I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear belowI apologize for the incorrect dates about the claim I contacted MrPinelli in about our patio starting to sink. He said " the foundation is settling give it some time and we can come back and fix it" I wish I had that in writing but took his word for it MrPinelli also stated that he did not sell me this product but his name, as the owner is on the contract Mark the salesman told me that the patio would not shift or sink because of the base that would be used. Come to find out the salesman did some time in jail for running a "Ponzi scheme " so I should never of trusted him. MrPinelli also mentioned that he came back and fixed the size of the patio. The original patio that was installed was way under the square footage that I paid for and the wrong pavers and pattern were actually installed. One of the workers that installed the patio was drinking on the job. He actually told us that he did not have a license because of his drinking and that is why he was getting a ride to work everyday. The last day our patio was installed he spilled a twisted tea (an alcoholic beverage) on our brand new patio and tried to cover it up. I asked him why their was a stain on the patio and he told me what had happened. They then had to call another co worker to bring a tool that they used to remove the stained pavers to replace them I feel that the patio that was installed should not of sunk and that it should not be putting pressure on the side of my house and the siding. The way that the patio has settled also caused the water to puddle and collect towards the foundation of my house MrPinelli I also feel that I am an honest and fair person. We spent a lot of money on this patio and could of easily go with a stamped concrete patio but we went with you because of what we were told about your product and guarantee. It is not our fault that your salesman Mark gave us incorrect information He worked for you and we feel that you should honor what we were told and fix our faulty patio.

With respect to Mr. [redacted] I question the dates, times, and calls he is stating. This project was sold in spring of2009, and completed in the summer of 2009. The customer states that I, Anthony Pinelli was the salesman forthis project and that is also incorrect. I am very familiar with...

this project. A past salesmen sold this project andhe was not employed by Pinelli Landscaping in 2011. Therefore we did not construct this patio in 2011 as thehome owner states.After the initial project was completed. I was made aware that the home owner was not happy with the size ofthe patio we installed. Mr. [redacted] felt he was not given the proper square footage that was agreed. I met with thehome owners and agreed to enlarge the space of the patio because of their displeasure.The portion of Mr. [redacted] patio that has settled is along the perimeter of the house foundation due to thesettlement of the soil back fill. We can't control the process of placing the back fill around the foundation of thehouse. This is done by the builder. For example; if the subsoil's removed when trenching for the foundation haslarge portions of hard clay that has dried in the sun for days and sometimes months prior to the back fill process,it may take years for ground the completely settle. Foundations are 8ft deep. The issues with the patio is notcaused by the process of how we installed the patio.As an authorized contractor through our vendor, we need to provide our customers with a 2 year warranty onhardscaping services. That being said, we do not use this to our advantage for any short comings. I wouldabsolutely repair any faults beyond the 2 year agreement, as long as the issues is something that could have beenprevented in our building process. We like to build for long lasting results and unfortunately there are situationswe can't always control.I like to inform and give as much knowledge as I have to people regarding the construction of building and themaintenance involved with the unilock patios. Power washing yearly is a good idea to get the grime out from theseams of the pavers. When cutting your lawn, you should make sure that the clippings are swept off. Thepolymeric sand that is used to sweep into the seams collects moisture and in shaded areas you will occasionallyget vegetation. Just about everything around us has some type of maintenance involved.In the spring of 2014.1 did receive a call from Mr. [redacted] expressing his concern of the settling. I had mentionedto him that 1 can repair it later into the season when we slow down a bit. This project would be an additional costdue to the ground along the foundation moving. I wanted to provide the service later into the season, so I cankeep the cost down and make it fair and reasonable for both of us. I should not take blame for something I can'tcontrol. The foundation is 8ft deep and we can't control how it was back filled and how it settles. 1 can controlour process in building and depth of stone we use for the patio base, and I would put our integrity of buildingsecond to none.Over the past 20 years Pinelli Landscaping has installed patios and retaining walls. The quality of our work andreputation speaks for itself. I have been researching hardscaping for years and can say with complete honestythat we go above and beyond when it comes to constructing. To whom it may concern:The new landscape plantings were installed in a landscape bed with an existing retaining wall. The wall created the established landscape height of the plant bed (1 0-12"high). The retaining wall was not to be removed. The new plant bed was built inside the existing wall, at...

the homeowner's request. After the work was complete, the customer were very satisfied with our services and had no complaints. It may be possible that there is an issue with the foundation that is allowing water to enter the basement. We understand his frustration, but we cannot take responsibility for something we did not cause. We also had arecord breaking year with rainfall that most likely did not help the situation. In response to Mr. [redacted] second comments to the Revdex.com complaint ID [redacted],As I slated in my first response the information that Mr. [redacted] is providing needs to be questioned. If heremembers correctly it was I who stopped by his house while working in the neighborhood. He had justcome home from work. It was several years later and I want to say it was either 2012 or 2013. First hestates we built the patio in 2011, now he says that he called in 2011. He also stated that he called 3times on this matter and that again is incorrect. It was I who stopped by his home.Because I didn't sell the job, doesn't mean I don't stand behind our work. In fact it was I who wasstopping by the job site during construction. I also had the crew enlarge the size of the patio stone baseafter viewing the shape. The patio had a tight inside curve to it and I had the guys bring the stone baseout more and square it off, so it would give us more room to work with. The patio was built accordingto the plan that was agreed on.The cost of the patio was fair. The larger the area, the less it cost per square foot. The smaller the patio,the more it cost per sq. ft. The patio was not way under square footage. We built it as per plan. It wasnot a large area and I understood that. Mr. [redacted] and I had met and I agreed on enlarging the area. So wecame back at no additional cost to solve his issue.It is clear that Mr. [redacted] is trying to discredit our company. I have no problem repairing the work at avery reasonable cost for both of us. I appreciate all business that comes our way, but I will not be put ina position of being taken advantage of.Mr. [redacted] mentioned, he would have gone with stamp concrete if he knew better. Concrete would havedone the same, but worse, and it is not guaranteed. We actually have a stone base compacted, concretedoesn't. It would have cracked and shifted because of the settlement along the foundation wall. Theywould have to replace the entire patio, if he chose to go in that direction. By choosing the pavers, wecan repair the area needed with the same product without removing the entire patio.I would like to handle this in a more civil way then bickering back and forth. I stand behind our workand I will be more than fair on agreed cost to repair it. I would also be willing to get there soon to dothe service and correct the problem.I believe what really happened here is that Mr. [redacted] and the salesman had agreed on doing someadditional landscape work around the patio on Pinelli' s dime, and in return the salesmen would havedone the front landscape planting for him off the record. Because I am involved with most of ourprojects, I believe that I put a stop to that and that is why he is going to this extent. I say this because ofconversations I had with the crew, salesman, and Mr. [redacted]. I have more detail I can add to this, but Iwould rather not continue bringing up other situations.
