Failed to deliver promised refund, not responding to my email, and instead of progress on my feet the orthotics caused me additional pains.First visit with Dr. [redacted]: 2 April 2014. Advised that their orthotics will make my feet 95% better. Also gave me a pair of boots.28 April 2014: cast made of my feet for orthotics. Paid $555.00.28 May 2014: Orthotics delivered at Dr. [redacted]'s office11 June: visit Dr. [redacted] with extra-different- pains. His response: feet need to adjust20 Jun 2014: same - advised no longer to use the boots.9th July: visit again: adjustments on heel of orthotics made: "should be better".17 July: pain is worse: shaved off, roughly, half of previous adjustment on heel of orthotics.24th July: pain -tried without orthotics for last week.6 Aug 2014: pain persists. Dr. [redacted] shaved off all adjustments on heel of orthotics, and added adjustment on ball of the orthotics instead.14 Aug 2014: pain was unbearable. Went to visit an Orthopedist at[redacted], who advised me that these orthotics were too rigid and, most likely, caused the additional pains and to go to CFI for softer orthotics.18 Aug 2014: to [redacted]20 Aug 2014: last visit to Dr. [redacted]. Was nervous and my blood pressure was considerable higher than normal, as noticed by one of Dr. [redacted]'s assistants.I told Dr. [redacted], cool, calm and collected, that the orthotics are not good for my feet, that I now have additional pains, that I saw an Orthopedist, and that I wanted a refund of the orthotics. Dr. [redacted] took my orthotics, and payment receipt (together in a plastic bag) and agreed with the refund, minus a small amount for business costs. he told me that I would hear in 1 or 2 days from the business office.We shook hands and I left his office.26 Aug: I still had not heard back from the business office. A lady told me that the cost will be credited within a week's time. She also told me that this would be around half the amount I paid, which was not acceptable to me as I do not consider that "a small amount for business costs". She said that she would pass [redacted] on to Dr. [redacted].9 Sep. 2014: Still no refund. Sent an email (see below) to Dr. [redacted]@podiatrycentersmemphis.comAttention: Dr.**.[redacted]Dr. [redacted],Unfortunately, I am still waiting for the refund of the money I paid for my orthotics I returned to you as not only did they not help my feet, but they caused other/new pain problems in my feet.I am most upset about this whole affair, and trust that you honor your promise of a refund ($555.00), minus administration costs: 10% in my eyes would be a reasonable amount.Regards,[redacted]. Desired Settlement1) Refund of payment for the orthotics.2) Compensation for the costs for the visits to Dr.[redacted]'s office, 3) Compensation for the extra costs for visits for new orthotics and advised from Orthopedist, and 4) Compensation for unnecessary pains I have to deal with since using Dr.[redacted]'s orthotics, right until the present, not knowing if these pains will be permanent or if they will heal. Business Response Pt was in 08/20/14 orthotics returned, Pt was advised that refunds are done by 15th of month. A check was issued for $277.50 on Sept 10th, 2014 and mailed. So we responded within 30 days of the initial request which is within normal business practices. She had some charges other than the orthotics, her insurance paid 80 percent of all charges except the orthotics which were non covered by insurance. So pt owed 20 percent of all other charges. Pt signed a waiver stating she knew insurance did not cover orthotics and would pay the full amount. These are custom made devices which are made from a cast from her foot. Consumer Response Thank you for resending this response, [redacted] I fully agree with the fact that I signed to pay the difference between their invoices and payments from [redacted], and I have done so each and every time. I also agreed to pay the $555.00 for the orthotics, which were not covered by [redacted] However, the orthotics made my feet more painful, even after several "adjustments" Dr. [redacted] made. Consequently I told Dr. [redacted] this and we had an agreed: he took the orthotics back, and would send me a refund minus a SMALL administration fee. I do not consider " a small administration fee" being half of the $555.00. That is my main claim. Of course I am most unhappy that my feet became more painful, rather than less, that I had to see an orthopedist who in turn advised me that these orthotics are not suitable for my feet at all and that I had to go elsewhere to get other orthotics. Not only does all this involve more costs for me, but I still have sore feet and do not know whether these new pains (caused by Dr. [redacted]'s orthotics) will decrease or whether they are now permanent. I think that compensation is warranted, likewise an apology from Dr. [redacted]. With regards,[redacted].Final Business Response
