On May 8th of this year. The client in question signed a 3-page purchase agreement for Power Drop machines. These machines were set to be built and sent to the client within a 90-day manufacturing window as stated in the agreement and discussed prior to the purchase. When the
funds were received (via American Express) and cleared, the production of the machines started. We appropriate the funds to several different vendors immediately as they are all custom products and services that are ordered and take some time. Along with this, our management team met with and negotiated on the client’s behalf, a top tier shopping center for the clients machines to be installed at. This was all part of the purchase agreement and our duties that we were obligated to execute on days after the purchase, the client emailed our team and demanded to cancel the purchase and refund immediately. Within minutes, our team cordially responded and asked the reason why as we had no prior awareness of this change of heart. It was not until after we stated that we could not issue a refund immediately that we were met with a tremendous amount of threats and hostility. During this dialogue we, acting good faith, offered the client options. The most prevailing being us finding a buyer in the clients’ region to take over the negotiated location as it would be highly detrimental for us as a company to sour a relationship with such a big property company by backing out of an agreement. This option would allow the client to be relieved of their purchase. However, we were only met with a continued unwillingness to work with us. Since then, the client informed their merchant (American Express) and were issued a refund. However, this dispute is under review with American Express as we have provided the proper signed agreements and dialogue that the client failed to inform the merchant about. We in no way feel that we have done anything wrong. We are a small business that appropriates the funds given to us to create custom machinesAlthough we would love to get someone out of something that they do not want to be part of, we simply cannot do this immediately. If the client would have cooperated with us in the slightest way, this would have been a completely different outcome. Please see the attached dialogue and purchase agreement for reference or our willingness and goodwill The client continues speak ill worded about the product inside of the machines. However, the product inside is a partner of ours Powrtabs.com. They are an established company whose chargers are located within airports, casinos, and other outlets throughout the nation. They were even featured in Forbes this past December. The chargers work very well and millions of people have enjoyed them in the over the past years. If there are faulty chargers, we will replace them immediatelyLastly, the client uses the words scam when referring to myself and my company. We are upstanding citizens of our communities and provide amazing machines that are located around the countryWe have not done anything that would merit this language and feel that this in its own way is damaging.
