Initial Business Response / [redacted] (1000, 9, 2016/01/11) */ Tile: Planet Beach Spa Name: Lisa Email: [redacted] Phone: [redacted] Case# [redacted] had a month unlimited agreement signed with Planet Beach starting Jan 2, Sept 22, I have spoken to [redacted] over the phone about her request to terminate her membershipI had told her she would have to come into planet beach to cancel in store and sign a cancellation form with $cancelation fee and days notice, as it was stated in the agreement that [redacted] signed Jan 2nd 2015, she had said she moved back to BC and she was not able to come in, we had an agreed to continue canceling her membership by emailing a termination form and she would send it back to us with a signed signature and agreed for me to pull the cancel fee off her credit card (which she had given to me over the phone) while I was on the phone with her and it approved Weeks went by and still no email from [redacted] When she called back weeks later she had spoken to our evening girl and she was told to phone back Monday and speak to the manger about cancelling as stated in agreementThen I got the call from [redacted] that Monday and spoke to her about her accountI had mentioned to her that I have not received an email back from her as I sent on Sept 22,with termination form attachedShe was asking why we were continuing to take payments out and why it was not canceled yetI had said the reason why it was not canceled and another payment had processed was because I had not received the signed terminated form from her by email that I had sent Sept 22,and we can not proceed to terminate an account without a sign signature and then that's when the days notice go into affect as started in agreement and she then said she had not received it any emailsI then had asked her if the email she gave me was correct and she said yes, and we were both unsure why the email was not getting to herSo then I had decided to just proceed this request of cancelation without days and termination form being signed and I explained to her why her payment got processed on nov 26th instead of the 1st and she seemed to understand and did not mention anything about having any problems with thatThe reason why her payment got processed on Nov 26th, was because I had put her account on waiting till I got the email from but I hadn't received any email response from herI could no longer wait because it was coming up to the end of the month to send out my reports so processed her payment for the 26th because she still owed for Nov 1, Then In December she had called and asked why Dec 1,payment came out of her account, I said sorry I will look into it and I did and requested a refund for heri had told her it would take business days as our billing company had told meI told her to make sure to keep a eye out for the refund and if she had any further issues she should call me backFrom then on there were no calls from [redacted] so we had thought everything was goodThe refund had been approved on our side I've Attached a copy of her Refund for Dec sent back to her and Email with termination form attached Thank You! Kennedy Construction's position remains the same, it started the work and this work contracted had not been completed at the time the complaint was filedMsWashington would not allow the Kennedy Construction employees to enter the home to complete the work as such Kennedy Construction was never given the opportunity to complete the work nor correct any of the items listed in her complaintGiven the fact the business was not permitted to enter the premises and complete the contracted work there is nothing further the business can do at this point

The email *** *** just submitted was after all of the emails I submittedEverything I sent in the first time was true and accurateAs the date on the email verifies, this email was their response to our company's frustration with having been shut off of the job with no explanationAny job that is stopped in middle you can find complaintsThe job was incompleteHad we had the opportunity to continue working, we would have worked with this customer until they were satisfied, if at all possibleWe understand every now and then there will be that customer that cannot be satisfied, however we diligently attempt to satisfy each oneThere was no problem with workmanship on this jobThe problem was a tile positioning preference which the *** originally consented to and later changed their mindsWe were still willing to accommodate themThere is no truth to the statement about the pipeWe did not leave the pipe uncapped. We are disappointed the *** chose this route as opposed to talking to us and allowing us to attempt to alter things to their satisfaction, however we are confident we did quality work until job access was denied and confident in our effort to resolve this matter amicably

