On April 4, 2015 my daughter and I went to Pirates Place to find an apartment for my daughter while attending [redacted] 2015-2016. We asked for an unfurnished, deluxe room that would be large enough for my daughters queen size bed and where she would have her own bathroom. They found one in the computer for her, we paid the $35 background check fee and filled out and signed the lease agreement.About two weeks later, on/around the 15th, my daughter received a voicemail left by [redacted] that her room was no longer hers. I called [redacted] the next morning being told she lost it because it went to a male. Then I asked for another of the same for her and was told there were none. I told [redacted] this was unacceptable and he said he would look further and call that afternoon. He never called. I then called on the 17th and was told he wasn't in yet but a message was left for him. He never called so I called. [redacted] said he had another room available that would be similar but would be upstairs. I asked for pictures that I finally received that evening. I decided to drive, once again, to Greenville on the 18th to find out what was going on. Found out from other employees that [redacted] was the room placement coordinator and that he was responsible for assigning rooms and showing those which were truly available in the computer system. [redacted] MESSED UP!My daughter and I spent too much time there in the office with no resolution. They were on the phone with [redacted], I was on the phone with [redacted] finding that all they had available was a room much smaller that my daughters bed wouldn't fit in. I expressed my thoughts that there were several of the same room available when my daughter first chose hers which would mean others acquired theirs after my daughter received hers. So, truly, another should lose theirs before my daughter should.Was recommended for me to contact the manager, [redacted], Monday morning.My daughter and I were there too longProduct_Or_Service: College apartmentDesired SettlementIn speaking to the manager, [redacted] I requested the $35.00 background check fee refunded since, as she admitted, the mistake was theirs. She said no and said that she would not release me from the lease. I then told her I was taking it further and she finally said she'd release me. I request my $35.00 background check fee refunded since it was paid after acquiring a room for my daughter. I have to now find a room for my daughter so much later making it hard to find one.Thank youBusiness Response Management determined to release prospect from lease contract due to floor plan availability and floor plan request. Legally, we are not required to void the lease as we do not guarantee floor plan types and request a first, second, and third choice from all prospects. However, due to unfurnished factors, we proposed alternate floor plan requests and since these were not desired by the prospect, we confirmed a release from the contract. Management will process refund of the $35 application fee today as a further step of customer satisfaction. Management will also call parties to inform them of this refund. Consumer Response I accept my $35.00 refund of the application fee. I don't not agree with the wording of their response.We paid the application fee due to the fact that we were accepting a room they had available that would be the proper size for my daughters furniture. There were no other choices needed because this room is the room they were assigning to my daughter.Pirates Place messed up on their end and caused my daughter to lose her room. By the time they contacted us, two weeks later, all other rooms that were a similar size to the one she was to have were taken by other students who came after my daughter did.Yes, they absolutely should have refunded the $35.00 due to the fact that it was their fault in the mishandling of all.Final Consumer Response

This business has charged my son and I for several things without any explanation and has refused to talk to us or respond to any notices.On 10/3/2015, I received a notice in the mail from Pirate's Place claiming that my son and I had ignored prior notices to pay past due charges and that if I didn't pay them soon, they would turn me over to the credit bureau. There had only been ONE prior notice sent to my son and the charges came without any explanation. When he tried to speak with them both on the phone and in person, they said they would only accept written notices. So, my son returned the notice they sent with a note back to them about how he should not be responsible for some of the charges and asking for explanation. No one responded. He also wrote a check (which I have a copy of) for the part of the charges that he understood - because his roommates left the apartment dirty. It was not him that left the apartment dirty, but he understood he had to take on that responsibility and gave them a check for $37.50 - the amount for cleaning. He wrote the check and submitted it to them on 9/18/2015 and they are still saying that we owe the full amount. I have proof from our bank accounts that the company did indeed cash the check on 10/1/2015. Another charge is for an unreturned mailbox key - which he returned immediately upon receiving the first notice. The other charges say "pest control treatment" which he knows nothing about - as they did not have a pest problem. The other charge just says "AUTOCHRG" with no explanation. We have tried to communicate with them in three different ways - phone, in person, and written notice - and have received no communication other than a letter threatening to turn us over to the credit bureau. I have never refused to pay anything in my life - but this is utterly ridiculous and unfounded. This business has been horrible to deal with and has provided an unsafe environment for my son and his roommates and there are numerous complaints all over the internet. Please help! I do not want my credit affected for something that I shouldn't have to pay - or at the very least, something that should be explained to me that isn't being. Desired SettlementI wish for the business to cancel these charges - especially the ones that we have paid for or resolved (cleaning charges and mailbox key). I believe the other charges should be cancelled as well, but I at least expect some explanation and communication. I also seek an apology for the poor handling of business - particularly for waiting weeks to cash a check and then sending threatening letters stating that money was not paid. Business Response We have spoken with the resident and left a message for the Guarantor on the lease. There was a change in managers and unfortunately the dispute was not discovered until recently, thus resulting in a delayed response. After speaking with the resident, the disputed charges have been cleared as they were valid disputes. Consumer Response Thank you for your help! My complaint is resolved. Final Consumer Response
