Review: On 4/**/** , me and my wife [redacted] , entered into a contract with the [redacted] auto mall , financing a used 2012 Chevy Impale ,VID# [redacted].We contend that at the time of purchase we spoke to the finance officer ( [redacted] ) ,who explained that [redacted] , had appoved our loan with 2000.00 , down , with a payment of 364.37 , a month, and , a bumper to bumper warranty , 3-years , 36000.00 miles , powertrain warranty included , 5-years , 100,000.00 miles . We contend that , at this point in time , they spoke to the finance officer regarding the bumper to bumper warranty. The finance officer then indicated that if we put an additional 1,000.00 , he would not only get the payment reduced , but get us the extended bumper to bumper warranty . We further contend that we gave the finance officer the extra 1,000.00 , for the extended bumper to bumper warranty . Henceforth , we were asked to sign papers regarding the loan . Nonetheless , at this point we questioned the amount and payment would be , and , the extended warranty . We contend that that they were informed that said finance officer would work on it , that we should wait in the lobby . we further contend that approximately an hour later , the sales representative Mr . [redacted] , informed us that our vehicle was ready .We contend that that they then questioned Mr [redacted] , regarding the situation of payment and warranty promised . Mr . [redacted] , indicated that [redacted] , would forward all info regarding payment and would hear back from finance regarding extended warranty . We further contend that upon leaving the auto mall , we noticed that the passenger mirror was damaged . We contend that we immmediately informed Mr . [redacted] , of said damage . Mr . [redacted] , apologized and asked us to wait in lobby while he had the car serviced . We contend that about an hour later we started to complain to Mr . [redacted] , that we were unhappy about the situation . Mr.[redacted] , then apologized and informed us that he had to order the parts , that we were to call the service department in a couple of days . We then argued our position that we didn't want to drive the car in its present condition . We were advised that the matter would be addressed immmediately within the next couple of days . We contend that we then left the auto mall with the vehicle . Approximately a week passed and several phone calls made and / or complaints , they called us and scheduled an appointment for may 1,2000 , We contend that at the time they serviced the vehicle and replaced the mirror they were informed that the warranty covered all expenses . We contend that at this point and time , we knew that the original bumper to bumper warranty was in effect , but was under the impression that the extended warranty was also in effect. We further contend that on 10/** /12 , we noticed that the check engine light was coming on . On the same date we called Mr. [redacted] , the sales representative who handled the sale and explainded that we were having prolems with starting the car . Mr. [redacted] , informed us to call back tomorrow and get a hold of the service department . on 10/**/** , we contacted the auto service and explained to them our position . We advised after a long conversation that there wasn't a extended warranty , that we would have to pay out of pocket for any and all repairs . Unpleased with the situation , on 10/**/** , we then contacted the finance officer ([redacted] ) , and informed him of our grievance . We contend that after a long conversation and reviewing the paper woprk , he apologized and stated that he wasn't able to get the extended warranty . I then asked him were was the 1,000.000 , that we gave him . He stated that he applied it to the down payment that he was sorry he didn't get back to us , that he's been really busy , that we weren't the only ones on his schedule . He then stated that we should take the vehicle to a Chevy dealership , under the power train warranty . Moreover , after several minute arguing with him about the 1,000.00 , he said that the contract speaks for itself , that we needed to read it . Hence , we then noticed that the contract did indicate that 3000.00 , was put down as a down payment which we dispute 100% . On 10/**/ ** , we took the car to [redacted], Chevy dealer ship , in Middletown , NY , for service . WE were informed by Chevy , that a diagnostic test was to be done to let us know what was wrong with the car , because the car wouldn't even start . So , they called back the same day indicating that The muffler system needed to be replaced , the battery and cables , and , wheel barrings , ect ., which would cost several thousands dollors , which we have the print out of costs . Well , we were totally shocked that we just bought a 2012 , vehicle with so many issues . Nonetheless , we could only afford to have the battery replaced , because of the costs , that the power train warranty didn't cover anything . After loosing several days work , we called [redacted] back , several times leaving messages for the general manager , without response . On 10/**/** , we called [redacted] , asking for help , without redress .e then called Chevey corporate and asked them for help , the office of te president and spoke to [redacted] , and explained our position and she informed us to file a coplaint with you all. She also helped us by getting the costs of the repair lowered , because she felt that we got treated unfairly . In closing , till this day were still having problems with this car , please help us .Desired Settlement: We would like are 1,000.00 , back and/or our extended warranty . In fact , we would appreciate that we be placed into another vehicle without prejudice and /or without having to pay out costs in order to have a decent vehicle . The vehicle is only a year old , my god .

I am writing to you response to Mr. [redacted] complaint. Please be advised that Mr. and Mrs. [redacted] came in to review their concerns with me on November **, 2013. I explained that I was not aware of any problems with their purchase of 2012 Chevrolet Impala, And [redacted], the finance manager who they were dealing with is no longer employed with us. I am happy to inform you that we were able to place Mr. and Mrs. [redacted] in a brand new 2013 Chrysler 200, as they requested.

I would like to take this opportunity to recap our phone conversation today, regarding Mr. and Mrs. [redacted].

Mr. and Mrs. [redacted] have [redacted] Auto Mall Inc. $3,000.00 in April 2013 that was used as the down payment for the 2012 Chevrolet Impala for a new 2013 Chrysler 200.

It was promised to the [redacted] that the $3000.00 down payment from the prior purchase would be used toward the new purchase.

Dear Ms. [redacted] , my name is [redacted] , Complaint [redacted] , I am in receipt of your e-mail dated 11/**/20** , in regards to the documents received . Moreover , I am also writing to you at this time in regards to an e-mail forward to me on 11/**/20** , by your office indicating that I failed to answer and/or respond to Mr .[redacted] , General Manager , [redacted] Auto Mall , that my complaint has been closed . Please be advised , that I have filed several complaint's with your office , including an amended complaint regarding to following . On 11/*/20** , my wife and I , met with Mr.[redacted] , General Manager , [redacted] Auto Mall , and agreed on the following , that " The 2012 Chevy Impala , would be fixed , and , he would return the $1,000.00 , that was put down toward an extended warranty . However , before we left his office , Mr . [redacted] , asked if we were willing to give him an opportunity to " try " and place us in a 20** Chrysler 200 , we agreed , under the following conditions , that the original $2,000.00 , that was put down on the 2012 Chevy Impala , and ,the additional $1,000.00 , that we paid toward the extended warranty , totaling amount $3,000.00 , be put toward and/or transferred toward the new car 20** Chrysler 200 , which clearly wasn't ! Ms. [redacted] , you have acknowledge possession of those documents ! Wherefore , I do not understand as to why your office is indicating that I failed in any way shape and/or form of answering Mr.[redacted] , response . Please be further advised , that we have also initiated a complaint regarding the 20** Chrysler 200 , regarding safety recalls , to wit : that we only had the car five days and it broke down . This is " DISCRIMINATORY PRACTICE " on behalf of your office in handling this matter . Mr . [redacted] , General Manager , [redacted] Auto Mall , has admitted fault in this matter , and , on behalf of his employee's , has apologized . I can't believe your office is indicating that I failed to do something ! It is now my opinion , that I need to take this complaint to the Attorney General Office , in order to seek redress . In closing , I hope and pray , that there has been a mistake made , and , your office will continue to seek redress in this matter , to with Getting our $3,000.00 , back .
