Plants from landscaping job have diedPoultry Villa did a large landscaping job at my house ($4500) including new plantings in several areas in February of 2015. Beginning in the summer I noticed that many of the azaleas that had been planted were beginning to droop leaves and subsequently lost leaves and died by the beginning of Sept (a total of 12 azaleas). 3 Globosa plants also died in a different area. I contacted Poultry Villa in September via phone and email and requested that they replace those plants as I had placed this house on the market and it was not showing well. After a couple of weeks, they got back to me. The went out to look at the plants and indicated to me that they thought someone had sprayed something on the plants or fertilized them and they were not going to do anything about based on their policies. I told them that I had not sprayed anything or fertilized these plants. After a contentious phone call, Mr [redacted] said he was sorry, but he was not going to do anything about it. Only azaleas and the globosa have died. All of the other plantings are fine.Desired SettlementI prefer replacement of the dead plants, however, I will take a refund for plants that have died. Business Response /[redacted]/This job was completed in February 2015, and it is our policy to give a 30 day warranty for all plants. If something happens to the plants as a result of our misdoing it would show within that time frame. As these plants died over 6 months later, we cannot be held responsible for them. There are a plethora of reasons as to why these plants might have died, but improper care on our end is not one of them as we have not touched the plants since February. I have explained this to the customer and visited the house to see if I could determine a cause for the plants dying. The plants are fully rooted in the ground, and the leaves are still on them but brown. Because the leaves are still attached to the plants, it is reasonable to believe some chemical has been sprayed on the plants as this is the typical reaction. The customer told me that he had some carpentry work done on the windows right near some of the plants, and that included painting and caulking, which could have caused the issue at hand. The customer called me and heatedly threatened to contact the Revdex.com, and I apologized that the plants had died but explained that since it had been over 6 months we cannot be held liable as our policy is 30 days. Due to the expiration of the warranty and my company not being at fault of the plants dying, it is unreasonable to request that we replace or refund the plants.
