We are now looking at a different contracts; What [redacted] is highlighting under Paragraph 5, only pertains to the Club's Membership Contract as the title states at the topClub Membership Contract is for a term of one year as stated under contract membership types and it begins 5/21/and ends 5/21/after which point the membership goes on a month to month contract until member wishes to terminate with a day written notice of termination and return of Club's KeyUnfortunately this is not the services ContractThat contract would be Titled StrengthPak Nutrition/Training Services Waiver and Release for which a service has been provided and unfortunately there is no refunds as stated under general Provisions under this Contract which I already submitted a copy of that statement signed by [redacted] in My Previous response Going back to Club Membership contract if [redacted] Provides the club in writing how she cannot used at least 1/of the club in a document signed by a certified Physician along with Club's key, we are happy to cancel year membership Contract to the club [redacted] is welcome to come in and submit required documentation if she now wishes to cancel club membershipAs far as Nutritional Services those are not refundable as it was already explain to consumerThanks

Hi, Unfortunately situations like this happens from time to time because of the nature of the business Following a strict nutritional and exercise program in not for everyone, and from time to time we get a client like [redacted] who realizes almost a month and one half in to the program that they cannot follow a program This is why we have a contract in place that clients sign, which explains how it is clients sole responsibility to contact their own personal physician before starting a Nutritional/ Training program like this and made aware that all my time and effort into creating this program after the start of the program date is non refundable I am attaching a picture of paragraph on contract that explains how program is non refundable after start date which was 4/17/in this case and signed by [redacted] Thank you

I am rejecting this response because:I had only done the program for week and, I can follow a nutritional and exercise program I had received only body measurements (initial ones), photos, and I didn't get my first nutritional program until 4/ I had prepped my meals and done everything that was asked of me on 4/ I was ready to do it Portraying myself as someone who is "choosing" not to follow the program is inaccurate On 4/I was taken by ambulance to Kadlec Regional Medical Center I had an MRI done and it showed a herniated disk between Land L I am under the supervision of a chiropractor, acupuncturist, Physical Therapist, and my Primary Doctor ALL of them told me not to weight lift I am happy to provide documentation showing that I was taken to the ER and based on the contract and that day, you will see that it was barely over week Stopping the program was not a "choice" It was something I had to do because I herniated a disk in my back I herniated the disk on 4/22/ According to the contract I was supposed to get months of nutritional counseling and eating programs along with working out 4x a week I contacted Valentino R*** and he stated, "I gave you all the nutritional counseling you needed the first day You paid the $1,for my knowledge" I feel that is deceptive and that was not what I had signed up for

I realize you took the time to create a meal plan and take measurements and pictures of me, and you should certainly retain compensation for that work. I figure the meal plans are worth $133 each, as there are three in 12 weeks, and I think $50 seems reasonable for the assessment.  I gave you a check for $650 ($400 for the food plan and $250 for the workout plan, which we postponed until October). I would therefore like a refund of $467 ($650 - $183).
 
Please let me know whether you’d rather have me come pick that up from you at the gym or you’d rather mail it to me. I think you have my mailing address on file, but if you need it, just let me know.
