I rented a property from *** April 2018 paid for the one year rent in full plus one month deposit and 500.00 pet deposit decided to end my lease early owner agreed to refund me one month rent plus deposit I moved out January 1st turned my keys in January 11
Owner did a walk through home was in same condition prior to renting owner told me to let *** know to refund my deposit which I did its benefits 10 days now no refund I contacted *** she told me she waiting for the owner to send my month refund and then she will return my deposit which has nothing to do with my deposit which is supposed to be in escrow held by the real estate the home has bene listed for rent on *** since December 10th and *** is refusing to return my deposits even after my repeated requests

On April 4, 2018 . & *** came into our Mount Pocono Office requesting housing as soon as possible. *** stated that he is willing to pay for the entire year up front to do this. I contacted ***, a Pocono Resorts homeowner who is on our short term rental program to see if he would be willing to rent for 12 months. The ***'s also told me that they are planning to rent for a year and then purchase a home. The urgency was due to *** accepting a job at *** as a truck driver but they would not guarantee his job until he had established a Pennsylvania residence and had to show proof of this by way of a Residential Lease. Upon agreement of both parties, I prepared the Lease on behalf of the Landlord and Tenant (a fully executed copy is attached). As you can see the date of the Lease is April 6, 2018 so I moved very quickly to accommodate *** so that he would have the job at ***. I asked the homeowner if he wanted our real estate company to manage the property, whereas I would be contacted of any issues that may arise during the term of the Lease. *** stated that he did not want this service. As indicated on page 2 of the Residential Lease, the Landlord was to be contacted with maintenance and emergency issues as/if they arise. I did not hear anything further from *** or *** until End of November/December 2018. At that time, *** told me that he purchased a house but did not know when he was scheduled to close on it. I reviewed the Lease with him and told him that on page 5 of the Lease Paragraph 23 – Tenant Ending Lease Early – He must fulfill ALL of the sub-paragraphs in that Section A, B AND C. See Page 5 of the fully executed Lease attached. As you can see, Paragraph A was NOT fulfilled by the Tenant but the homeowner allowed him to terminate his Lease early . December 1st his wife, *** notified me that they are ending the Lease early and would be vacating the property by February 1, 2019. During this entire time, the Landlord was also contacting me stating that the ***’s could not break the Lease. He also stated that the Tenants owed him money because the propane tank used for heating the home was empty. Page 4 of the Lease CLEARLY states who is responsible for the Propane, the Tenant. The Landlord stated to me that there was 40% in the propane tank when the Tenants moved in. *** stated that there was not 40% and that there must be a gas leak in the line. I called the propane company who told me that they would not put propane in to a leaking tank for safety purposes. *** INSISTED that he had put $200 of propane in the tank in October and the heat was not put up during the day and he was not putting any more propane in the tank. I repeatedly explained to *** that they can terminate the Lease early if they fulfilled all of the sub-paragraphs of Paragraph 23 of the Fully Executed Lease. Paragraph A states CLEARLY that the tenant is responsible to pay until the end date of the Lease. *** did not agree with this and kept insisting that I refund his security deposit. At the same time *** was telling me I was not to release security because there is a propane and cable bill that was still owed to him and he wanted it deducted from the Security. On the same date, *** sent myself and *** a separate email regarding the Washer and the Propane tank. This proves that the ***’s knew to contact the homeowner with maintenance and emergency issues. *** told me that he fixed damaged front stairs at the rental house and that he save the homeowner money to do this so that he did not have to hire a contractor. I was unaware of any of the issues that came up from April 6, 2018 through December 1, 2018 as I was not managing the property. I ONLY prepared the Lease. *** finally agreed to send 1 month’s rent and I sent the security deposit and pet deposit to ***. *** came in person to our office to pick up the checks and left. I have not heard from him again.
