Please be informed that as supervisory attorney, I have reviewed the case of this gentleman thoroughly with the attorney who attended him and the assistant who also worked on the case. On the day the client had his initial consultation to review his legal options, client, urged my staff to
work to resolve his legal matter that same day despite numerous attempts to have him schedule a follow up appointment after the consultation to begin the work on his case. While it is out of the norm for my staff, because of his persistence to obtain resolution that same day and because the attorney's next appointment coincidentally "No-showed," the attorney accommodated his same day request to work on his case Client paid a retainer to begin the work on his case A payment is legally paid in exchange for services rendered Here, services were rendered for the retainer Upon collection of the retainer, the attorney proceeded to draft the contract and assigned the applications be completed to a legal assistant who was pulled away from his scheduled tasks to instead accommodate the client's urgent request to work on his case As requested, the contract and applications were completed while client agreed to wait for same in the waiting area. Despite assuring the attorney working on his case that he would wait for the contract and applications to be completed, the client decided to leaveTherefore, the receptionist scheduled a follappointment for the next dayClient returned as scheduled to his follappointment. The assistant proceeded to review the applications prepared the day before with the client to ensure the information was accurate and to coordinate obtaining his mother's signature. After this work was done, the client provided the assistant legal documentation client had received from his mother. The assistant then called and informed the attorney that the client had brought in legal documentation provided to his mother by her previous attorney. Upon learning that there were new legal documents to review, a service we often charge separately for, the attorney interrupted her schedule to meet with the client. The attorney took the time to review the numerous documents the client brought and provided a legal conclusion to client’s legal matter and resolved the doubts he had regarding the matterIndeed, this was the client's goal in retaining the firm's legal services when he paid the retainer, thus the work was concluded fully Given the work and effort provided to accommodate client’s requests, it is surprising to know he requests a refund of the retainer he paid when the work was fully performed and in fact it is likely that at our hourly rate he would be owing our firm funds for further review and legal analysis performed beyond the initial consultation and beyond the applications that were drafted and completed the day before. For the aforementioned reasons, we decline to provide this gentleman a refund given our firm went above and beyond to accommodate his "same-day" request to produce applications and his request for prompt resolution including a next day, impromptu legal review and analysis of legal documentation resulting in resolution of his legal matter
