This is all I have as I have stated in prior communication I was asked to send my original contract to pinnacle by mailBecause I complained and noticed it was adjusted when I asked for it back so they could have their copies they never returned them this is all I was able to obtain from my previoya salesman Michael who no longer works for ** *** *** or pinnacle financialI had them come to pick the vehicle up because they were charging me plus for insurance and I had my own and they kept telling me I didnt ive send so many proofs and so has the insurance company and they were still charging pinnacle stated they needed needed the original copy of my contract to prove it was adjusted and they wouldnt accept copies in fear of alterations and again I never received my original back is why I cant provide all of it to you I have been scammed and ripped off they are saying I owe for a used *** not even a blind person would but that or in desperate need at all.These people are scammers and liarsThey did send a contract by email but it was not tje contract I had sent them it wa girl named *** *** *** and every time I ask thats what they send that is not who I am and they know it

This shall serve as Pinnacle Financial Group's ("PFG") response to *** ***'s complaint.
PFG bought *** ***'s Retail Installment Sales Contract from Auto Connection April 23, which is attached. After reviewing the Collection History Notes and Payment History
(attached) *** *** first payment was returned non-sufficient funds ("NSF"). The bank account given by *** *** at the point of sale was closed. June 9, *** *** emailed in and requested a due date change and wanted to give new bank information. PFG emailed her a change of bank information form; however, we did not receive anything back from her. June 22, *** *** called in and said she was moving and would *** ("**") the past due payment. July 1, Ken spoke with *** *** confirming the due date change and she gave us bank information at that time authorizing one payment. On July 22, the July 1st payment was returned NSF and the account information was removed. PFG sent an email requesting new bank information on July 22, and *** *** did not get us the bank information until August 7, 2015. On August 11, *** *** authorized PFG to debit her account for two payments. At no point did PFG debit *** *** account without her authorization. Per company policy we do not change or resubmit any Electronic Funds Transfer ("EFT") or Automated Clearing House ("ACH") payments in regards to the amount or scheduled date without the customer's consent by recorded call or signature. Per company policy, state laws and Fair Lending Policies, Pinnacle does not add any charges that are not described in the Retail Installment Sales Contract signed by the customerAny charges or fees that she disputed were credited back to her loan.On December 8, the contact phone number for *** *** was No Longer in Service and was removedWe attempted to locate her by calling references for a better contact number. Per company policy we only attempt to contact references if we cannot locate the customer and no information about the loan should be disclosed. December 10, 2015 *** *** called in and was upset about previous NSF's, late fees not being waived, no mention was made of a financial hardship or need for deferral, and she hung up on PFG. Subsequently December 22, *** *** stopped her payment and was returned NSF. On December 29, she emailed PFG stating she cannot received calls to her personal cell phone at work. Per company policy we will defer payments with proof of hardship and/or a payment and as best practices we attempt to contact the customer and educate of the deferral process and how it affects their loan rather than defer a payment without consulting them
At the beginning of January PFG performed data analysis on our inbound and outbound telephone calls, PFG came to the conclusion that too many dropped or missed calls were occurring after 6:30PM. Management decided to change the schedule of the Collection Department to better fit needs of the business and customersThis most likely contributed to the "all of the sudden" change for *** ***January 27, *** *** was trying to make a payment via our website, customer must supply their account number and last of their Social Security Number which is required to make the payment via PFG's website. *** *** emailed us trying to verify her account information via email and per Pinnacle Policy e-mail communication must be general in nature and cannot give non-personal information ("NPI"). Pinnacle does not refuse web payments unless the account is tagged "No Web Payments" which at no point was *** ***'s loan tagged with that code.
January 29, *** *** threatened legal action and requested no more telephone contact to her personal cell phone while she is at work. At that time we removed all telephone numbers and the account has been flagged "Cease & Desist" February 5, *** *** called in and talked to Ken Q*** and gave him permission to call her at ###-###-####As of today, I will review the account with the Operations Manager and Collections Manager to adjust *** ***'s account this one time as a courtesy and will contact her via e-mail to let her know of this adjustment

