Complaint: [redacted] I am rejecting this response because:The response from the company is not the truth I submitted a request with specific instructions for a custom product The original communication requesting the product is attached In fact, the company had made this exact product for me in the past The company sent me a price quote for the product, but changed the specifications from the specifications they had originally built and that I had again requested I accepted the order, and now I am being punished for not catching their mistake Seems odd, doesn't it, that the customer is responsible to make sure the company doesn't make a mistake, especially when they had already produces the product? I am rejecting this response because it is laughably unreasonableHow silly to say that it's my fault because the sofas happen to be near a window; that is, near the back of my house Don't most people who have garden furniture have that furniture near the backs of their houses? It's not as if all of us have acre upon acre of backyard space; it would have to be the case that most people have their outdoor furniture near the backs of their homes and, therefore, near windowsThis whole thing is just so silly It would be like buying car wax that destroyed the surface of your car only to have the company tell you that you shouldn't have parked your car so close to a windowAny way you cut it, these people are making money essentially selling snake oilThey are thieves who destroyed my personal property and in lieu of absconding with my hard earned money, ought to be doing the right thing by prpvodong a full refundThe disregard for ethical behavior really shocks the conscienceAnd if by some stroke of legal misfortune or technicality I am unable to get the refund I deserve, I assure you I will prevail in articulating to the online and offline world the nature of their conduct to an extent that costs them hundreds of times more than the simple refund would have.

*** *** went on the website and requested a quoteHe then emailed and requested another quoteQuote *** the quote he himself put on the website was submittedThis order was made and shipped 6/04/He agreed to this contract to these dimensions

The customer received his quote on October The contract is attached and he filled out the form and submitted the order to be made on the 12th along with paymentWe offer free shipping for order over $bought on our websiteCustom covers are not ordered on our websiteThe customer emailed on
Octasking for the free shipping to which we explained it wasn't for custom coversHe then asked for his order to be cancelledOn the contract he submitted it states You understand that custom covers are non-cancelable, non changeable, and non refundable We charge half of a custom order when it is ordered and the other half when it shipsI attempted to prevent this from getting nasty by offering to let him cancel but he would be out the initial charge of because fabric had already been cut and it had been startedHe then asked to speak with a manager and I sent his letter to the managerThe manager again trying to prevent this from betting nasty agreed to give him free shippingThe customer informed us he had lodged a complaint with his credit card company at which point we have to work with them and not the customerAt that time his cover was complete so we completed his order by sending the cover and charging the remaining amount dueWe received his order, we made it and we sent it

I am rejecting this response because the writer of the response does not understand the lawThey are hanging their hat on the notion that their warranty doesn't cover what happened, but that's a bunch of rubbishHere's why: Clearly, there was no vandalism, neglect, misuse or improper use (not sure how "misuse" and "improper use" differ, but whatever); even THEY recognize thisAs far as "conditions" is concerned, it is perfectly to have a sofa in your backyard that is within reasonable proximity to the back of your house and, thus, to windowsAnd as far as "acts of God" is concerned, there is no way that they can disclaim force majeure in its entirety when the very product they produce is intended to safeguard against acts of GodThat's why people buy sofa covers to begin with. Can you imagine buying roofing tile or tar paper that tried to disclaim the effects of rain (too much rain could cause a leak - and that's your problem) or car wax that tried to disclaim the effects of sun (too much sun could destroy your paint - and it's your tough luck)It's positively ludicrous. Revdex.com, please get involved hereYou have a crooked business for a memberThey produce a product that does not workIt is sold for a particular purpose, and it failsAnd now they are refusing to do the right thing for consumersThey should be reprimanded and forced to do the right thing or threatened with sanctions and the revocation of their membership. I am quite sure I am not alone, and I'd be happy to be the plaintiff in a class action lawsuit that could very well put these mns out of businessAnd don't think I won't do it because now I'm on a mission that is principled, and I will not stop until these people recant and do the right thingI promise that the combination of (a) defending a class action lawsuit, (b) paying claims to all of those whose fabrics have failed or, worse yet, destroyed personal property and (c) taking every product you produce with that fabric off the market will be a hell of a lot more expensive than refunding my moneyMaybe math is not your strong suitI'm having trouble understanding why you wouldn't see the logic here, but if you want to keep digging your heals in and not refund my money, get ready for the mother of all battles

I'm sorry the error was on the customers sideHe submitted the wrong quote but we made the quote he did submit correctly

*** bought covers made in our Koverroos III fabricHe then put these covers on furniture next to windowsThe sun magnified through the windows and melted the coversOur covers have been tested extensively for performance in the sun and they don't melt under direct sunI don't know of
any cover that can handle magnification through a windowWhile we were very sorry to hear of this problem our warranty states: The warranty protects your furniture cover against damage when used under conditions and does not cover damage from acts of god, vandalism, neglect, misuse, or improper use such as wind whippageThese covers were not damaged under circumstancesCustomer service representative *** and *** both tried to resolve this issue by going above the warranty and offered the full amount *** paid to apply to a hardier fabric in hopes it would not melt when magnifiedIt was rejectedWe have tried to help with *** problem but anything we offered was rejected

Our warranty covers: Warranty is calculated from the date of original purchase. The warranty protects your furniture cover against damage when used under normal conditions and does not cover damage from acts of god, vandalism, neglect, misuse, or improper use such as wind whippage. Damage caused by heavy storms and high winds will not be covered under warranty. Warranty is void if the cover has been modified in any way. This warranty is in lieu of all warranties expressed or implied, and under no circumstances shall we be liable for any damages in excess of the covers' original purchase price.While we are very sorry this has happen and went over what =the warranty covers in an attempt to help resolve this issue we are not responsible for these covers.

rejecting this response because:The response from the company is not the truth.  I submitted a request with specific instructions for a custom product.  The original communication requesting the product is attached.  In fact, the company had made this exact product for me in the past.  The company sent me a price quote for the product, but changed the specifications from the specifications they had originally built and that I had again requested.  I accepted the order, and now I am being punished for not catching their mistake.  Seems odd, doesn't it, that the customer is responsible to make sure the company doesn't make a mistake, especially when they had already produces the product?  So they say I'm at fault - for not seeing their error.  Great concept of customer service.
