I signed onto Piper Noble as a Founding Ambassador. We had to pay $500 into the company to be a funding member. They promised special training, customers to be routed to us, etc. None of these promises happened. She had corporate staff that were working hard and not getting paid and they all ended up quitting. They had 2 back offices that had failed and stopped all communication with Ambassadors. Now the CEO is on her own with no corporate staff and is terminating anyone that asks questions about what is going on with the company. Many people have not been paid any commissions that they have earned and the company is still taking sales of their own and not directing them to ambassadors when this is a direct sales business. Those of us that have been terminated have requested proof to back the reasons of termination and have received none. When we have asked for refunds we get ignored and don't get any responses from the company. I do not believe that this company has all the right certifications to even be running their business.

Desired Outcome

Refund I would like a refund of my initial investment as all the things that were promised in the beginning did not happen. Things kept getting pushed off and never had a website that worked to even try to attempt to even run my business how it should be run. I have contacted that company several times with no resolution and just want to be able to get my money back.

Complaintant is a former Founding Ambassador and did pay $479 for the position and received communications, earning preferences on sales and merchandise as a result. Complaintant sold no product and is entitled to no earnings.

Company has inquired of Complainant what representations were made to her and by whom and what representations were not fulfilled but she has refused to respond.

The Complainant by the publication of false statements of fact that are an intentional disparagement of the quality of the services and products and liable of the Piper Noble LLC business via Social Media that has resulted in pecuniary damages to the Company.

Company Agreement with Complainant is covered by and Under the American Arbitration Association. Company is filing an Arbitration Action against Complainant Trade Libel, Defamation, Slander, Interferences with Contract and Perspective Economic Advantage. The Company will be seeking Preliminary and Injunctive Relief and $75,000 in damages.

From the beginning I have never been provided with a policy and procedure that I actually signed like I have with my other companies that I work for. I have contacted the company several times and have even asked for proof from them for the reasons that they had stated in the termination letter that they had sent. The items that the company claims that I have done are not accurate. I have provided them several screen shots from other Founding Ambassadors and some of them are even still current and had just received warnings. I did not sell anything as I was waiting until all the kinks got worked out as I know that some Ambassadors had sold items and have still yet to paid their commissions for the products that they have sold. Several Founding Ambassadors have filed credit card disputes to receive their money back. The company is now on their 3rd back office that is still not up to par compared to the other companies that I work for in the direct sales industry. The company has lost their shipping center and the CEO is back to shipping from out of her house again. Also, several Founding Ambassadors have been terminated that have not stated anything publicly myself being one of them that have received threatening Arbitration Letters from the Company from someone posing to be a lawyer who is not. We have all researched this Kelso Malcolm and found that he has served time before for pretending to be a lawyer when he is not. You will see in the attachments that this so called lawyer can not even spell correctly. I work in Human Resources and have dealt with many lawyers so I know what communication from them is like and the communication that I have currently received is definitely not professional and fitting of an actual lawyer. When I had asked for proof from the Company to back up anything for my termination I had received no response from them. As you will see in my attachments is that I have contacted the company several times with no response back. I have no reason to bad mouth this company publicly. I would just like my money back from the investment that I had made and had not received from the company what was promised by them. Lessoned learned that I will research a company first before jumping into something with that big of an investment. The company should have done their research first before even starting. It is unacceptable to go through 3 back offices in the matter of 4 months and still not have things working correctly. I was waiting for kinks to get worked out before I fully promoted the company as I did not want to sound dumb to my customers or Ambassadors I was trying to get under my about items that I didn't even know cause the company didn't even know. As you will see in the documentation that I am attaching is that the company is even having pay information sent to customers that are holding parties for Ambassadors and this is just not right. The company doesn't even know when something has gone live for promotions or sales! For a direct sales and MLM company the company should not be receiving customer orders directly to the company. All orders should go directly through an Ambassador where they should get credit for the sale. Other companies that I currently promote have the website/back office system where a customer can not order unless if it is directly through an ambassador. There had been promises that all sales made through the website would be given to ambassadors but that was not the case.

Response:

The Complainant's basic issue is that she was terminated for unprofessional Conduct by disparaging the Company and she wants her money back.

The best evidence of the continuing conduct is the Complainant's rebuttal to the Company's response to her complaint.

She lists a series of false unsubstantiated allegations:

Others not being paid. No proof or evidence provided.

That others had received warnings for their conduct, but she was terminated. Basically, admitting misconduct but she was treated unfairly.

That the company has sent letters threatening Arbitration. Yes, the company has and that is the agreement to resolve disputes.

States that someone is pretending to be a lawyer and went to jail for it but produces no evidence, nor even an allegation of a conversation. It is intended to be inflammatory and in fact in itself untrue and actionable. Further is not relevant of her complaint.

"Company lost its shipping center". Untrue and not relevant to her complaint. Our fulfillment center is still actively sending out our orders.

That several Ambassadors have been terminated. Untrue and not relevant to her complaint.

Allegations of 3 back offices in 4 Months. Untrue and not relevant to her complaint.

Allegations the Company has threatened Arbitrations with parties that have caused damage by untrue statements in and on Social Media. True the Company has sent warning letters and in fact has filed Arbitration for that is what is required under the Agreement signed by the parties.

The Complainant's basic grievance when she became a founding ambassador was that an employee made verbal material misrepresentations to her about training, etc. That is false. The Company has had only one employee and that is I. I have never spoken to the Complainant.

Summary:

Complainant's basic approach is one of making inflammatory allegations that have nothing to do with her basic Complaint of "Wrongful Termination". Presents no evidence or fact to substantiate her claims and presents false allegations in her complaint alone to justify her termination.
It should be clear that the purpose of the Complaint in itself is to Slander and Damage the Company's reputation in order to pay her $500 to stop.
