I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below. The lease does in fact state but it does not say on or before the 1st of the monthI notified her on the 6th and offered to prorate for the first days of the following month to make it a complete monthThis was declined by the landlord because she had a tenant that she wanted to get in on the first so the days was given by us and was refused by the landlord. A walk through with the property manager was preformed on the last day of our rental 9/and he stated that we would only need to re-clean the refrigerator and the stove to get our security back, both of these items were completedAt that time no reference to an odor had occurred and the building manager even stated that when he showed the apartment to prospective tenants that the place smelled good and cleanWe have two cats not three and both are fixed, we do not have any issue with odor and we had all of the carpets cleaned before we left as per the rental agreement. The amount of stuff we owned was at the time being packed up so we understood that it looked a little untidy, we also then rented a storage unit with our own money to appease the landlords and placed our excess boxed in it for the remainder of the month so that there would be less in the apartment for showingWe also made sure to clean and pick up before each showing that they notified us about. As per the lease we should have received our security OR a notice that we were not receiving it with and itemized bill on exactly what our security was used forWe received neither and when I reached out to Bernadette several times through text she sent no responseLater we hired a lawyer to send several certified demand letters to the address above (* *** ***) and no response was made to those either. If carpeting needed to be replaced that should have been told to us, additionally the wood floors would need to have been redone regardlessWhen we lived there a new refrigerator and heating system was installedWhile bringing in the refrigerator the hardwoods in the kitchen were scratched up and when the radiators were removed from the house this also caused damage to the floors in the living room and upstairsWe pointed these damages out to the property manager and was assured they would have no bearing on our security. As for the lost rent when we were moving we were told that she had found someone to rent it and that is why she declined the prorated amount for the first six days of OctoberWe also have proof that the new tenants moved in on the 30th of September while we were still vacating and cleaning the apartment, there is no way to attest to what damages were made by the new tenant after we left because no walk through would have been preformed with the new tenantsThey moved in before our lease was even upMy boyfriend was still in the apartment cleaning when the new tenants showed up with their stuff. Bernadette told us that the new tenants would be dropping things off to the attic possibly before the 1st but the attic was not attached to our apartment in anywayThe new tenants walked into the apartment and started moving in while we were still technically living there. We also had to endure several un-responded to repairs that left the apartment in un-showable shapeThere was a large stain in the upstairs roof where there had been several leaks during heavy rain that had never been repainted over after the leak had been presumably fixedAfter the first leak occurred a secondary leak formed over the stairs, we told the building manager about this but nothing was done about it, one night at in the morning our smoke detector started to go off because the rain had leaked into the roof and then into the smoke detector shorting it out and causing it to burn outThere were also several holes around the new heading ducts that were installed that were not sealed up after the installationI believe these repairs should have been done before asking a new tenant to move into the apartment regardless. The apartment was not vacant in September we were still living in the apartment until the 30th when we were cleaning and moving things out when the new tenants came in, we also paid for September rent the the water bill that was due in our name, there was no money that should have been taken from our security for missing rent after our lease term was up. I do not accept the responses given for not given us our security back especially because the walk through with he building manager said we wereAfter several attempts to reach Bernadette about even receiving proof that she had to use it on damages and getting no response I filed a complaint with the Revdex.com

9/6/This was not a day notice but I was going to work with thetenant if I could get it rented in timeI did not know the condition of the place at this timeItold her at the time that this was not a day notice which was required for her securitydepositShe said she would have told me sooner but the new place didn't inform her until then.Security is used for damages done to a place or a last months rent if a day notice isn't given.I have saved all the texts that transpired with herI did tell her the rules and have signed leasepaperwork stating the notice requirement.I went on to try to rent the place but the place had a bad cat odor from the cats they ownMyProperty Manager told me after trying to show itI did not know about the cat odor before this.Not only did we have cat odor but they had so much stuff in this house it was too hard for us toshowLiterally hard to see the place or walk through itIt was not dirty, that was not theproblemThe place could not show wellWhen they rented the place from us it was nice andno odorI have pictures of how they received itI decided to try to rent to a tenant I had inanother place of ours who hoped for a larger placeOur tenant moved over to this place andcould only stay a few days because the cat odor was too strongWe lost September rent money& needed security money to get rid of the smellI ended up having to do the wood floors overand put in new carpet and padding to fix the cat urine odorI have apartments in the CapitalDistrictI do not keep security deposits if the person gives me the required days and givesthe place back as they received it.The security in this case was used for new carpets, new padding and putting new polyurethanedown on all the wood floorsThis is a big place so the security didn't go far and I lost themonth of rentI have proof that the place laid vacant during September and that we had to workon the place to get rented for October 1st.Sincerely,Powell Properties