RE: Complaint ID: [redacted]As Kennedy Construction has chosen to omit all of the facts, I am supplying the written communication we had on this matter, to be added to this file.  To substantiate their claim of not being notified of any issues with their sub-standard work, Kennedy Construction conveniently left off the email below outlining the issues identified by two independent contractors.FINAL EMAIL TO KENNEDY CONSTRUCTION:[redacted]Subject: Re: Kennedy Construction BathroomDate: Tue, 31 Mar 2015 09:14:10 -0400[redacted] I certainly appreciate your need to have some resolution to the work Kennedy Construction has been doing on our home.  I do however, take offense to your comment “your silence and un-cooperation cannot be overlook.”  As the homeowner, we are certainly within our right to stop work when it appears to be substandard and is detrimental to our home.  It is also within our right to have that work evaluated by someone licensed and experienced in this type of work who can provide an independent and in-depth analysis of the work done by Kennedy Construction to date.  The following items were noted by an independent licensed contractor regarding the work done by Kennedy Construction to date: 1.      The tile has not been laid properly causing the lines and tile squares not to match up properly in the brick pattern you were wanting.  The grout lines are not accurate and the tile floor set up is not proper.  It looks as if no attention was paid to how the pattern was to be laid on the floor and that the tile was just laid in whatever was easiest for the person who handled it.2.      The tile is also not laid flat causing trip edges near your shower.  The trip edges in the tile could become a hazard to your family or anyone who may be visiting your home.  The edges were noticed near the shower, but there may be others as well in the existing tile.3.      The tile will not be able to be re-used as it will break when it is pulled up to be replaced.  Unfortunately this will cause you to have to purchase additional materials.4.      The seams in the concrete board where not properly sealed.  Concrete boards need to be sealed to be waterproofed.  Without sealing these boards you can have water damage to these boards.5.      When the original sinks were removed the pipes were cut leaving the traps open.  With the traps open the methane gas is leaking into your home through these pipes.  This is hazardous for anyone living in your home.  It can make some very sick but can also be combustible causing serious damage to your home. Based on the findings above, we will not be continuing with Kennedy Construction to complete this work.  We will be seeking compensation from Kennedy Construction, LLC for the additional costs due to the substandard work and consequential damage to our property. Regards, [redacted]

Kennedy Construction has responded to this complaint previously, and our podition has not changed. At this.point, we feel as if both parties are repeating ourselves. As explained in previous correspondence, there are many untruths to the allegations presented. It is unfortunate that the communication between the client and our firm has ceased at their request, because had it continued, we are confident we could have worked to a mutual agreement. Alternatively, however, it has ended in a manner in which we feel the customer owes us money, but we are willing to forego collection of those funds and just part ways amicably.

Kennedy Construction stated
that everything in their original submission is true and accurate, and that “we
changed our minds regarding the design.” We did not change our minds on the
design.  A more accurate statement would
be that due to the irregular appearance of the work which had been completed,
we believed there was a problem with the workmanship.  We discussed the
issues with Kennedy Construction and we were informed that due to the
dimensions and layout of the room, this was the only way they could get the
tiles laid in the pattern on which we had agreed.  As stated in their response Kennedy
Construction did not believe there were any problems with the workmanship.  We felt the best way to address the
workmanship issue was to get two independent evaluations of the work performed
by Kennedy Construction by their peers in the bathroom remodeling
business.  As the evaluations indicated the work performed was of a poor
standard and could have been completed with the design we originally requested,
so despite claims that the work was of a high quality, their peers believed
just the opposite.

We had purchased a new unit 1.5 years ago. The unit cost was approx. $16,000. Since our purchase, we have had at least 5 service calls for a number of different issues. The latest issue was that the unit was, is still, blowing cold air. That last service was conducted on Friday, February the 12th. And the company charged me $275.00 for the service call. It is now Sunday the 14th and I am still having the same issues. The only time the unit starts to warm up is when the temperature outside gets warmer. The unit runs constantly and is coasting me a lot of money on my electric bill.