guidelines are specific and apply to military members that had an existing loan prior to active duty and  entering the military or a transfer of duty station. [redacted] entered in to this contract as a 21 year military service member and the SCRA does not apply because [redacted] was an existing service member.  A courtesy was offered to t[redacted] to give a 5.00% rate reduction because [redacted] has been an excellent customer with Pinnacle,and [redacted] declined the offer. primary account representative since 2013 and maintains a professional attitude when speaking with any of his customers. [redacted] came to our office February 16, 2015 and spoke with Ken about her account. Mr. Q[redacted] explained her payment history & past due amounts, our contractual policy of insurance coverage, and gave [redacted] a copy of her RISC (Retail Installment Sales Contract). She made payment and is now up-to-date. [redacted]s communication with Pinnacle have been because of late payments and payments being returned for non-sufficient funds (NSF). We hope this last meeting Monday February 16, 2015 helped her understand our attempted communications with her when her payments are returned NSF and when they are late.

I am rejecting this response because:This predatory lending which imposes unfair or abusive loan terms on a borrower. I was convinced inot accepting unfair terms through deceptive, coercive, exploitative or unscrupulous actions for a loan. I was at the time told that I was consider at risk-based pricing — tying interest rates to credit history and was being charged a very high interest rates in which I might likely default.My monthly loan payment is $403 in which only $152 is the actually payment that does not apply to the principal which adds more to the unpaid balance. I was told by the finance representative that after making several good payments I can refinance. I have never been late on my 24 payments and now I was told that they do not offer refinancing.Yes, the supervisor offered 5% off the loan amount, in which I said it should be off the principal since after 3-6 months of the loan. He refused to take my offer. I also asked if they could drop the amount of the balance by $2000 to $3000 in order to trade the car in and he refused that offer. Right now I owe $13403.00 on a car that is valued at $5,500. So I will have to pay out $8,000 in order to trade in the vehicle.  The lender adds language to a loan contract making it illegal for a borrower to take future legal action for fraud or misrepresentation. The only option, then, for an abused borrower is arbitration, which generally puts the borrower at a disadvantage. The APR on the contract has locked me in on the life of the loan.

[redacted] did have knowledge of the sale to Pinnacle Financial she was informed via mail, electronic mail, phone and in person when she made her payment in cash to Pinnacle Financial. Regarding the contract signed by [redacted] the contract shows a down payment of $2,000.00. The buyers order and credit application along with [redacted]’s driver’s license all match the signature on the contract showing $2,000.00 as a down payment not $2,600.00. [redacted] account was credited for two charges of $95.00 on June 7, 2017, this occurred after we received the proper documentation showing proof of insurance coverage. Review: I signed a contract for a car for 30 payments. When I called for an early pay-off balance, I was told an amount of $2.200. the person I spoke to acknowledged the fact that I have only 2 more payments of $282 due on the car. He couldn't tell me why the balance was off by such a large amount. Over the course of a week, after calling repeatedly for an explanation, I was told to look at my contract again. When I did, I finally saw that my down payment of $1,900 wasn't deducted from the balance of the car. Instead, my down payment was rolled over into the loan, as well as the title, taxes and tags. So Pinnacle expects me to pay back my own down payment, with interest. Pinnacle said if I refuse to pay the additional money, if I refuse to pay more than the 30 payments I signed for, the car will be repossessed.Desired Settlement: I want to pay the last 2 payments I contracted for and receive my car title.

Review: After agreeing to pay my car note along with my insurance through this company. They decide to take the exact amount out of my acct for the car payment but not for the insurance . In which I was later informed that instead of my car payment being paid they were deducting my insurance form my car payment inturn making me deliquient in my car payments not my insurance claiming they didnt have permission to take my insurance out of my acct so they deducted it out of my payment in which puts me up for repo!!!!!!! Very unprofessional and messy.

