Complaint: ***I am rejecting this response because: The contractor made no offer to
resolve the problem There were numerous falsehoods provided in his
rebuttal however To enumerate and respond to these outright falsehoods,
I list them here:
ON PAGE
of MrR***'s letter to the Bureau of Consumer Protection, he stated that
"after work started, the *** requested a cathedral ceiling in the
kitchen." This was not after work started, nor was it a request
It was a discussion He called for a meeting with us on
January 28th, and we quickly found out the purpose of the meeting was to
get us to sign a new contract and advance him more monies We also found
out at that point he had already gone through all the monies we paid him, which
was for the entire original contract I told MrR*** we would
discuss this contract AFTER he finished the plumbing, the bathroom, the
electric, the flooring, and the painting At first he agreed, but this
never came about It was con***t badgering for more monies, as we stated
in our complaint MrR*** has harped on this constantly in an effort
to obtain more money from us. In fact,
we have numerous voicemails from him, always asking for more money. MrR*** did not perform any work on any
type of ceiling; and our photographs of the lack of work attest to that (copies of which were already submitted)
Also on page 1, MrR*** mention that we made requests to
change items We made no changes to the original contract

of MrR***'s letter, again he states his outright falsehood about us
withholding monies for all the changes to the contract we made See above
statement MrR*** was more than paid in full for the entire
contract, and he went through all the money in two months and began asking for
more We lost count of how many times he said, "My men won't work
unless I pay them."

R*** states that he "offered *** *** the opportunity to purchase
materials directly on his own to reduce the amount that we would owe him
Outright lie! *** *** offered to pay for items when Mr
R*** didn't have the money to purchase these items; and these amounts were
applied to the total payments we made to this contract

R*** "assures you that during the course of the work, we at no time
complained about the quality of the work." Another lie We
were constantly complaining So many things had to be ripped out and
redone If *** *** wasn't there to supervise, the work being done
was of an extremely sub-par level or no workers were even showing up
***, who is totally disabled at years old, stood around for hours in
freezing weather, waiting to see if any of MrR***'s employees would show
up to work

R*** claims the plumbing and electric have been rectified As of our
last inspection of the premises, there were water stains on the wooden floor
MrR*** hired a fourth electrician to finish the electrical work,
and the electrician stated he didn't know what kind of work the previous three
did and couldn't tell if any of it was done right We are extremely
concerned about the safety of the plumbing and electric since all wiring in the
attic is exposed and not up to code

R*** states he presented us the second contract after substantial work was
done on the new project. This is a lie that can and has been verified
by the Sheriff’s Deputy and/or by inspection, as witnessed by my neighbor and a
friend. As I stated above, I told him what needed to
be done before we could even focus on the cathedral ceiling It seems Mr
R*** had tunnel vision when it came to discussing this It was quite
apparent he NEEDED us to sign a new contract and he NEEDED us to advance him
more money because he ran out of money on the original contract There was
NO reason why MrR*** could not finish the rest of the house as I had
asked, and then work on the kitchen Instead MrR*** stopped working
HE REFUSED TO DO ANY WORK BECAUSE HE WANTED A NEW CONTRACT SIGNED AND HE
WANTED MORE MONEY FROM US

R***'s offer to repair the front lawn and cracked sidewalk is the FIRST
TRUTH I HAVE READ IN HIS LETTER

R*** claims he spent far more money on this project than he had intended
That is because he stated to us, "I think I underbid this
project." If MrR*** had done the work correctly (each part of
the project), then it would not have cost him additional monies to rip apart
and repair certain parts of the project Yes, he made repeated trips and
alterations to the property; that was because we had complained things were NOT
DONE CORRECTLY; i.e., the plumbing, when tried, leaked throughout the house

This is THE SECOND TRUTHFUL STATEMENT IN HIS LETTER
As for the
flooring, this was one of a number of items MrR*** purchased and then
returned to the store We saw supplies coming and going--with absolutely
no explanation Again he refers to additional payment Without the signing
of a new contract and only focusing on the original contract, MrR*** was
already paid in full The amount of work he had completed was
approximately 50%--if that much The house is now in disrepair because of
his mistakes and worse than before he started
Yes, we
have/had a propane fireplace in the living room--which was totally operational
and was providing heat for MrR*** and his workers We didn't have
to provide the heat, but we did--at our expense Although we suggested
MrR*** bring in propane heaters or generators, as well as a porta-potty
(so that his men wouldn't urinate and defecate behind our garage), it fell on
deaf ears One of MrR***'s workers decided to pull apart and put
back together our propane heater and, in so doing, placed the heating elements
in the wrong places, causing them to melt and totally foul up the operation of
the propane heater *** *** told MrR*** that he would have to
reimburse us for that Although it may have been an old heater, it was
fully functional; and MrR***'s group destroyed it. The cost to replace it is $5,
The shower
stall had never been used Yes, it needed a cleaning It certainly
did not need MrR***'s men to use it as a dumping ground for their garbage
and waste The shower stall ended up with stains and demarcations. This was originally installed by our
neighbor, at a cost of $2,800, and will now have to be replaced
Yes,
concrete was poured into the bottom of the trailer floor. The house was not leveled, and we no longer
have a crawl space for half of the house
Regarding
the new electric box, *** himself paid *** the electrician in cash
This transaction never involved MrR*** This is another
fabrication

