Hello [redacted] I reviewed complaint number [redacted] is correct with most of the details he provided.[redacted] did apply and paid $45 for application and $250 to hold the apartment.However, after a standard 48 hr. background check his application was denied.The manager refunded $250...

to [redacted] on January 3, 2017. I have attached records of the refund as proof.We have never denied to refund his $250 and we have not received any follow up calls or communication on January 9 or January 23.  After further review of this case I did discover that we had an IT problem with accounting on this transaction and although we did refund the$250 in our system, it may not have reached [redacted]’s bank account. attached document was received by the Property Manager.  Accommodations for a different parking space were requested by the Tenant to the Property Manager and accommodations were denied.  Accommodations were denied based upon an alleged lack of justification.  To the contrary of the response from the Property Manager, the Tenant disagreed that additional justification was warranted since the request for additional justification is unreasonable and created an additional burden upon the Tenant.  The Fair Housing Act Sec. 802. [42 U.S.C. 3604], as described by the Property Manager, outlines the offense twofold:A refusal to permit, at the expense of the handicapped person, reasonable modifications of existing premises occupied or to be occupied by such person if such modifications may be necessary to afford such person full enjoyment of the premises, except that, in the case of a rental, the landlord may where it is reasonable to do so condition permission for a modification on the renter agreeing to restore the interior of the premises to the condition that existed before the modification, reasonable wear and tear excepted. Moreover, a refusal to make reasonable accommodations in rules, policies, practices, or services, when such accommodations may be necessary to afford such person equal opportunity to use and enjoy a dwelling.  Ref: Fair Housing Act Sec. 802. [42 U.S.C. 3604].With a plethora of unfilled parking spots available, a reasonable accommodation is requested under Fair Housing Act Sec. 802. [42 U.S.C. 3604].

and meetings with [redacted] reiterated this was correct. As a service measure as [redacted] has previous positive reviews on social media we provider a customer service rent credit in the amount of $300 which [redacted] agreed to for the A/C defect. Thank you for your assistance. Best regards, [redacted]
