I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below
I was manipulated and deceived by the owner Mr*** , who led me in believing they were a professional and reputable company that stands by their work He informed me that he had Approx: plus yrsin the business , and they were reputable and stand by their craftsmanship I checked with the B.B.Band they also confirm that the company was reputable and has a star rating with no problems I even asked my neighbors who had fences installed about their fences , and they had no problems This led me to believe that this company was legit In the company's rebuttal to my complaint they clearly stated that they made a mistake about my property , and I still charged it as human error People make mistakes , and need to except that and realize that thay aren't above the laws of the land once they notified that they made a mistake I never told them where to put up my fence , I never strung up the fence and so on the only thing that I did was believe in the company and paid them what they told me the job would cost ( ) Any reputable company would stand by their work The fence is less than 6months , and he wants me to pay an additional dollars to correct his company's mistake My profession is not putting up fences This his why I contacted this company this is what they do I contacted them on Tuesday , May ,@ ApproX : : p.mto try and make and appointment to have the fence moved off of my neighbors property they stated sarcastically , " we don't want to do business with you , because you report us to the B.B.B." However , I have to contact other fencing companies to come out and correct Bob *** Srcompany's mistake I want to be reimbursed for whatever this may incur , as well as attorneys fees and so on Sincerely ,

To whom it may concern: In response to the complaint submitted by Mr** ***Yes, we did install Mr***'s fenceWhen we give estimates our sales rep uses a measuring wheel to obtain the liner footage, this wheel does not assess property lines as Mr*** has stated, it only
determines the amount weather it be feet or feetMr***'s estimate was misquoted by human error and he was informed but his complaint is about the placement of the fenceWe have a very detailed TERMS & CONDITIONS to our contracts that is given to our customersThe must sign the first page and initial the second indicating they read and agree to the itI have attached the second page indicating Mr** ***'s initial that he read and agreed to the termsWe state several times over the course of speaking to customers that we are not a professional surveying company and if they are not sure where their property lines are that we suggest they contact a surveying company prior to the installation of the fence, this to is written in the terms/conditionsMr*** has made a allegation in his complaint that we used a tripod site, we did not use nor do we have such equipment in our possessionWe do keep a metal detector on hand to help the customer locate metal rebar if they state they have them however, this is just a guess and the customer still must agree that they are indeed their property markersIn our terms we clearly state we can not be held responsible for knowing where the customer property lines areWhen we apply for a permit on the customers behalf they only thing the permit office needs to know is the footage of the fence, a layout of the fence, and the cost of the jobOnce Mr*** called us about his neighbors concern we let him know we were not responsible for that however, we would come back out to see how much it would cost in labor to move the fence for himHe met with *** *** Srand was reminded of the terms and he requested we give him a price on the cost to move it overHe was informed that the cost would be $dollars and he said okay and to send over the new contractOn the contract and email it was indicated anything under $had to be paid in full upfrontOnce Mr*** was made aware of that he then was upset and made a call to *** *** Srand it was again explained to himWe had not heard from him until we received this complaint.

Pierce Fence is a professional and reputable company that has been in business for over years, this too is why we have a terms and conditions page to our contract that every customer must sign and agree to before we install a fenceQuoting Mr*** "In the companies rebuttal to my complaint they clearly stated that they made a mistake on my property" this is false, we stated that the first price given to him was a mistake and was corrected and accepted by Mr***, it had nothing to do with the propertyWe can not be responsible for knowing property lines and again this is why we have it written in the contract that if the customer is unsure of their property lines they should contact a land surveyor to mark it BEFORE we install the fence, if they choose not to take this step they are accepting responsibilityWe told Mr*** there would be a cost, over the phone, prior to us coming back out to move the fence and he still agreed for us to come back out to look at it We offered (via fax May 5th) /offer to remove the fence line and reinstall it for $700, the $dollar payment must be paid to the office the morning the crew arrivesMr*** may wait until the crew has arrived at his house to make the payment over the phone if that helps ease his mindWe can not do it for freePierce Fence is not trying to make a profit off of someones misfortune, the $is at cost to pay our crew and for the new concrete needed to do the installHad Mr*** not been a past customer of ours, the cost to do the same work would be higherWe are not willing to reimburse him for the cost of the land survey that he had completed after the install, when it is in the terms/conditions that it is something that should take place prior to Pierce Fence coming out to install the fence and was signed and acknowledged by Mr***Thank you.?

I checked with the B.B.B. and they also confirm that the company was reputable and has a 5 star rating with no problems .  I even asked my neighbors who had fences installed about their fences , and they had no problems . This led me to believe that this company was legit .  In the company's rebuttal to my complaint they clearly stated that they made a mistake about my property , and I still charged it as human error . People make mistakes , and need to except that and realize that thay aren't above the laws of the land once they notified that they made a mistake . I never told them where to put up my fence , I never strung up the fence and so on . the only thing that I did was believe in the company and paid them what they told me the job would cost . ( 72000 ) . Any reputable company would stand by their work . The fence is less than 6months , and he wants me to pay an additional 700.00 dollars to correct his company's mistake . We have a very detailed TERMS & CONDITIONS to our contracts that is given to our customers. The must sign the first page and initial the second indicating they read and agree to the it. I have attached the second page indicating Mr. [redacted]'s initial that he read and agreed to the terms. Once Mr. [redacted] was made aware of that he then was upset and made a call to [redacted] Sr. and it was again explained to him. We had not heard from him until we received this complaint.
