I am rejecting this response because:
I am rejecting the claim made by the Ploome companyI was not at all contacted by phone by the owner Christina to come to a conclusion about the chargeThe last phone message I have received from the company was on the same day I sent my emailAs you are aware, the company has NOT made an effort to contact me, she has provided the last thread of emailsGiven the circumstances I did not accept going to the gym since I did not authorize the charge on my accountI came to a different VERBAL agreement with the owner in a time of crisis and trusted that agreementGiven the situation I did not feel comfortable returning to the studio under any circumstances, especially during a disputeEspecially since the situation has escalated into an unhealthy relationshipNo one is willing to workout in an environment they do not feel comfortable

I write today with regards to a Ploome Client Account Charge*** ***, a Ploome client since 2014, is refuting a charge to her credit cardThis charge covers an outstanding balance on ***’s accountBelow, please find the information needed to refute her charge and justify the studio’s claim to this chargeIn March 2014, *** *** purchased a Ploome Golden Ticket 12-Month Unlimited Class Membership at a rate of $per month. At that time, she was required to sign a membership contract that confirmed she would be liable for making payments of $per month and that her contract could not be broken, transferred, or canceledFurthermore, the contract stipulated that, if she canceled her membership before meeting the minimum months of participation required, she would be responsible for paying the balance on her membership*** signed this contractI have included it as an attachment in this disputeIn April 2014, ***’s credit card failed twice when charged with her second month of studio membershipI have included both failed autopay emails as attachments in this disputeAt that time, I reached out to *** by phone to cheregarding her accountI was unable to reach her by telephoneInstead, she emailed me to inform me that she did not think she could manage her membership due to family issuesI responded by email informing her that we could explore alternatives together to provide her with the best supportI then followed up by telephone to inform *** that we would be happy to cancel her membership (although she was contractually responsible for paying her membership)Pursuant to her membership contract, I informed her that we would need to charge her for one final month of membership (April 2014)She agreed to thisHowever, the payment for this last month of membership was never successfully charged to her credit cardHer card was denied and she did not return my calls regarding this issueI have included ***’s payment history as an attachment in this disputeMonths later, in November 2014, *** sent the studio an email thanking us for our support and informing us that she would be happy to reconcile her studio accountI have included this email as an attachment in this disputeIn February 2015, *** returned to the studio - she purchased two class single reservationsShe attended one class and late cancelled the second classI have included ***’s visit history as an attachment in this disputeIn February 2015, *** contacted Ploome by email inquiring about a $charge on her credit cardThis was an automatic charge on her credit card to cover her outstanding account balance for one final month of studio membershipThe charge was $and not $because the rate of her Golden Ticket 12-Month Unlimited Class Membership had increased in I immediately emailed *** back to explain the charge and kindly reduced the charge to $in order to honor the terms of her membership agreement. In addition, I provided *** with days to utilize the final month of unlimited class membership for which she was charged and which she owed to the studioI have included this email chain as an attachment to this disputeBelow, please find a portion of my email response to ***:
Hey *** and thank you so much for your email.
It is wonderful to have you back in the studio, I am so excited about thisI do hope we can work together again soonI took a look at your account and it seems the $you were charged is actually a remaining final balance on your Golden Ticket 12-Month Unlimited Class MembershipAs you know, you requested an early termination of this 12-month minimum participation membership (which, at the time, was set at a membership rate of $per month)Given your personal situation at the time, we were happy to grant this request even though you did not meet the minimum months of participation that your membership requiredAs per the terms of our membership contracts, we canceled your membershipPursuant to your contract, you were billed for one final month of membershipIt seems that your credit card was declined at that time and, as a result, the outstanding bill was added to your account balance for Ploome.
Below, please find your membership contract:
To terminate your studio membership, please send written notice to ploomephilly@***.com This is the only way to terminate your membershipNotice to a staff person or by telephone or text message is not sufficientWe will provide you with a return email notification indicating the date we received your notice of termination and the effective date of your terminationYour studio membership will be terminated thirty days from the date we receive your written notificationAll remaining membership classes will expire thirty days from the date we receive your written notificationUpon receipt of your written notification of membership termination, you will be charged for one final month of membership on your scheduled auto-pay dateThese membership classes will expire thirty days from the date on which they post to your account, and not thirty days from the date of your written notification of terminationIn other words, you have extra time to use these classes!
If for any reason your membership is terminated before the minimum participation date, we reserve the right to charge your credit card an amount equal to the minimum that would otherwise have applied: 5-Class/Duet/Private Session Memberships and 10-Class/Duet/Private Session Memberships require 3-month minimum participation; 3-Month Unlimited Class Memberships require 3-month minimum participation; 6-Month Unlimited Class Memberships require 6-month minimum participation; 12-Month Unlimited Class Memberships require 12-month minimum participationIn the absence of special circumstances (see discussion immediately below), no freezes or holds are permitted on memberships with 3-month and 6-month minimum participations, and two 7-day membership freezes are permitted on 12-month minimum participation membershipsWe cannot freeze a 12-month minimum participation membership for more than days at a timeA membership freeze for special circumstances will be permitted only in the discretion of Ploome and only for truly exceptional and unanticipated circumstances (such as serious injury to you, a death in your family, or other major issue but, for example, not just the flu)Please send written notice to ploomephilly@***.com This is the only way to freeze your membershipNotice to a staff person or by telephone or text message is not sufficientWe will provide you with a return email notification indicating the date we received your request for membership freeze and the effective date of your freezeMemberships are non-refundable and non-transferableClasses, instructors, and pricing are subject to change without noticeWhen you updated you credit card information, you outstanding balance was automatically charged to your filed credit cardYou carried a balance for one final month of payment on a Golden Ticket Unlimited Class Membership with 12-month minimum participationIn 2014, that membership was set to auto-renew on the 27th of each monthThat is why the $charge for one final month of Golden Ticket Unlimited Class Membership went through on 2/27/I have updated your account, voiding your $charge for final month of membership and replacing it with a $charge for final month of membershipI am happy to make sure that your outstanding bill reflects that rate at which you were scheduled to pay in Please do feel free to use you month of unlimited classes 2/27-3/27/We would love to have you at the studio and to share this space with youIf you have any questions of need any additional support, please do not hesitate to contact usWe are always here for youChristina
I did try to contact *** *** several times by telephone to return her calls, but was unable to get in touch with herShe did send an email follstating that she could not use her last month of membership due to scheduling conflictsI then received this chargeback from MindBody, filed by *** ***I am refuting this chargeback because the studio acted appropriately in handling this client and in providing her with support and understanding at every phase in her studio journeyThe client is responsible to paying her final month of studio membership, as outlined in her contract and agreed in Please do not hesitate to contact me if you need any additional informationWe are always here to helpChristna *S***
