Re: Formal Complaint

To Whom It May Concern,

In the summer of 2012 we had two spots in our gunite pool where the plaster had come loose. We contacted [redacted] Pools who built the pool in 2004. They recommended [redacted] Silva of Silva Plastering out of [redacted], MD. After contacting Mr. Silva he came out and gave us a price of $750.00 for the repair of the two spots or $2500.00 to re-plaster the entire pool. We decided to re-plaster the entire pool, but would do it in the Spring of 2013, needing to drain the whole pool.

We scheduled the work with Mr. Silva for early A.M. on April 24th. We drained the pool and scheduled water delivery for around 3:00PM. At 10:30AM we called Mr. Silva only to be told that he would not be here that day. I asked why he didn't call and tell us, he had no answer other than he was very busy working on newly installed pools. He said they would be there on Sunday the 28th in the A.M. At around 11:00AM I called to inquire as to when they would be here and Mr. Silva said it would be in the afternoon. We called our regular water company to schedule the delivery after cancelling on the 24th and the owner said they I supplied the tile for the wall and Silva Plastering supplied the tile for the steps. When completed the job looked good, acceptable. We gave the check and a self-addressed envelope, for return of a receipt and two year warranty, to his foreman to give to Mr. Silva. The checked was cashed quickly but still did not receive a receipt or warranty.

After the plaster cured we noticed a two-tone color, gray and white, the job w&s supposed to be an all-white pool. I don't know if they used to different types Of plaster or didn't apply thick enough in those areas that are gray. Anyway we ended up with a two-toned gray and white pool.

We called Mr. Silva and requested that he come and look at the pool. We also asked about our receipt and warranty. He asked if that was what the envelope was for and my wife stated yes. He said he would be out in a few weeks to check the job and bring us a receipt and warranty. Three weeks past and still no show. Spoke with Mr. Silva again on May 21st and he said he would be out in couple of weeks. On June 11th called Mr. Silva again to be told that he would be out after July 4th. We called again in August and finally again right after Labor Day and told him we would be closing the pool in two weeks. He again said he would be out in two weeks. We informed him if he didn't show we would contact Revdex.com. To this date we are still waiting for Mr. Silva, our receipt and a copy of two year warranty.

I think my wife and t have been very nice, professional and pleasant throughout this entire ordeal and all we wanted was a professional job and service which was agreed on with [redacted] Silva.

It looks like we will end up in court, if that happens we will be asking for a full refund, court cost and lawyer fees from Silva Plastering.

Sincerely,Desired Settlement: Mr. Silva to come and look at the pool, our receipt, a copy of the two year warranty or a full refund (see Attached document).
