From: ***Date: Tue, Jun 20, at 12:PMSubject: UPDATE: Complaint ID: ***To: geninquiries@upstatenyRevdex.com.orgUPDATE...UPDATE...UPDATE....THE company AUL has agreed to finally honor the warranty contractThey almost denied it due to the oil changes done by ed s*** in
jamestown nyEd s*** has me in an advantage program through them for maintenance on my carI do all my oil changes when they tell me that I need them, I do all my regular maintenance as they see fitNow the AUL company is saying that ed s*** is not doing the oil changes as they requireEd s*** does all my oil changes when they say I need them, by the milesEvery milesThe problem is that it takes me months sometimes to get that mileageI dont drive the car far, scared of the safety or breaking down so I stay with in town driving onlyso because I followed what ed s*** was telling me to do, I ALMOST got my car claim deniedNow I know because AUL told me themselves as of todays date, 6/20/not to follow ed s*** anymore, to do my oil every months or every 4,miles, whichever comes firstThat way my future claims wont be deniedThis is ridiculous though, not only did Ed s*** sell me something that has had safety concerns and mechanical problems, they sold me a warranty full of misleading info, they also didn’t tell me that their standards were diff from the contractThe owners refuse to call back or are all of a sudden out of the country, the jamestown store is very rude and in my opinion they do not care about the safety of anyone that buys the carsOnce they are paid, that's allIts just not right that big corporations can take advantage of people because they have high paid lawyers or they just don’t care

[To assist us in bringing this matter to a close, we would like to know your view on the matter.]The response actually points out that the issue with the vehicle could. under normal circumstances, happen as quickly as it did. This was exactly my point and yet they are unwilling to accept any fault. Also, more issues have arisen since the filing of the original complaint.First, in order to have a working vehicle, we were forced to fix the catalytic converter and had to pay them to get it done. We were unable to pay at the whole bill and were told they would arrange a 12 month interest free account with Synchrony Bank for financing. Today we received the card and paperwork from Synchrony and it is only 6 months interest free.Second upon picking up the vehicle, there were we notice it was rattling and there was a definite thump whenever we hit a bump. We brought the vehicle to another deal in the Shults Group. This one in Bradford. Originally they said that they had left a mess in there, but once they talked to the Kia dealership they would not say anything more. We now have the vehicle at an independent shop and he is in the process of detailing the many issues caused by our 'service'.

update: Yes my car is still under warranty, but they told me that I was misinformed about what type of extended warranty I bought. They told me that I bought drive tran and not bumper to bumper.I asked for a warranty that included everything but again was misled.  Also, monday, 6/19/2017, another problem with the vehicle, the water pump went and the serpetine belt. The water pump is covered under warranty that I bought but the belt is not, however I am having a hard time getting approval for the water pump. I bought the extended warranty through ed s[redacted], but they said that they only collect the money but they buy the warranties elsewhere. They gave me to 5 different people yesterday before I could even get a number to the warranty company itself, AUL. AUL informed me that ed s[redacted] has not sent them the proper paper work, ed s[redacted] says they did, so its another waiting game for me. I do not know if they will cover my water pump or not, or if its more money out of pocket. The manager stated that if they get approval then I would just have to pay for the belt and the deductible. I have never had this many issues with any company before, I have left messages with the owner and manager chad who have not returned my calls. When I tried to speak to the other owner of the other store I was told he was out of the country. I had multiple issues with this car and alot a bad accident due to failure of the vehicle. I always have to pay out of pocket because they say the warranty dont cover that. but this time I read the contract and saw that the water pump was covered but I have been waiting 2 days now for an answer. It should be easy, its in my contract that its covered, so they should cover it. But instead AUL is having us jump through hoops. The manager at ed s[redacted] in warren pennsylavnia has been the ONLY helpful person. The jamestown ny store just transfers me, or takes a message, or keeps telling me they cant help me. So again, its sad that a company treats the clients so poorly but once they make that sale, its like they dont care about you or your safety anymore. again, THE ONY PERSON who has helped me and been decent in thos whole situation is mike who isnt even from the store I bought it from. He is from another store but atleast he has tried to help me the best he can but now its another waiting game from the warranty company, AUL.