Review: I purchased a vehicle through [redacted] Automotive, with a lease agreement through Pinnacle Financial. Since dealing with this financial institution I've experienced nothing but rude disrespectful harassment. Upon signing the lease agreement and other paper work I began to receive harassing phone calls regarding information which I thought was not necessary such as other family members I lived with and their occupations. What does this have to do with a car I'm purchasing and I am the sole owner/purchaser? Several months later I called to find out what the interest and pay off amounts were, I talked with a gentleman who refused to send me information disclosing payments, receipts etc. He informed me that Pinnacle does not send receipts or paper correspondence of any kind & proceeded to insult me by saying I know nothing about interest or credit. I later managed to get a fax stating my payoff amount after speaking with another associate. I had been making bi weekly payments at [redacted] Automotive until March of 2013. Due to Pinnacle not receiving payments in a timely fashion through Hopkins, resulted in customers having to make their own payments directly to Pinnacle. Due to working @ a university on a contractual basis my income is not consistent, however it is always in my best interest to bring debts current and complete. I made a payment arrangement with Pinnacle to pay $200 of the $366 dollars to bring me current. I sent $200.00 via money order on Friday 01/17/2014. Today on 01/21/2014 I received a phone call from a private number from a man who left a voicemail & who I found to be rude. I then repeatedly called the number for Pinnacle with no answer & left a voicemail to ensure the payment had been sent. I really am tired of the rudeness every time I make a call or receive one to this establishment.Desired Settlement: I would just like a consistent direct person I can talk to regarding my account and some documentation regarding my account vs. a fax which looked like it was printed from a personal computer. I am in no way trying to be evasive, I just don't like being belittled just because of my credit history.

Pinnacle Financial Group is listed in lieu of [redacted] of Arlington. [redacted] of Arlington is now closed and the phone number is disconnected. I was informed the dealership may have relocated to Maryland. However, I do not have an address. Pinnacle is withheld the release of and is responsible for the loss of my personal property.

I purchased a 2003 Mercedes Benz E500 from [redacted] of Arlington on November 13, 2012. The vehicle is financed through [redacted]. My account is current.

On October 7, 2014, I discovered that my vehicle was not in the spot that I parked in the previous night. I contacted my property management office and confirmed the vehicle was not towed. My resident parking sticker was properly displayed. I contacted my lien holder, [redacted] Services, to confirm the accuracy of my loan account. [redacted] confirmed the vehicle was not repossessed and my account was current.

I contacted the Arlington County Police Department to report the vehicle stolen. The Responding Officers, [redacted], informed me that the vehicle was reprocessed by Pinnacle Financial Group (301-652-4700). This company is the alleged lien holder of the previous owner, [redacted].

I filed a formal complaint with the Virginia DMV-Law Enforcement on October 7, 2014. Mr. [redacted] was assigned the case and took my statement. I was informed that I was one of several victims of fraud committed by [redacted]. He is currently investigating my case.

In an attempt to contact [redacted], I discovered the location was out of business. I was able to contact the previous owner, [redacted], through a social media site. He stated he was unaware of the outstanding lien by Pinnacle. I was informed that his attorney attempted to make arrangements to return the vehicle to me to no avail.

I contacted [redacted] to inform them of this information. [redacted] confirmed they have a clear title for this vehicle and are the sole lien holder. The [redacted] Branch Manager [redacted] contacted their legal department to determine their rights but would not release me from my loan agreement at this time.

I contacted Pinnacle Financial Group. Pinnacle's Branch Manager Tony informed me that the dealership had no right to sell me this vehicle and I shouldn't have been able to register it in Virginia.

At that time, I informed Tony I just picked up the vehicle from the auto repair shop on October 4, 2014. I spent approximately $12,000 on the vehicle including my biannual registration renewal, annual personal property tax fees, general maintenance including wiper blade replacement, a new hydraulic tire jack, minor general repairs, compete suspension and headlight system replacement to pass annual state inspection, biannual emission inspection, monthly car note, insurance payment, a full tank of gas and new 20 inch chrome rims and tires to replace the damage items due to the suspension issues.

