You will see attached, both a copy of the membership agreement Mr [redacted] signed agreeing to the terms and conditions of the membership.On his agreement, under Membership Prviliges, Notices, Disclosures & Agreements you will see bolded the terms: Under the bolded section naming DEFAULT AND LATE PAYMENTS midway in the page on the right hand side it clearly discloses that: "Should you default on any payment obligation as called for in this agreement, the club will have the right to declare the entire remaining balance due and payable and you agree to pay allowable interest, and all costs of collection, including but not limited to collection agency fees, court costs, and attorney fees A default occurs when any payment due under this agreement is more than ten days lateSHOULD ANY MONTHLY PAYMENT BECOME MORE THAN TEN DAYS PAST DUE, YOU WILL BE CHARGED A LATE FEE AN ADDITIONAL SERVICE FEE WILL BE CHARGED FOR ANY CHECK, DRAFT, CREDIT CARD OR ORDER RETURNED FOR INSUFFICIENT FUNDS OR ANY OTHER REASON." Mr [redacted] is disputing that he owes this amount calling the fees usury But as can plainly be seen by language of the agreement he signed, Mr [redacted] agreed to said terms and conditions of the agreement disclosing the service fee for insufficient funds As an aside, Mr***, when he enrolled did not pay first and last month dues which is normally customary And if you read on page two of his agreement, under the heading of CANCELLATION PROCEDURES, it states that "Member must deliver written notice to Powerhouse Gym in accordance with previsions regarding notices set forth under miscellaneous." "(provided, that any such notice of cancellation that is not received by Powerhouse Gym at least days prior to such next monthly dues payment date shall be effective on next succeeding monthly dues payment date.)" We did not require Mr [redacted] to give us days notice, we cancelled his membership immediately He neither expressed displeasure to our billing and accounts supervisor [redacted] as can be seen by accompanying email, and I authorized her to waive the final month billing requirement As such, I believed we acted both in good faith, to resolve the situation that is equitably fair to both parties The late fee he was assessed is $19.00, and is less than the $he was obligated to pay us per his signed agreement I am sorry that he feels that we treated him inequitably Sincerely, [redacted] ***General ManagerPowerhouse Gym Aiea

The member came in today, paid the cancellation fee to cancel her account, and it was promptly cancelled. At no time, was she in collections. She agreed to a month non renewable term agreement, she completed of months of the month agreement.

[redacted] originally signed up in 2010, with her husband [redacted]. At the time she signed up, the gym was owned by [redacted]. In February 2011, it was purchased by [redacted], our current owner.
We have a copy...

of her signed agreement. Also, of her husband. I can forward over to Revdex.com, both the notes of the billing company we previously used, as well as the copies of the agreements for both parties. She was scheduled to see [redacted]. She understood that he worked from 9 am to 7 pm. She called after [redacted] had left. As a side note, her husband, [redacted], put her membership on freeze 10/19/2010, for six months. She enrolled on 08/31/2010. If she had not enrolled, why would her husband put her membership on freeze. 22 phone calls were made to her contact phone number. It wasn't until 2012, where her phone was no longer able to receive voice mails, where we not able to contact her. Prior to that, she was receiving voice mails from the gym. There is no record of her cancelling her membership. She was on a month to month membership, and could have cancelled at anytime, if she had given us a one month notice.

I took care of this account just now here at [redacted], I paid eventhough it wasnt my signature. It was my husband who signed the contract. He signed my name. All I want is that Powerhouse gym should not let spouses or partners sign unless it is the real person signing. It wasnt my signature or my initials. I paid because my husband gave me the money to pay for it because it shows his penmanship in my signature.

I did not assumed that my two sons membership were cancelled when I cancelled mine. Reading the complaints I saw in this website, they are really not conscientious when it comes to proper handling of cancellation notices.
