Installed landscaping last fall. 40 dead plants come spring. Initial contact in May. Ignores calls and emails. Works still not completed. Landscape plants were originally set on new construction 11/16/14. None of our plants (39 or 40) on front slope survived the winter. Initially emailed [redacted] 05/19/15 with photo asking for feedback. No response. Left messages on voicemail. No response. Finally confronted him on neighborhood job site. He indicated that he'd had some payment issues with our builder, but not on our house, and that he would surely replace the plants. We waited quite some time, then started trying to reach him again. Phone calls and voicemails go unanswered. Next contact (September), he indicated that he would prefer to do it when neighboring home was being landscaped. We agreed to allow that. That home was landscaped on 10/22. Ours was initially to be done that day, as well. He contacted us a few days earlier to confirm the number and type of plants needed and assure us that he would replenish the pine straw, as well. On 10/21 he informed us that our job was now scheduled for 10/23. His crew spent all of 10/22 next door; but never showed up to do our job on 10/23. Every attempt to reach him via phone after that date went directly to voicemail. An email was sent on 10/28 to [redacted] which outlined our concerns and indicated to him that we wanted the job done THAT week, and to please call us if that was not possible. The job was not done. We never heard from him. On 11/02, my husband finally got [redacted] to answer his phone by calling from a different phone number. He was told "we'll play it by ear", "this week or next", "I'll call you by the end of the week." I followed up that conversation with yet another email on 11/02, informing [redacted] that if the job was not completed and completed properly by the end of that week, then I would file this complaint. Not having heard from him by the end of the week, after he stated that he would call, we made one final attempt on 11/06. Our call once again went straight to voicemail.Desired SettlementWe want [redacted]/Pinnacle to replace our dead plants. (We also asked him to pick up several additional plants, which we would pay for, to fill out the area better, which he also agreed to do.) We would also like a fresh covering of pine straw.Since we are now entering into winter, our preference would be to have Pinnacle perform this work next spring, no earlier than April 01, 2016, no later than May 01, 2016. We would like to have this agreement in writing.After receiving restitution from our builder (which was an unsettled matter on a property *other* than ours), Luis contacted us immediately and has agreed to perform the requested services this coming spring.
