Complaint Without my permission and while I was not home, Pioneer Sealcoating applied BIN primer paint to my factory finished garage doors and vinyl siding.On or about July 5, 2013 Pioneer Sealcoating splashed sealcoat material onto the maintenance free white, steel, factory finished baked enamel garage doors and white vinyl siding and aluminum trim of the front of the garage of my home. When unable to remove the sealcoat material from the affected areas, without my permission and while I was away from home, Pioneer painted over the affected areas with BIN primer paint. This caused an eyesore due to uneven color shading and established a situation which would require maintenance when the paint would flake and peel in the future, thereby breaking the maintenance free status of the affected areas.Pioneer Sealcoating advised me that they had brought out (when I was not home) a professional painter, who advised that the doors should not be painted, but replaced. They advised that they then brought out (when I was not at home) a garage door expert who advised that the doors should be replaced in their entirety and not just the panels affected. They turned the matter over to their insurance company, [redacted] who wrote an estimate calling for the garage doors and the affected vinyl siding and aluminum trim to be replaced. After repeated telephone contact with Pioneer sealcoating which brought no resolution, on January 21, 2014, I notified in writing via certified letter, Pioneer's owner, [redacted] that it has cost me [redacted] to restore the affected areas to pre-loss condition and requested reimbursement in that amount from Pioneer Sealcoating. To this point, Pioneer Sealcoating has made no indication to me that intend to come honor the requested settlement. Desired SettlementI am seeking payment in the amount of [redacted] from Pioneer Sealcoating to recover the cost to me of restoring to pre-loss condition the damage caused by Pioneer Sealcoating applying BIN primer paint to my baked enamel factory finished maintenance free garage doors and maintenance free vinyl siding and aluminum trim. This represents the cost of labor and materials to replace the two damaged garage doors and and affected vinyl siding and aluminum trim. I am willing to subtract [redacted] from the above amount representing the cost of the driveway sealcoating work completed by Pioneer on my property on or about July 5, 2013. Pioneer's representative, who gave [redacted] name as [redacted], indicated that Pioneer did not want payment until the matter of the damaged caused by the company was dealt with in a manner which met with my full satisfaction. Business Response On July 5,2013 Pioneer Sealcoat LLC seal coated the consumer's driveway. During the evening there was an apparent rainfall that was not in the forecast and as a result some of the material splashed up onto the consumer's garage doors. Pioneer Sealcoat LLC was notified of the damage to the garage doors on July 16th, 2013. Contradictory to what the consumer states, he was made aware that we were sending out a painter to assess the damages on the garage doors. However, in most instances, messages were as the consumer spends summers at his home on Cape Cod and spent some time in Texas. The painter was sent during the time frame of between July 16th and August 16th and advised at that time that the garage doors would no longer be considered " maintenance free " however with the paint available today, the paint could last twenty or more years. The consumer contacted us on August 16th to say that this was unacceptable. Pioneer Sealcoat then left two messages on August 27th offering to replace the garage doors with new panels. We then informed the consumer that we were sending [redacted] and [redacted] during the week of September 12th and the consumer was quoted a price of $ [redacted] to replace the doors and trim at wholesale price. We were then contacted on September 19th by the consumer stating that the resolution was unacceptable as he had received an estimate in the vicinity of $ [redacted] September a claim was filed with Pioneer Sealcoat's [redacted] Pioneer was advised by [redacted] after filing the claim not to be in contact with the customer any longer. However, numerous conversations did take place after the claim was filed as Pioneer was trying to act as a liaison between the insurance company and the consumer in an effort to facilitate a satisfactory resolution between the two parties. This was due to the consumer not agreeing with [redacted] appraisal of approximately $ [redacted] During the last conversation between the consumer and [redacted] inquired if they might send out another impartial contractor for estimate purpose. They were told not to send anyone to his property. At that point in time, Pioneer stopped conversation with the consumer because it was apparent that he was unwilling to work with the insurance company. To the best of our knowledge, the consumer has only received one estimate from a contractor that the consumer has an established relationship with. To date it is still not known to us if the consumer has had the repair work done. While many contractors in our field do not carry insurance, Pioneer Sealcoat LLC is insured for unlikely events such as this although to date we have never had a situation in which we have had to file a claim. In recognition of the damages claimed, [redacted] has stated several times that their appraisal was accurate and reasonable.Final Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)Pioneer Sealcoat advised me that the painter they sent to inspect the garage advised that the doors and siding should not be painted, but rather should be replaced. Pioneer advised that the garage door person that they subsequently sent to look at the garage doors advised Pioneer that the entire garage doors and not just individual panels should be replaced.The original measurements of the doors and siding materials were inaccurate. Once correct measurements were given to them, Pioneer would not honor their promise.Pioneer Sealcoat needs to reimburse me for the [redacted] which it has cost me to replace the two garage doors and vinyl siding and trim on the front face of my garage to which they applied BIN primer paint without my permission.Final Business Response Pioneer Sealcoat has tried to resolve the consumer's complaint, but the consumer does not appear to be willing to move from his position. The consumer is in receipt of a check from [redacted] Company in the amount of $ [redacted] This amount was based on their assessment to restore the affected areas to the consumer's property. During the month of September 2013 the consumer was informed that Dracut Door and Window could not paint, but Replace the doors and affected areas for $ [redacted] This amount was unacceptable to the consumer because he had already obtained a quote from a contractor that he has utilized in the past in the amount of $ [redacted] As this was a substantial difference, [redacted] then offered to send out another contractor for the sole purpose of obtaining another quote. [redacted] was told by the consumer not to send any one else to his property. So two SEPERATE parties: a reputable contractor AND an insurance adjuster were in alignment with a replacement cost while the consumer's selected contractor's quote was 80 % higher than the other two parties. If the consumer had allowed [redacted] to send another impartial contractor to assess the repairs instead of insisting on sticking with his inflated estimate, perhaps all of this could have been avoided.
