Dear Sirs, Thank you for your letter of...

5/15/17. Previously you had presented us with 3 “?nal” invoices with the same line items of changing amounts thereby varying totals between 12K to 15K. Now with your letter we have a solid amount of $14,455.17 You do realize that at the time you say the plaster payment was due you had already been paid $153,800,over 90% of the total project cost? Leaving only $14,455.17. You were paid well in advance of the work accomplished. Basically, the pool has not run properly at anytime since water was introduced and still does not do so. Are you surprised we paid for the rock invoice and yard grading around the pool instead of sending it to you? You had not started: 1. the building of the kitchen stonework 2. the Pergola (who spends 2 months building a pergola?) 3. installing any of the pool equipment 4. The Cool Deck had not been applied And we were to believe you could ?nish the project on $14.455.17? Well the ?nal product does not function.If you will refer to the email of 3/2/17 (attached) you will see that during this period of time when you were not receiving the final invoice funds. We were in fact paying for dirt work/grading,the stone used around the pool and coping and paying to correct design/ electrical and building errors previously made. (additional breakers in boathouse, damage to boathouse facia, kitchen stonework too short and completion of unfinished replaces) Plus the clean up around the site was epic. The total for monies spent by us was $12,691.75 so we do indeed owe PDC $1763.25. But you owe us a properly performing pool and without a cracked patio. We can hardly be in breach of contract as our only requirement is to pay and yours is to preform. PDC, did not perform per the contract from the very start. The contract clearly stated three (3) PDC folks would be on site during the project. PDC was rarely present to guide and manage their subcontractors. This is what led to PDC being over charged for work, both electrical and plumbing. How many plumbers did you have to let go AFTER their work errors was reported to you by us or Chuck? PDC was not present on the job, mistakes were made and the pool project took over 6 months get water in the pool. PDC has since ceased making any attempt to perform and take corrective action to cure long known problems. See 3/1/17 attached and Addendum. If as stated in your letter, you have no intention of correcting the problems then we will have to do so. Do you think the patio cracks and main pump issues can be solved for $1800? I think not. Monies spent in corrective action in excess of monies due will form the basis for a Breach of Contract and Deceptive Trade Practices Act claim. This can not come as any surprise to you having been informed via text and email of the failures to substantial perform per the original contract. As far as PDC cancelling the Pentair warranty I will take that up with Pentair and they too can be a party to an even larger lawsuit. These conditions have already existed for almost 90 days with zero corrective action taken by you or Pentair. If you do not intend to cure the aforementioned problems let us know and we will do so. If the problems are not cured within 30 days we will take steps to correct them ourselves. Very truly yours, [redacted]ADDENDUMProblems still to be addressed Cracked concrete leading to cracked Cool Deck on Patio. Chlorine tab feeder does not operate-no water in it. Main pump sucking air- A failed valve discovered and replaced by [redacted] at Owner's expense stopped pool over owing onto patio and yard from priming hose and reduced some of the air intrusion. Priming hose does not appear to aid in priming. Excess air bubbles still remain in the system and are visible. The system still takes excessive time to prime even in Service mode, sometimes hours. If we are lucky it only takes another 30-40 minutes to make the switch from Service to Auto Mode and recently after over 5 hours the system would not go from Auto into spa mode at all. The Spa line back?ow valve appears to barely opens to allow water which might be part of the problem. You have not been onsite in many many weeks and no one you have sent in the past did any work at all,other than to install a faulty hose bib valve, they just stared at it. On 3/1/17 via email it was discussed that Pentair might come out on or about 3/6/17 to go over the system with me. This would have been ?ne if the main pump worked in other than Service Mode. What exactly were they going to show me other than on their one “visit” to help setup the Pentair App on my phone? On 3/3/17 a Pentair Work Order WO-00662066 was created but nothing came of it. No one came out and the problems persist. If you told Pentair to not come out you have tortuously interfered with a warranty contract. It just gets bigger. As per inspection made by Longhorn Pools and you were so informed many weeks ago the source of the air intrusion would have to be detected by a 3rd party with proper equipment.