During this conversation, I stated several times I wanted the vehicle back. I also stated that I had a lot of personal property in the vehicle due renovations currently underway at my place of residence. My personal items includes my iPod, my mother's medical documentation, work related documentation, a digital camera, a Garmin GPS unit, my winter coat, my gym bag containing heart monitor, iPod, Jawbone Activity Device and some items I recently purchased for Christmas.

Additionally, I informed him I was the primary caretaker of my mother who is permanently disabled and paralyzed on her left side. Therefore, I need my vehicle back as soon as possible so I take her to her medical appointments and pick-up her prescriptions. I shared that my current commute hardships. My normal 20-minute commute is now 2 hours on metro which causes my mother to be alone for extended periods of time.

Tony stated that the vehicle would be held until a solution could be made and the vehicle could not be sold until the title issue was resolved. He informed me that the vehicle was in a safe location and my property in the vehicle was undisturbed.

I have contacted Pinnacle several times per week since this occurred to determine a course of action to recover the vehicle and my personal property. Tony stated if the lien was satisfied for approximately $8,000, the car would be released to me. He stated he wanted me to have the vehicle back because he was informed by the towing company that the vehicle was in good condition and cared for. However, Theron informed that his attorney made several attempts to negotiation an agreement with Pinnacle to not avail.

On October 31, 2014, I informed Tony I wanted this resolved so I would pay for outstanding lien amount and wanted my property. He informed me that the vehicle was a [redacted] and I could contact them directly to obtain my property. He also stated that I should contact Rob C[redacted] on November 2, 2014 to make arrangements to pay the lien.

When I contacted [redacted], I was told the vehicle was not there. The vehicle was released for auction two weeks ago and was located to [redacted]. I called Tony at Pinnacle back immediately. He then stated the vehicle was relocated to [redacted] and was being held there because it was incurring excessive storage fees at [redacted]. Tony said not to worry because the vehicle was not auctioned nor would it be auctioned. I contacted [redacted] to make the arrangements to pick up my property. They said I would have to make an appointment the next week and someone would call me back by November 5, 2014.

On November 3 - 4, 2014. I made several attempts to contact Tony and Rob regarding the arrangements. They didn't answer my calls or return my messages. On November 5, 2014, I finally spoke to Tony. He stated that the vehicle wasn't mine and it was auctioned. He said they were trying to get it back but it was going to take a few days. When I asked about my personal property, he stated he didn't know where my property or tags were and he didn't have anything to do with it.

[redacted] returned my call on November 5, 2014. I was informed that the vehicle was auctioned in October 2014 but that's all the information they would provide. I was told I would have to contact Pinnacle directly for more information.

On November 22, 2014, Tony finally confirmed that the person that purchased the vehicle wouldn't give it back.

Since I can't get a straight answer from Pinnacle and the [redacted] and [redacted] won't provide me any information, I can only conclude that my personal property still with the vehicle at the time it was auctioned.

I have called Pinnacle several times every day since November 5, 2014 with no response. Pinnacle has been extremely uncooperative, disrespectful and unprofessional through this entire ordeal. They have hung up the phone on me, not responded to my numerous messages and spoken to me in a manner as if I was to blame for this situation.

Since October 7, 2014, Tony had me believe that the vehicle and my property were safe at [redacted] and nothing would be done until the title issue was resolved. That was not the case. I have experience great loss due to this situation, I lose my vehicle and personal property, still being held liable for the remaining loan balance and the $12,000 I spent 3 days prior to this incident. At this time, I am unable to purchase another vehicle due to the expenses I recently paid on this vehicle and the loan is still on my credit report.

I am currently seeking an attorney to represent me in court.

Any assistance you can provide in the resolution of this case would be greatly appreciated.

Release from my current loan with [redacted] Revdex.com was notified by the business that this matter was resolved pursuant a settlement agreement after a court case was filed with the United States District Court for the Eastern District of Virginia. In accordance to Revdex.com policies, we will not reopen the complaint to change the closure.
