Bedford Paving (“Bedford”) values the opinions of its customers.  For the following reasons, however, Bedford denies Ms. [redacted]'s assertions. Back in January 2017, a property manager for the Homeowner’s Association  in which Ms. [redacted] lives contacted Bedford for a price to have a...

private road sealed. Bedford does not perform any sealing work. It is a paving and asphalt contractor.  As such, Bedford referred this inquiry out to a sealer with whom it does business.Subsequently, as Bedford understands it, the sealing company was asked by the Homeowner’s Association to also provide sealing prices for each individual homeowner's driveway and inquired about whether a group discount could be offered. The sealing company provided prices for the interested individual driveways. We also understand that they provided discounts so long as each homeowner signed to have their individual driveway sealed.  In other words, the sealing company provided a group discount, so long as each homeowner contracted to have their driveway sealed. After that, because Bedford was the initial point of contact, homeowners called Bedford to inquire about the price differences between each of the homeowner’s individual driveway estimates. Bedford explained that each price is dependent upon the size of the driveway. We further explained that each driveway price with calculated based on a pure square footage calculation. Nothing more.  So the more square footage - the higher the price.  The calls continued.  And Bedford received even a few complaints about the individual driveway price. Bedford communicated this to the sealing company and because the calls were becoming a bit intrusive to Bedford’s business, the sealing company indicated, it was no longer interested in performing the individual driveway work at a discounted rate. Four months went by.  Then in April, as is customary when the weather warms, some of the homeowners contacted us to have their individual driveway sealed again. This time, since not all of the homeowners agreed to have their individual driveway sealed, so a full price was given - again based on pure square footage.  Apparently, a few members of the neighborhood opted to pay full price.  This, apparently, is what Ms. [redacted] witnessed. None of these homeowners were given a reduced rate. Ms. [redacted] was free to contact our office for a full price estimate. But neither Bedford nor our sealing contractor was obligated to offer her a customized discount at any time.  The deal with the homeowner’s association was that a group discount would apply, provided all homeowner’s agreed to sign.  This did not happen.  Thank you.  I am available at your convenience.   Law Firm [redacted]  [redacted]

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
I do not accept Laurie C.'s , from Bedford Paving, response to this matter.  First of all, she never said anything about putting a top coat on in our conversation, nor did she mention anything about replacing the cracked areas and putting saw cuts in the driveway. I'm not sure who she was talking to, but it wasn't me.  I have repeatedly asked for someone to come out to our house when we are home and she would not send anyone to discuss this matter.  I find this very rude and I am home two days in the week when someone could set up a time to come out to speak with me. This is the reason I said I was going to call the Revdex.com.  I was not hostile. I just wanted someone to come out and speak to me.  This is a poor way of doing business.  I called them 4 times and they didn't have the decency to come out to talk to me.  Who wouldn't get irritated! The areas that are cracked are 6" in on the side of driveway in two long spots, where the pavement was applied very thin. It is not the edges that are cracked, as she stated . It is 6" into the side of the driveway!  These areas required minimal backfill and that is not the cause of the cracks.  The cause is that the asphalt is too thin in these areas. The amount of backfill used was so minimal and was not enough to keep the asphalt from moving. In most spots, the backfill was merely  1/2 an inch thick.  It clearly states in our contract that they would apply  2 3/4 inches of Dense Binder Asphalt( compacted to 2 inches). This is not 2 inches in these areas or the whole driveway would be cracking! I would not recommend  this company to anyone. They have very impersonal service and do not resolve issues on a personal basis, only on the phone. Obviously, there was never a resolution!

Revdex.com:I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.[To assist us in bringing this matter to a close, we would like to know your view on the matter.]Regards,[redacted] I had read Bedford paving response and it had nothing to do with the price nothing was mentioned about the price when I had called the company I had asked that I would like to have my driveway done she told me, the girl in the office,  that because of complaints that they were doing no driveways on my street so I figured I'll see if I can get another company to do it the whole reason of having it done by Bedford paving Because of convenience, when I saw the driveways on my street being paved the same time the private drive was being done I couldn't understand why she said no to me, again it had nothing to do with the price she had said they were doing no driveways on my street because of complaints

We were first contacted by the customers on 6/16/14 with a complaint of cracking along the driveway edges.  We were contracted in July of 2013 to remove their existing asphalt, leave the existing stone and install a binder driveway (attached).  After receiving the complaint in 2014, our...

estimator went out, looked at the driveway and took pictures (attached) of the complaint area.  We responded to the customer’s complaint with a letter (attached) dated 6/18/14, the letter stated that the cracking was directly related to the customer not backfilling the edges of the driveway per the care sheet they signed (attached) upon accepting the contract.  A second copy of the care sheet is also left with the homeowner on the day we complete the job.  We heard nothing further. Mrs. [redacted] called again in July of 2015 with the same complaint as 2014.  The same estimator went out on or around 7/22/15 and took more pictures.  The driveway had since been backfilled, as recommended in our 2014 letter, and the cracks were exactly the same as they were in 2014 and no further damage had occurred.  Mrs. [redacted] called before we could send a follow up letter.  I spoke with her via telephone and explained that the cracks are a result of them not backfilling the edges when the driveway was originally installed.  I also told her our pictures from 2014 and 2015 were identical and no further damage has occurred.  I explained there was no defect in material or the way the driveway was installed but a direct result to not backfilling the edges of the driveway.  We also discussed driveway integrity and installation practices and I explained that her install was the binder coat of the driveway and that a finish coat (top coat) should be installed in the future.  A top coat was offered in our original proposal but they opted not to have the part of the work completed.  Mrs. [redacted] was not interested in listening to what I had to say but continued to insist we did something wrong and wanted us to come out and fix it.  I tried to explain that should we come out and replace the cracked areas she would have larger, more noticeable saw cuts in the driveway repair areas.  We went back and forth on the same issues stated with no resolve.  Mrs. [redacted] became more and more agitated on the phone and "threatened" to call the Revdex.com.  I told her that was her choice but that we felt we installed the driveway properly.  This did not make her happy and after that she became hostile and was yelling at me on the phone.  I tried to reason with her but she was not interested in hearing what I had to say so I explained that we were not going to come to an agreement about the driveway.  At that point I told her I would be hanging up now as she would not lower her tone and have a respectable conversation. Bedford Paving feels we installed the driveway per the specifications in the contract.  Had Mrs. [redacted] followed the care instructions for her driveway the cracking would not have occurred.  As you can see by looking at the pictures, the cracking is minor and hasn't changed from 2014 to 2015 which shows that there was no defect in installation. Please feel free to contact me with any questions or clarification. Sincerely, Laurie C. Office Manager
