I am writing in response to your letter dated 9/14/16, ID[redacted], concerning the correspondence to the Revdex.com from [redacted], dated 9/9/16. I find it best to address each statement or issue noted in [redacted] letter in a step by step fashion. This should help in answering any and all questions hopefully. I will list [redacted] statements in quotation marks first, then our answer or response directly following. "Company shows false advertising on web-site, claims to offer Design related services, also employees are listed that are not working for this company" Point Surveying does have a website. This website was created some time ago when we had an employee who was well versed in creating websites. It was a work in progress. We were constantly trying to improve and better the use and content of said website. However, the employee in charge of this project has since moved on and the creation and continued maintenance of the site has ceased. We have found that what we believed at the time to be a vital necessity to the company to bring in business has not produced enough traffic through the door to justify time and energy spent on the project. We have been blessed with enough business that the time and attention needed for the website has been directed towards the direct one on one, face to face personal response our customers seem to prefer. We don't believe that what is listed on the web site is false advertising. And because the website has not been updated in a while, there are past employees of our company still listed. "Company uses practices that are: unethical, fraudulent, and contradicting to accepted industry principles." I am not for sure how to answer/address this statement made by [redacted]. I have no knowledge of exactly what he is referring to or what practices he believes to be unethical, fraudulent, or contradicting to industry principles. "No licensed land surveyor worked at this office in 2016 and did not provide "direct supervision" to unlicensed technicians preforming the work." We have always operated under the supervision of the Owner/CEO of Point Surveying, [redacted] supervised all work for the company and its employees. Any map/plat put out by our company has his signature and official stamp. No one else in the company is allowed to certify maps. Unfortunately, [redacted] passed away almost a month ago on August 20, 2016. At this time, we have currently submitted the necessary paperwork to the [redacted] to have permission for another licensed surveyor to step in to supervise and oversee and certify maps for any and all current jobs that were open at the time of [redacted] passing. We are still waiting for the response from the Board and their approval. So, since August 20, 2016, no work has been completed or sent out of our office. "Company has caused problems throughout community and state due to lack of professional judgement and knowledge of accepted principles and practices." We are not aware of the problems [redacted] has referred to. We have not been approached by any customers or any residents of the community or state claiming to be upset by our work. We try diligently to perform the work requested by our clients to their satisfaction. We follow all surveying rules and regulations to the best of our ability. Point Surveying has been in business and has been performing surveys for our customers in WV and Ohio since 1986. "Also, this company has billed me $250 for services that were not requested and no contract (verbal or written) was prepared/executed. The company was hired and performed work for an adjacent landowner and billed a 2"1 party after they became upset with additional/ or unexpected time that was required to perform the work." We were contacted by [redacted] on March 9, 2016 by phone. He asked for a quote for surveying work at that time and supplied his address [redacted] and a phone number. We gave him a quote of $1250-$1750 to complete the requested work. I have attached a copy of the email that [redacted] sent on that same day detailing the work he needed completed and the details and information behind the property line dispute he was having at that time. Point Surveying relies on verbal contract with our clients. Call us old fashion, but we let the customer contact us, explain the work they need completed, and agree to the requested quote for services performed. At that time when the customer says, "Yes, I want Point Surveying to come survey my property", we assign them a job number and begin the steps necessary for each specific job. Our job number system is relatively simple. It consists of two digits (the year the job was performed) a hyphen (-), and then another number. For example on January 1, 2016 the first job we receive would be assigned job number 16-001. The next job that comes into our office would be job number 16­002, and so forth down the line. When the New Year rolls around, the job numbers will begin again, starting with 17-001. [redacted] was assigned job number 16-025. We do not fill out any kind of written contract for the job. All of our work is performed off of the old fashion method of the customer requesting our services, we show up and perform all necessary work requested, and then we get paid for services rendered. Basically, a verbal contract, taking each party at their word. We did bill [redacted] for the time we had in his job on Invoice [redacted] in the amount of $250.00, based off of the verbal contract we had made with [redacted]. Coincidentally, we were also hired by [redacted]'s neighbor, on March 28, 2016 to survey her property at [redacted] 25287. [redacted] was assigned job number 16-034. She had called in after [redacted]. I am not for sure who [redacted] is referring to when he says we billed a 2nd party after becoming upset with additional /or unexpected time that was required to perform the work. We only bill our clients who have requested our services. We sent [redacted] a bill which he included a copy of in his initial complaint, and we billed [redacted] for worked performed at her request. [redacted] has paid her bill in full and was satisfied to the best of our knowledge with the work she received. [redacted] listed under "Complaint Background" that he did not purchase our "product" or surveying service. Based off of the telephone call we received and the email (which I have attached) that he sent to us including the aerial map with the line marked, we agreed to complete the requested survey. [redacted] also personally came into our office and sat down with [redacted] to discuss our findings. He has listed that he talked to our company on 9/6/16. I am assuming he is referring to the priority mail letter he sent requesting dismissal of charges. Under "Desired Settlement" [redacted] asks for a cease and desist letter for offering public service without a licensed land surveyor in "direct supervision" of activities that require it. As previously addressed in this letter, as of August 20, 2016 due to the passing of [redacted], we have ceased and desisted all land surveying activity. We are currently awaiting the Boards approval of another surveyor to oversee our work. Under additional comments from consumer [redacted] mentions employees listed on website that are no longer employed by Point Surveying. [redacted] is not the former owner, he is the deceased owner. [redacted] lists a [redacted] as a manager. We did not have anyone by that name working here or listed on our website. [redacted]r and [redacted] are listed as employees. As previously addressed multiple times, [redacted] passed away almost a month ago. He is still listed on our website; as also previously acknowledged we have not updated our site in quite some time as this is not a necessary tool at this time. Our website is paid on a yearly basis. We have no intentions of renewing our website contract when it comes due again. In regards to [redacted]'s bill in the amount of $250.00, we have written off the charges incurred for the work that was completed and the time spent on his requested survey. Because of the loss of our owner, at this time we have no desire to pursue collections any farther. I have included a copy of [redacted]'s bill with a zero balance. I hope this clears up and answers any and all questions concerning this matter. If we can be of assistance in any way in the future concerning this issue, please feel free to contact us.
