Dear [redacted] , This letter is in response to complaint [redacted] We were aware of [redacted] concern and it has been rectifiedThis incident occurred due to a clerical error on the part of Pocatello Nissan and KiaOur finance manager was a new employee when the extended warranty application was completed, and he mistakenly used an incorrect formWhen the application and payment were returned to Pocatello Nissan Kia from Portfolio Protection, he reached out to Ms [redacted] several times to arrange for the correct form to be completedHe did not receive a response from Ms***Ms [redacted] had an issue with her vehicle and had no coverage due to the correct application having not been completedPocatello Nissan Kia paid for the repair as a goodwill measure, and we were able to complete the needed paperwork which was submitted to Portfolio along with a check for paymentPortfolio processed the application, but would not issue the policy until they received paymentThe check had apparently been lost in their processingWe cancelled payment and re-issued another checkMs***'s policy is now in effectWe have offered Ms [redacted] our Tires and Oil for life program for her inconvenienceThis provides her with replacement tires and engine oil for as long as she owns her vehicle subject to the terms and conditions of the programThis is a program that is typically available only to our new vehicle purchasersIt is our hope that Ms [redacted] will accept our apology, and utilize this valuable benefitBest Regards,

Complaint: [redacted] I am rejecting this response because:i was not called until months after the check was retirned and the totle was told to me on monday and had been pais off by friday, joone told uswe found out by ab enailso I am staying with wanting dollatrsfor they did not repair anything before er got the car with the check engine light on and anthoer lighy on onso I shoulf not have to pay for itSincerely, [redacted]

listed at our special internet price of $plus tax, title, and dealer doc feesThis vehicle was available at this price for any purchaser who paid cash or OAC through any traditional financing sourceWe provided Mr*** with a buyer's order as he stated, as he desired to obtain his own financing through local lendersHe was unable to obtain this financingWe attempted to obtain financing through our many lenders, unfortunately due to his credit standing he was declinedWe were finally able to secure an approval though Credit Acceptance Corporation {CAC) for Mr***CAC is a lender that specializes in high risk lendingThe final purchase price, down payment, rate, term and payment reflect the approval that was obtainedOur client advisor presented the terms of the only approval we were able to obtain and Mr.*** accepted them, He was under no obligation to do soOur business manager also thoroughly explained all of the terms of the purchase when completing the purchase paperworkAdditionally, CAC requires that the customer signs both a paper contract as well as an electronic signatureWe make every effort to provide every customer with the best deal possibleIt is unfortunate that Mr*** is having second thoughts concerning his purchaseWe did the very best that we could for him in his personal circumstance

I am responding to the complaint filed by [redacted], dated June 13, 2016. [redacted] and [redacted] purchased a used 2008 Kia Sorento from Pocatello Nissan Kia on March 8, 2016. They traded in a 2000 Chevrolet Blazer that they indicated had a clear title. The...

provided us with a check for $3,000 for their down payment and promised to provide the title to the Chevrolet Blazer. Their financing was approved through Credit Acceptance Corporation.Their $3,000 check was returned to us due to insufficient funds, and though there were multiple contacts,they would not provide a title. We contacted Mrs. [redacted] multiple times,and we finally received $1,000 of the $3,000 owed. We investigated their trade, and found that their lender, Loan Mart,held the title with a payoff amount of $13,000 still owed on the vehicle.  They indicated they had not received a payment in over 1000 days and had been trying to locate the vehicle for repossession. Credit Acceptance Corporation returned the loan to us on the 2008 Sorento as no payments had been made. We contacted Mrs. [redacted] and advised her that she had fraudulently traded her Blazer in to us, she had not paid her down payment, and she had not made any payments toward her new loan and it had been returned to us. We advised her that we were unwinding her deal,she needed to return the Sorento to us and she could pick up her trade in. She promised to come in,but did not. We reported the vehicle stolen to the local authorities and advised Mrs. [redacted]. She returned the Kia Sorento to us one week later.

This is a response to your letter dated June 29, 2016 concerning complaint ID [redacted]). Due to what appears to be numerous typographical errors in Mr. [redacted]'s message, I am unsure that I understand every point that he attempted to make.  I will reply to the overall message as I understand it. The check for the down payment of $3,000 for this vehicle bounced due to insufficient funds. The  [redacted]s were give multiple opportunities to correct this. Only $1,000 was paid by cashier's check with a promise of the other $2,000 in two days. The additional payment was once again never made. The vehicle traded in to us was fraudulently presented as having a clear title having been paid off. There was still a sizeable amount owed on it and had been in default for some time. We could not obtain a title to their trade in without their previous debt being satisfied. We once again gave the [redacted]s the opportunity to fulfill their obligation, but they did not.  The vehicle they attempted to purchase was returned to us approximately three months after they took possession of it. They were charged for three months of depreciation, miles used, and restocking to cover reconditioning, repairs, and maintenance.  These costs are in excess of the $1,000 paid.