We interviewed with 3 companies and by far [redacted] and his team out weighed the others. Instead of just looking to do a quick change out of units. They made several changes to the original installation as a whole and explained how the changes would benefit us. I could write a really long review explaining all the benefits and the differences I found between these three heating and cooling companies. However, I will just said if you are looking for a heating and cooling company to do it right and be more than competitive just give 72 Degrees a call and ask for [redacted]. See for yourself the difference this company will make over the others and you will see what we did. We made the right decision and I know you will too. The installers were great to work with and worked a very long day to ensure we had the comfort back in our home before leaving. First class company all the way!!! Thanks so much to everyone!!!

The whole experience was very tolerable from when [redacted] came out to walk me through my options to talking with [redacted] about financing and payment options to when [redacted] Matt and [redacted] came out to do the install. The guys were professional and kept us informed on what was going on and why things were taking longer than anticipated. And most importantly we are cool now!

Case# [redacted] had a 12 month unlimited agreement signed with Planet Beach starting Jan 2,2015.
Sept 22, 2015 I have spoken to...

[redacted] over the phone about her request to terminate her membership. I had told her she would have to come into planet beach to cancel in store and sign a cancellation form with $50 cancelation fee and 30 days notice, as it was stated in the agreement that [redacted] signed Jan 2nd 2015, she had said she moved back to BC and she was not able to come in, we had an agreed to continue canceling her membership by emailing a termination form and she would send it back to us with a signed signature and agreed for me to pull the cancel fee off her credit card (which she had given to me over the phone) while I was on the phone with her and it approved . Weeks went by and still no email from [redacted]. When she called back weeks later she had spoken to our evening girl and she was told to phone back Monday and speak to the manger about cancelling as stated in agreement. Then I got the call from [redacted] that Monday and spoke to her about her account. I had mentioned to her that I have not received an email back from her as I sent on Sept 22,2015 with termination form attached. She was asking why we were continuing to take payments out and why it was not canceled yet. I had said the reason why it was not canceled and another payment had processed was because I had not received the signed terminated form from her by email that I had sent Sept 22,15 and we can not proceed to terminate an account without a sign signature and then that's when the 30 days notice go into affect as started in agreement and she then said she had not received it any emails. I then had asked her if the email she gave me was correct and she said yes, and we were both unsure why the email was not getting to her. So then I had decided to just proceed this request of cancelation without 30 days and termination form being signed and I explained to her why her payment got processed on nov 26th instead of the 1st and she seemed to understand and did not mention anything about having any problems with that. The reason why her payment got processed on Nov 26th, 2015 was because I had put her account on waiting till I got the email from but I hadn't received any email response from her. I could no longer wait because it was coming up to the end of the month to send out my reports so processed her payment for the 26th because she still owed for Nov 1, 2015.
Then In December she had called and asked why Dec 1,2015 payment came out of her account, I said sorry I will look into it and I did and requested a refund for her. I had told her it would take 5 business days as our billing company had told me. I told her to make sure to keep a eye out for the refund and if she had any further issues she should call me back. From then on there were no calls from [redacted] so we had thought everything was good. The refund had been approved on our side.
I've Attached a copy of her Refund for Dec 1.2015 sent back to her and Email with termination form attached
Thank You!
Have a great Day!

72 Degrees installed both of my HVAC systems and has maintained them for more than 10 years. I find them to be responsive, thorough, and professional.

