I did remove clients fencing to access area for excavation I will install existing fence post and panels and make the repairs to the neighbors landscape once the other contractor has completed wall construction and has back filled the area, clients needs to contact me once that has been achieved since client has elected to use other contractor to finish wallClient needs to sign a letter stating that *** Construction & Landscaping is no longer contracted or liable to finish wall project other than the fence repair and landscape repairs to neighbors yard stated aboveThe contract then will be considered closed with no other money owed to either parties

Customer paid $1700.00 down of the $3400.00 contract to install a retainer wall in front of existing above ground swimming pool. been completed, while digging out for footers found there is a water issue below grade which has delayed wall construction. To keep additional cost down customer was advised to keep water pumped out of this area so it would dry and I would keep checking in on the progress. The area stayed wet all Summer do to wet season and or not being pumped out. Customer and I agreed that if this does not dry out by October 2014 we would have to try again Spring of 2015. Customer was also advised to install a drain pipe on neighbor's downspout to redirect water and prevent washout, this was not completed. I have always and still want to complete the job that I was hired to do.

I was told by Mr. [redacted] that if we could not resolve the water issue that the area that the digging was done would have to be back filled with dirt, which did not happen and now the entire area is washed out including area at my driveway.  The posts for the fence have fallen in and my fence is falling in.  As far as my neighbor needing to have water from the downspouts diverted, Mr. [redacted] looked at the area  and informed me that this was not the problem and that I did not need to do anything at the neighbors to divert the water.  I did buy piping to put there and did not use it since Mr. [redacted] told me that this was not the issue.  I never heard from Mr. [redacted] after his vacation in the first week of October.  If the area that he dug had been back filled with dirt, there may not have been the issue that is now present in the yard.  The block is in my yard and has been there since the project started in May.  I do feel that he needs to pay for damages to the fence and the neighbors landscaping which has continued to wash out and will continue until I have the work completed by the other contractor.