Hello, we have sent a check overnight to cover the customers additional expenses.  Thank you for the notification!

To whom it may concern;Ms. [redacted] and her boyfriend authorized motor tear down after a representative from their warranty company inspected the vehicle for a minor engine noise.  Once the motor was disassembled the warranty company again inspected the disassembled motor for internal failure....

Unfortunately no cause of failure was discovered, and the extended warranty company declined the claim. The noise the motor makes is inherent to the vehicle. As a good will gesture to Ms. [redacted] we have waived the rental car charges in the amount of $650 and have established a payment plan to cover re-assembly of the motor and get the vehicle back it Ms. [redacted].  The vehicle has been reassembled, inspected, and redelivered to the customer and we are confident that we have done everything in our power to satisfy Ms. [redacted] and cover our obligation under her no-charge Certified Pre-Owned warranty. However, Ms. [redacted] is welcome to take her vehicle to ANY other Hyundai dealer under her warranty policy if she feels there is still an issue with her vehicle..SincerelyEd S[redacted] IIIGeneral Manager

Refund check has been sent to [redacted] and the customer has bent sent a copy. [redacted]

To whom it may concern; After reviewing the [redacted] complaint, We have determined that the engine replacement and the catalytic converter replacement were in no way related. The engine replacement was deemed necessary by Kia due to a noise, not due to running rich or any other abnormality that would...

cause the converters to fail.  The vehicle in question had 112,763 miles and catalytic converters by design take quite a while to fail, making these repairs unfortunate, but unrelated.  In discussing the complaint with my Service Manager, I am told that the [redacted] have picked up their vehicle and paid the invoice.  Unfortunately, Kia Motor America and Kia of Jamestown cannot assist in covering this repair.Best regards,Kia of Jamestown

To whom it may concern; Please find the attached documentation regarding [redacted] purchase of a 2011 Dodge Nitro with 84,149 miles on 2/8/15.  I have reviewed the file and our paperwork is in order.  Please note that this case should be closed for the following reasons:-The vehicle was purchased pre-owned from us almost 2 1/2 years ago.  It had a NYS Lemon Law warranty and [redacted] purchased an AUL extended service plan, attached.- Other than normal maintenance, the vehicle has only been to our facilities three times for service indicated by the customers complaints.  Repair orders are attached.-On the first service appointment on 06/02/16, with 95,747, the technician rode with the customer for 10 miles and could not duplicate the complaint.  No lights appeared, shifted correctly, etc.  See attached.-On 06/14/16, with 96,014 miles, the vehicle returned to our store for an overheating problem.  We sublet the vehicle to our Dodge store in Warren, PA as they are equipped to work on the Dodge product line. The cooling fans were not running at that time and the fan and connector were replaced.  These items were not covered under the AUL power train warranty, however Ed S[redacted] Ford Lincoln covered [redacted]'s Diagnosis fee of $100 in the spirit of goodwill.-A year later, on 06/19/17, the vehicle again exhibited the "lightning bolt" on the dash, which is a check engine light.  At this time the vehicle had 103,462 miles.  The water pump was leaking as can happen with high mileage vehicles.  The AUL Service Contract covered this unrelated repair and [redacted] was only responsible for her deductible and additional service completed at that time.At this time, all of the repairs that we have been contractually obligated to perform have been completed including goodwill adjustments.  Jayson A[redacted], Used Vehicle Manager, has even offered to trade [redacted] out of this vehicle and into something with lower miles.  We are not able to offer a refund on a vehicle that has been driven for 2 1/2 years and 20,000 miles.  However, we are willing to work with [redacted] on a fair trade into something more reliable.Sincerely, Ed S[redacted] III[redacted]
