I bought a lemon I've made numerous attempts to settle the matter and the dealership has my money and the car won't give me either. Had car a week Hi my name is [redacted] this is a written confirmation that I've returned the Burgandy 2002 Toyota Camry that was purchased on 03/22/16 and returned on 03/29/2016 at 1:30 pm. The car was having issues as far as loud engine noise, rough idle, low horsepower,low gas mileage,rough running,and delayed start after only having the car for an hour. I returned to dealership on Wednesday 03/23/16 and was told the car needed a tuneup and I could take it to the mechanic. I took the car to the mechanic located at [redacted] Raleigh Nc XXXXX. The mechanic had 2 spark plugs on hand and changed the ones that were showing on dianostic machine error codes. I left mechanic and the car was running terrible so I called the finance manger [redacted] because he's the one I've been communicating with about the car. He advised me to go back to the mechanic and let him know. I went back to the mechanic and he said I needed 2 more spark plugs but he didn't have them on hand and needed to call the dealership for approval to buy parts. He called and spoke with [redacted] and [redacted] said he need confirmation and would call back. So we waited about 30 mins and got no call back so the mechanic said if I bought them and kept my receipt Pleasemt Valley Motors would reimburse me for the 2 remaining spark plugs. So I bought left and went about a mile up the road to [redacted] where I purchased 3 spark plugs (bought extra 1 by mistake). I returned to mechanic who attempted to replace the 2 remaining spark plugs. Upon instillation he discovered motor oil residue on 2 spark plugs meaning oil is leaking into 2 of the engine cylinders. Upon discovery he called [redacted] and made him aware of the situation and I told him I was returning to the dealership to return the vehicle. I got there I spoke with [redacted] (car salesman) [redacted] (finance manager). [redacted] said on Monday he would have it straight as far as trying to get me more money from the bank for a better vehicle. I contacted him on Monday and told him because of work I couldn't come down but I wanted an update. He said he hadn't had a chance to work on it and come Tuesday 03/29/16 so I came around 1:30pm with my two small children ages 8 and 5. He said he still hasn't had a chance to work on my stuff and he needed a hour. I left and walked with my kids about a quarter of mile down the street at chic-fil-a and waited a little more than a hour. Me and kids went back and [redacted] said he still hasn't worked on it. At that moment I took my belongings out the car and called my mom to pick up me and my children. I went in the office and explained I wanted my down payment of $1300 back and left the keys on hos desk. He advised me it will take 2-3 business days to reverse the deal with back and get my down payment money back. I went to the dealership on 4/2/16 and [redacted] said the bank wouldn't reverse the deal and he would have an answer on Monday. I called the bank on Monday 4/4/16 and I was told the dealership has 30 days to reverse the deal. I went to the dealership on 4/4/16 around 6:50 pm and explained to [redacted] what the [redacted] Finance told me and now he said the dealership won't do it because they will lose money and handed me there lawyers telephone number. So now I have no car and no money. They're in possession of both.Desired SettlementI would just like my down payment of $1300 back.
