I have appreciated your patience on this project as it has drug out longer than any of us had expected. As you know 2-1/2 months of this time was wrapped up in just getting the city of to sign off on the permit, we are now in a situation where...

there are unforeseen condition of the soil has led to the requirement of engineering on footings and soil conditions. This is extremely costly to get this worked out, I have tried to get by with a basic soil conditions test but the Building Official is pressing for stamped engineering drawings to verify the new footings will suffice for the load of either the sunroom project as originally planned or returning your deck to the design it was before we got to this point.
You have requested that we put your deck back to the original design and forget the sunroom project, we are committed to getting the project done for you either direction it goes. Since the footings need to be done with either project; we need to get this process completed to get actual costs.
To get the new footings in place I have a foundation company that can get a small walk behind dingo type machine to drill in helical footings that can be engineer stamped to meet the kip requirements for either the deck or the addition. To get this machine in place we will need to temp up the upper deck and to and remove the lower deck to get the machine into place to drill the 6 footings.
It will take me two weeks to get a crew out there for the helical footings. Once these footings are in we can begin building right away to complete your project. If we install a cedar deck with cedar railing back into this location it will take us about two weeks to complete.
If you would like to move forward with the sunroom option there will be an additional 2 to 4 weeks for the completion time.
Unfortunately due to the unforeseen soil conditions we are limited to the choices we have available to us. We are committed to getting through this process with you.

We have met again since this response from Portico. I also had the building inspector clarify the solution...just put the deck back without new footings just put down the cedar boards and railing. Return the initial $20,000 and let me know the cost of putting the deck back and whatever is left from the #14,000 installment will cover the costs. Waiting to hear back from Clint. He was out at the house 1/4 to do a measurement for the 2x6's...and waitng to get the final word. I'll reach out tomorrow as I did not hear back today as he said he would.

Portico has emailed the documentation to Mr [redacted] for us to change his contract as he is requesting. We are discussing he timing of the remaining details. I believe this will be settled soon. We are sympathetic to the situation as it was out of our control and we are working with the [redacted]'s during this transition to make it go as smoothly as well can.

The material for this project is at our warehouse and the customer has requested a scope change to the overall size of his project. We are working with the customer to complete this scope change and finish his project as quickly as possible.

5/4/16Re: Revdex.com complaint from [redacted]Dear Mr. [redacted],I am responding to your document dated 5/3/16 for [redacted].  We apologize for the issues that arose from getting a slow start on the project for the [redacted]’s, I’m sure you will find that we have not done anything as fraudulent as Mr....

[redacted] is claiming and after numerous attempts to get the project back on track we have not been able to come to an agreement with the [redacted]’s.  We signed the original agreement on 10/23/15, there was a change order requested by the [redacted]’s to add additional items to the project that was signed on 3/7/16.  The [redacted]’s then decided that they wanted to make another change to lower the cost for the extra additions from the change order dated 3/7/2016 so another proposed change order dated 4/13/16 was written up but was refused by Mr. and Mrs. [redacted]. My installation supervisor and myself met with the [redacted]’s to get the project back on track on March 22nd, the plumber and the process was agreed to by all parties at that time.  The plumber was there on 3/23/16 to perform the additional work that was requested and agreed to by Mr. and Mrs. [redacted] per the change order dated 3/7/2016 and the drywall was scheduled for install on 3/30/2016.  The morning of 3/30/2016 Mr. [redacted] prohibited our crew from continuing with the project and that we were no longer allowed on the property.Since then we have been accused several times that we do not stand by our product or our service, which is not the case. It is always our intention to do our best for our customers and we strive to satisfy all Portico customers. We want to come to a reasonable agreement with Mr. and Mrs. [redacted] and close this issue as soon as possible.We have sent a breakdown of our expenses with a refund proposal to close out the project to the [redacted]’s.  We informed them that once the agreement is in place and we have a signature on a Non-Disparagement agreement, the money will be refunded.
