Pioneer Contractors

Contractor did not start the work for months and did not return the deposit when asked. He kept delaying and not showing up but kept promising he would start work soon. He promised to send a sub contractor and deliver all the materials. It did not happen. His email stopped working on the day that he was to have the deposit money to me. He is not answering the phone.[redacted]Desired SettlementThe contractor was contracted to build a fence. He did not do any of the work but did ask for a materials deposit of $750. I paid him and he kept citing delays for months, each time assuring that work would begin in a few days but it did not. I asked for the materials deposit back. He said Iwould have it in 14 days- he would send by [redacted] by Sept 2, 2015. It did not arrive, now he is not responding to my calls and texts and his email does not work anymore. I want a FULL REFUND OF $750Business Response [redacted]Due to medical issues arrising in spring, I was unable to build her project. I then sub-contracted it out as a few other jobs, and the sob-contractor faulted on me. As a result I had to permantley close pioneer contractors down and am no longer operating it. I am in the process of issuing refunds and the above mentioned [redacted] will recieve a refund within 10 buisness days. There has been materials delivered to site. I see that that was failed to be mentioned. as well as email and phone have been shut down due to closed company finances. As stated a refund is in issue within 10 buisness day. Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)-[redacted] has stated multiple times that he will pay and has not once pulled through. He gives a timeline such as "I will send a refund within 14 days" and then does not respond, resets his timeline to pay when he does respond, or disconnects his phone or email. In this case, "10 business days" will be Oct 13 while I only have 14 actual days to accept his response or not. He should be given a firm shorter timeline to pay-five business days or 10 actual days with the stated amount ($750) made out to me, by certified check, or e-transfer. A personal check is not sufficient as he may not have the funds to pay and he may even close his bank accounts in order to avoid paying. I also have absolute no proof that any materials were dropped off by him at my home- I asked for a receipt or invoice and he did not provide this-therefore, he cannot claim he left materials at my home because he has no proof. He also closed his email and phone and did not give me notice or an alternative email and phone number to contact him by.I ask for the following:1. Certified check or e-transfer of $750 in a secure, certified (with funds assured from his bank) form to Revdex.com in my name to be paid to me within 10 days of his initial reply-Sept 29 so $750 by Thurs Oct 8, 2015.2. That he give up any claim for materials or labour3. That I and [redacted] be completely released from any contract obligations-in written signed form. We owe him nothing.3. That he provide an address, phone number, and email to the Revdex.com and to me in case we need to track him down again.Something like:"I [redacted], "Pioneer COntractors" hereby release [redacted] and [redacted] of [redacted],Saskatoon of any fees, duties, or obligations to me or Pioneer contractors for the fence building at [redacted] and agree to pay [redacted] back her materials deposit of $750 in a certified check or e-transfer form by Thurs Oct 8. I give up any claim on materials and costs and agree to stay away from their property. I am providing my new phone number: ...... and email:..... in case they need to contact me.[redacted]