R*** claims the project was 70-75% completed With inspections by our
Gouldsboro PA Police Department and its Chief of Police, as well as some other
trusted individuals, the consensus of opinion is that the work completed is
approximately 50% The photographs clearly show the electric work is not
completed--if it was done correctly at all As stated before, we doubt
the plumbing was done correctly with apparent water stains on the floor
The contracted drop ceiling was never done The flooring throughout
the entire house was never bought and installed All the kitchen cabinets
have not been bought either; and they need to be installed The exterior
of the house still has vinyl siding that needs to be put back in place and
plywood replaced
The time
period of the contract was extended because MrR*** kept stalling for more
money and for another contract to be signed In no way was there $15,
of extras added to this contract THIS IS THE BIGGEST FABRICATION YET
MrR*** kept taking other jobs, would be absent from our
premises for weeks or months at a time, and we would receive phone calls asking
for money

turned off for the winter, we do not know how he tested for leaks
Regarding the ceiling fan, there was no phone call from MrR*** on
January 11, (or 2016)
Again, Mr
R*** refers to *** *** stopping payments on the contract Mr
R*** is of one mind-set, only his way of thinking He was paid in
full and he NEVER COMPLETED THE WORK ON THE CONTRACT!
The whole
problem is with MrR***'s poor management of money and his employees
He paid them for a full day's work when they would show up for two hours
No wonder he ran out of our money so quickly

February 25, 2016Dear *** ***,Thank you for your letter of January 15, I did review the Complaint filed by *** and *** ***I am of course disappointed that such a complaint was filedI have been in business for approximately years and have never received a complaint.I
did enter a contract with the *** on October 23, At that time I estimated that it would take approximately weeks to complete the workThe contract called for total payment of $35,The *** are correct in saying that they paid me $36,214.73, however, that is not the whole storyAfter work was in progress, the *** made repeated requests to change items.After the work started, the *** requested a cathedral ceiling in the kitchenThey knew that it was not within the terms of the original contractI agreed to do the work and started the cathedral ceiling before the original contract was even finishedThe cathedral ceiling was in the second contract before the second contract was even signedI did that in good faithThe ceiling had to be started due to the progression of how the work had to be done.When the *** stopped making payments to me, I did advise them that I could not complete thee work unless I was paidI could not continue to make changes to the contract at their requests without being compensatedI had numerous meetings with the *** to try and work this outI even offered *** *** the opportunity to purchase the materials directly on his own to reduce the amount that he would owe meThat offer was refused.I can also assure you that during the course of the work, the *** at no time complained about the quality of the workThis only occurred after they refused to pay me for the work that I had performedThere were two (2) areas that had trouble, the plumbing and the electricHowever, both of those had been rectifiedI brought in a new electrician at my own expense to have the problems solved I used $of my personal monies between the electrician and plumber. The *** know that there was additional work that was performed at their requestI had presented them with a second contract after I had started the workAfter I had done sub***tial work they refused to sign the contractIt was at that point that I realize that there would be trouble with this projectThat does not change the fact that I had performed the work and billed them for the work that I had performedThis additional work included cutting the metal ceiling out of the trailer and exposing the roof joist to make the ceiling a cathedral ceilingThey then requested that cedar shakes be placed on top of the structure which I didThey are correct that the initial contract has not been completedThat is because the work that they had requested needed to be performed during the course of the first contractI cannot simply complete the first contract, and then tear out some of that work to start the secondThis would have been inefficient and more expensive for the ***.*** *** has complained that I have performed other jobsHe is correct when he would not pay me, I did go to work on other jobs since I needed to make a living and I needed to pay my menAs far as the ruts that were in the front lawn, I did promise the *** that when the work was completed I would replace the front cracked sidewalk in the spring and place new top soil and seed out of good faithHowever, it made no sense to do that work during the winter and it further made no sense to do that work until the project was completeI can assure you that I had spent far more money on this project than I initially intendedI made repeated trips and alterations to the property in order to address the concerns expressed by the customerAll of those concerns were addressed.*** and *** stated that they liked the painted walls.I purchased laminate flooring for the back room and due to lack of continued payment, I left the job and returned the flooring.He had a very old propane fireplace in the living roomWe did him a favor and cleaned itWe know nothing about it not working.The shower stall in the bathroom only needed a good cleaningWe in no way damaged it.Concrete was poured into the bottom of the trailer floorThe concrete was leveled as best as it could be due to the cross members under the trailer.Items from the house claimed to be stolen:There was an old electric box and breakers taken by *** ***He did not steal itIt was replaced with a new electric box which I paid $for*** said he would pay me for it and never did*** asked for the old electric box back and *** told *** it was discardedThey agreed that *** would do electrical work for *** for free since he couldn't produce the old boxAll excessive materials were not removed and used for other jobsThe mud room has always leakedIt was in the contract to renovate the mud roomAll plywood was placed in the mud room, not outsidePlywood used in the attic area was put down temporarally so we could work thereIt was not going to be reused or permanently used as flooring in the attic.This project was 70- 75% completedThe time period had to be extended since $15,of extras was added in the contract.We tested for leaks and there were no leaksAs far as replacing copper piping with pex piping, that was never discussedIt was not in the contract and it was not in any of the changes that had been requested.After the electrical work was completed and checked out by ***, we found out that the new ceiling fan that I purchased was faultyI contacted *** on January 11, We exchanged pleasantries about the holidays and I told *** that we had a new fan that would be installed*** *** stopped responding to my textsI did look at the pictures that he attached to the complaintIt is correct that certain items were not finished, however, the majority of the work was completed and the only reason the work was not completed was because the *** stopped paying me on the contract.It is unfortunate that the entire project was not completed and the *** felt the need to make this complaintI, as a reputable contractor gave quality work at all timesThe whole problem is that the *** repeatedly requested changes and then refused to pay for those changes.Sincerely,K.CR
