Review: We contracted with [redacted] Contracting to add a pergola to our deckDuring our discussions [redacted] suggested that all the hardware be painted black, and the language, ."paint all hardware black," was included in the contractOn April 11, 2013, the pergola was built but the hardware was not paintedOn the evening of April 11, [redacted] came to the house and to review the workWe discussed the hardware, and at first he said that he thought we weren't sure about it so he didn't do it, and now that the pergola was built it would be much more difficult to paint than it would have been before constructionI don't remember there being any question about whether or not the hardware should be black, and if there was any question about it he should have confirmed it before he built itHowever, he said it was in the contract and he would get it doneHe asked to be paid in full for the job, which I did because he had done over $100,in renovations to our home two years ago without any issuesHowever, he did not come back and paint the bracketsI spoke with him a couple of times, most recently the week of May 6, when he said he would have the painting completed no later than Monday, May When the work wasn't done I called him again on May He didn't answer but I left him a message requesting that the work be done by Friday, May or that if he didn't intend to do the work that he give me a refund of $I called him again first thing this morning, May 23, and again he didn't pick up but I requested that he call me to tell me how he was going to resolve this issueIt is now near the close of business and I have not heard from him.Desired Settlement: Because [redacted] has not kept his commitment to paint the pergola hardware a full six weeks after he was paid in full, and because he is not returning my calls, I want a refund of $I no longer want [redacted] to paint the brackets because I am afraid he will come and do a sloppy job just to say it's done and then I will be in a worse position than I am with unpainted bracketsBecause of the tedious nature of the work, painting the brackets without getting paint on the cedar wood, this will be a very time consuming jobAnd while I have not gone so far as to get bids for the work from painters, [redacted] himself said it would take at least several hours so I think the $is fairThe entire cost of the pergola was $5,

I am rejecting this response because: 1) If, as [redacted] claims, there was some question as to the color for the brackets (and I would dispute that), it was incumbent on him to inquire prior to construction rather than assume that no color was desired2) [redacted] states that the job took two and a half days to completeIn fact, the job was completed in a single day, while no one was home, otherwise we would have told the carpenters prior to completion and only some of the brackets would need to be painted3) [redacted] continually references bad weather as the reason the job has not been completedThe deck was constructed in early April and I did not file my initial complaint until May 23, six weeks after the job was completedSurely there was enough good weather for the painting to be completed in that time span, or since4) [redacted] says he hired a painter, but that it rained the day the painter was initially scheduled to goThere has certainly been good enough weather for the painting to be done since then, or enough time to hire another painter5) [redacted] says that I left calls that harassed him and threatened himI only called him a few times and after he missed his May commitment for finishing he stopped returning my callsWhat I did say in the messages that I left was that I was disappointed that the work had not been completed in a timely manner, and that I was going to be forced to take other action, by which I meant filing this complaint6) [redacted] also says he has been too busy to complete the workI would think that a job that has been fully paid for should take some sort of priority, and in any event completed in far less than the two months that it has been since the wood went up7) [redacted] is correct that we did have a very good working relationship up until this time, which as I stated in my initial complaint is the reason I agreed to pay him in full before the work was doneHe says that I should be more patientBut I paid in full on the day the wood went up, waited six weeks to file this complaint, and have now waited almost another month, and only about a third of the brackets are paintedI think I have been more than patient and that [redacted] should be more diligent in completing work he has been fully paid for
If he is unwilling to provide a refund then I expect him to find a painter to complete the work as soon as possible
