Initial Business Response / [redacted] (1000, 7, 2015/09/02) */ The material ordered by *** [redacted] Construction ("***") was loaded on a 40ft container aboard the vessel Ever Salute on 7/2/2015, with a scheduled departure date of 7/10/Upon departure, the shipping line's estimated arrival date for the container into the port of Manila was 8/9/ Upon ***'s request and instructions, this shipment was consigned to their broker R.E.N.Z.REnterprises who would be responsible for clearing the shipment thru Philippines customs and providing local delivery of the container from Manila North Harbor to ***'s specified delivery site On August 3rd Typhoon Soudelor was upgraded to Super Typhoon status, being recognized as the strongest typhoon of and bringing torrential rain, catastrophic flooding, and wind gusts of upwards of mph to the East and Southeast Asian regions, originating from Japan, China, and Taiwan, and entering Philippine territory on 8/5/ Super Typhoon Soudelor (known locally in the Philippines as Typhoon "Hanna") caused massive and widespread flooding and power outages, resulting in region-wide business disruptions, and in particular delays for regional travel & shipping, including including specifically, China (point of origin,) Taiwan (trans-shipping route,) and the Philippines (destination port.) Super Typhoon Soudelor made landfall on Mainland China late on the evening of 8/8/2015, causing major shipping delays that could not be foreseen by Smith & Fong Cowhen it delivered the container to the shipper of record as required by contractDue to the disruptions caused by Super Typhoon Soudelor, the vessel Ever Salute was detoured as vessels seeking safe harbor from the storm sought shelter in Taiwan On 8/Smith & Fong Cowas advised that the estimated arrival date for the material to Manila North Harbor was now 8/23/(instead of the initially scheduled 8/9/2015) as the next available vessel picked up the container in TaiwanOn 8/19/the container of material was able to leave Taiwan and subsequently arrived at Manila North Harbor on 8/23/at 12:local time Although we regret the delivery delay caused by Super Typhoon Soudelor, it should be noted that the container was timely delivered for shipment by Smith & Fong Co., and as of 7/10/Smith & Fong Cohad in fact fulfilled its obligation to deliver conforming productsAny further delay in this shipment is an unfortunate force majeure event that is beyond the reasonable control of any party involved in this contractAs such, Smith & Fong Coshould not be held liable for any damages claimed by [redacted] because Smith & Fong Coacted in utmost good faith and diligence to assure prompt delivery of these goods despite the unforeseen consequences of Super Typhoon Soudelor disrupting all regional trade and shipping during the early August Initial Consumer Rebuttal / [redacted] (3000, 9, 2015/09/03) */ (The consumer indicated he/she DID NOT accept the response from the business.) We are not accepting the response from the business (PLYBOO) As per our monitoring on the evergreen ship, it arrived Taiwan on Aug 3, Our container was unloaded and stay at the port Aug 3,4,5,6,for almost days.Why did they not transfer it to other ship for the shipment to Manila as it is their job to do it so they can meet the schedule of Aug Manila arrival as they committed to AGA As per their own report, The typhoon hit Taiwan on Aug 8.It is their own no concern to do the transfer of the container immediately to other ship upon its arrival in Taiwan Port on Aug 3.They have almost days to do that before the Typhoon arrivesthey are just using the Typhoon to justify the delay of the shipment but the truth is their not doing anything to do the ship transfer immediately upon unloading of our cargo in Taiwan Port on Aug 3, Also their air fright shipment of our order of sheets of natural flat grain sheets on July is lacking one sheet worth $which they acknowledged as missing and we request a reimbursement of the said amount thru e mail last July but until now, Sept 4, we have not received the said return payment via telegraphic transfer We are planning to do legal action in this delays of our shipment once our client charge us on the delayed installation of this product by PLYBOO Final Business Response / [redacted] (4000, 11, 2015/09/14) */ Wire Payment being processed today for $The discrepancy needed to be verified and corrected thru accounting systems before payment could be processed Final Consumer Response / [redacted] (4200, 13, 2015/09/16) */ (The consumer indicated he/she DID NOT accept the response from the business.) Upon [redacted]'s request and instructions, this shipment was consigned to their broker R.E.N.Z.R. Enterprises who would be responsible for clearing the shipment thru Philippines customs and providing local delivery of the container from Manila North Harbor to [redacted]'s specified delivery site.

On August 3rd Typhoon Soudelor was upgraded to Super Typhoon status, being recognized as the strongest typhoon of 2015 and bringing torrential rain, catastrophic flooding, and wind gusts of upwards of 143 mph to the East and Southeast Asian regions, originating from Japan, China, and Taiwan, and entering Philippine territory on 8/5/2015.

Super Typhoon Soudelor (known locally in the Philippines as Typhoon "Hanna") caused massive and widespread flooding and power outages, resulting in region-wide business disruptions, and in particular delays for regional travel & shipping, including including specifically, China (point of origin,) Taiwan (trans-shipping route,) and the Philippines (destination port.)

Super Typhoon Soudelor made landfall on Mainland China late on the evening of 8/8/2015, causing major shipping delays that could not be foreseen by Smith & Fong Co. when it delivered the container to the shipper of record as required by contract. Due to the disruptions caused by Super Typhoon Soudelor, the vessel Ever Salute was detoured as vessels seeking safe harbor from the storm sought shelter in Taiwan.

On 8/13 Smith & Fong Co. was advised that the estimated arrival date for the material to Manila North Harbor was now 8/23/2015 (instead of the initially scheduled 8/9/2015) as the next available vessel picked up the container in Taiwan. On 8/19/2015 the container of material was able to leave Taiwan and subsequently arrived at Manila North Harbor on 8/23/2015 at 12:00 local time.

Although we regret the delivery delay caused by Super Typhoon Soudelor, it should be noted that the container was timely delivered for shipment by Smith & Fong Co., and as of 7/10/2015 Smith & Fong Co. had in fact fulfilled its obligation to deliver conforming products. Any further delay in this shipment is an unfortunate force majeure event that is beyond the reasonable control of any party involved in this contract. As such, Smith & Fong Co. should not be held liable for any damages claimed by [redacted] because Smith & Fong Co. acted in utmost good faith and diligence to assure prompt delivery of these goods despite the unforeseen consequences of Super Typhoon Soudelor disrupting all regional trade and shipping during the early August.

We are not accepting the response from the business (PLYBOO).
As per our monitoring on the evergreen ship, it arrived Taiwan on Aug 3, 2015. Our container was unloaded and stay at the port Aug 3,4,5,6,7 for almost 5 days.Why did they not transfer it to other ship for the shipment to Manila as it is their job to do it so they can meet the schedule of Aug 9 Manila arrival as they committed to AGA.

We are planning to do legal action in this delays of our shipment once our client charge us on the delayed installation of this product by PLYBOO.
