I was contracted to lay asphalt for Mr*** and Mr.***, they have attached drivewaysBoth contracts stated they did not want asphalt connecting to the road( attached is the signed agreement from Mr***)I told both men they
should continue with asphalt to the roadMr*** agreed and payed me to lay the additional asphalt to the road, Mr.*** said "No I am not paying for city property to be asphalted." So I let it be, and did not push the issue any further*** and Son's laid Mr.***s driveway first and then Mr.Gaspers, while we were in the process of getting the job laid, Mr.*** decided to finish the asphalt to the road, however we had already ordered asphalt to do his job and was already in the process of finishing it, at this point in the day we could not get anymore asphalt because the plant was already closedI told Mr.*** if I ever had extra asphalt and happened to get back into his area I would pave the end of driveway for a price of $400.00, and he verbally agreed because, Mr.Gaper knew it was his fault for continuously telling me "no" to finish his jobNow that Mr.*** has decided to file a claim, I am not going to finish his driveway and for no cost( I am a busy man, I do not have time for accusations.)

This entire issue could have been avoided if we had gotten a return call at some point over the last year from Mr Potter as we were told we would receive by his wifeWe never asked or expected Mr Potter to lay the additional asphalt for no paymentAlthough we were concerned initially about damage to the part close to the road from snow plows, he explained it would be fineWe also indicated we wanted him to seal the driveways in the spring for an additional feeWe began calling to confirm an estimated date for that application in early springMrs Potter said we were high on the listMonths went by and nothing was done and we received no callbacks as we requestedWe finally had the sealer applied by someone else since Potter never came to do that jobAgain, a simple phone call could have prevented all these issues before it got to this point and we would not have a bad opinion of the company

Potter& Son's finished everything they were hired to do, attached is the signed contract by Mr. [redacted] stating so. I do not seal coat driveways for free, I did not say I would seal for free, where this came about I have no idea.

and Mr.Gasper called Potter and Son's to have their driveway seal coated this year, however we are busy. I have a lot of customers, we seal coat all the way up until November, they would have gotten it done (not for free) if they would have just been patient. Just because Mr. [redacted] thinks it has to be done when he wants, he does not run my business, my price, had I of ever given them a quote for seal coating would have been $500.00. I will not be reimbursing them anything, and I never promised them anything. (PERIOD). Also you are suppose to let asphalt cure for one whole year before seal coating.