I have never written a testimonial before, but I felt compelled to share my experience. As homeowners, keeping up with repairs can be a challenge. Not only can it be costly, but which company to choose can be daunting. I have dealt with many businesses over the years. Some have been ok and some have been awful (which is why I have learned not to jump at the 1st one that promises me things).
If your HVAC unit has ever quit working, then you know that these systems are not cheap. I troubleshooted the problem, thinking that I could fix it myself. However, this was too big (even for me who has taken on the role of handy-woman). After I realized that I could not 'fix' the problem, I called around to get a quote. One of my many calls I made was to 72 degrees heating and air. [redacted] was very professional and prompt when answering my call. When 72 degrees president, [redacted], called I told him about going with another company. He suggested that he would like to come out in person to check out the HVAC system. I was impressed, so I said sure. He came out and explained the many options available to me. I decided to go with 72 Degrees, and I have not regretted my decision. I talked to [redacted] and he helped me get approved for financing, which was ½ the battle. It was not an easy installation, to say the least. From the furnace arriving damaged during transit, a faulty compressor, a switch replacement, and a faulty coil, the technicians stuck with the job until they got the system installed and running properly. Meanwhile, during the 3 visits it took for the HVAC installation, (the 1st day was 10 hours long!), I was able to utilize 2 AC window units (courtesy of [redacted] the supervisor). [redacted], and [redacted] deserve my special thanks for their perseverance throughout this ordeal. They were knowledgeable and very patient with me and my many questions. My contact with 72 Degrees did not stop after the installation process, however. About a week later [redacted]'s wife ([redacted]) called me to ensure that the HVAC unit was functioning properly. Everyone's work ethics and dedication are top notch and I would recommend this company to anyone (which I have!).

Review: I have been a member with Planet Beach since 2006. Back in 2010, I got pregnant, so I believe in February 2011 I came into this store to cancel my account, but was told I could freeze for free. I assumed it was frozen until you unfroze it. I had other things on my mind obviously so this was the least of my worries. So the account was frozen. The account was linked to my Whitney Credit Card which had a zero balance most of 2012. January 2013 rolls around and I get a statement for this credit card. Weird thing is, I havent used it.. So I open it and BAM $249.50 charge from Planet Beach. I called and was told it was for 10 months @ 24.95 of charges that were insufficient. The account was no longer frozen, which would have been no problem. After seeing the first month charges appear on my credit card I would have canceled my membership. I was unaware of any activity until 10 months down the road. No phone calls or letters to notify me of the MONTHS of insufficent charges, but had I gone in there to tan I most definitely would have been turned away for insufficient funds!! I disputed the charges through my bank but was told I had no case since there was a contract in place (at this point I wasnt under contract I was just paying month to month). Weird how I had all these months of insufficnet funds and then suddelnly in January, they ALL go through! Whitney also does not produce a statement for a zero balance. So therefore I have only 3 months to prove to you there were sufficient funds. I have provided statements via certified mail and called and have had no one willing to resolve. I had no option but to pay for 10 months of NOTHING!!!!! I have asked Planet Beach to provide documentation showing these funds were insufficient then I could at least take that to the bank and have them investigate. Absolteuly no documentation of the "insufficent" funds has been provided to me or the bank, just their word.Desired Settlement: Refund the $250.00

Review: I attempted to purchase a 30 day trial membership for my daughter in January, 2014. The paperwork they requested I fill out indicated the membership would continue on a monthly basis and that I authorized them to charge my credit card. I specifically indicated on the paperwork that we were trying the spa for 30 days and instructed the employee that she was not permitted to keep our credit card information. My daughter used the service for 30 days as we agreed and then stopped going. Planet Beach has continued to bill my credit card monthly, overriding blocks and reversed charges. After phone calls, a letter and our continued efforts to block their charges, they persist. We are filing this complaint to request they finally stop. We have given them ample opportunity to do the right thing, we held up our end of the bargain and they have continued to pursue predatory billing practices. My credit card company indicates that we cannot pursue a fraud claim because we authorized them to use our credit card once.Desired Settlement: Stop billing our credit card and destroy our credit card information.

Response:

To whom it may concern,

According to my records it shows that they had signed a membership for a year. We then put a card on file and charged that card $39 starting on january 10th 2014. We had them on our automatic payment each month on the 1st. They then came into the spa and gave us a new credit card number on february 26th 2014. We have no cancelation fees we just ask for a 30 day written notice. We recieved a letter from the mother on September 29th 2014 and since have canceled the membership and no longer have a card number on file.

Thank you,

Spa Director
