We received a defective product from Poythress Construction. The company is unwilling to work with us towards resolution.Poythress construction built the shell of our condominium complex and also built out the interior of our specific unit. We took occupancy of our unit in 2006. We recently learned from [redacted] that the meter associated with our unit was originally wired incorrectly by Poythress and must be reworked. Again, this wiring is exactly as it was the day we took occupancy --- as proven by the electric bills that have been a consistent, yet according to [redacted] incorrect, amount since 2006. We called Poythress, who met with us, their electrician, and [redacted] Subsequently, Poythress submitted us a proposal - $4000 dollars to correct the mistake. We ask that Poythress stand behind their work and correct the defective product, rather than passing the problem to us, the customer. We have already paid for this service and this product. We believed we received a certain product in 2006 and are upset and distressed that this was not the case. In fact, after a single call and a single meeting, Poythress has moved to threatening to invoice us if we continue to involve them and take up their time. Poythress' Vice President, [redacted] sent the following email:"As discussed, I spent my time meeting with you and coordinating with both [redacted] and an electrician. I do not have plans to invoice your firm unless you continue to pursue this issue. I feel that we have gone above and beyond to assist you with your problem with [redacted]The builder is entirely unwilling to take any ownership regarding the issue; this problem existed at the time of construction -- prior to the date of discovery and long before expiration of warranty. We appreciate any help and support the Revdex.com can give us. Desired SettlementWe would like Poythress to replace the defective wiring and to provide us with the product we paid for.Business Response Revdex.com Complaint Department;In reference to your Case# [redacted] (Ref#XX-XXXXXXX-XXXXXXXX-X-XXX) the facts include the following:1. The company name is Poythress Commercial Contractors, not Poythress Construction. Poythress Commercial's Vice President is [redacted], not [redacted]2. On January 17th, 2014, we were contacted by Ms. [redacted] with [redacted] regarding an issue that they had with their electrical service.3. I responded and met with [redacted] Ms. [redacted] the same day. Upon further investigation, it was apparent that [redacted] contacted [redacted] regarding their electric bill. Apparently, the meter was not reading properly and [redacted] requested that their service be corrected to allow for the meter to read properly.4. On January 22nd, 2014, I provided an estimate for the work which I received from a licensed electrician. At this time, we did not mark up the quote or charge for any services including my time to evaluate the problem. We wanted to assist with their issue so that they would not have any issues with [redacted]5. Upon receipt of the estimate, they asked that we provide the work and pay for the work. At that time, I indicated that we were not liable or responsible for the work but that we would be more than willing to coordinate the work with the [redacted] and [redacted] Company at no cost to [redacted] 6. The building was completed on 8/18/06 (see attached certificate of occupancy), 7 1/2 years ago. In order to obtain the attached CO, the building had to be installed by a licensed electrician, inspected by the [redacted] and inspected by the power company so the meter could be set. 7. Since we did not provide this work for free, [redacted] threatened a lawsuit against our company. At that time, I gave them our attorney's contact information and I let them know that if the issue was not dropped then we would be charging for my time to provide consulting services. The charge for consultation services referenced in the complaint occurred only after their threat against our company.8. Shortly thereafter, [redacted] contacted the Revdex.com.In summary, we were not contacted in a 7 1/2 year period of any potential issues. We have no proof that there were not any changes to the building and the work is well beyond the statute of limitations. The work, when installed, was installed in accordance with all applicable codes. The proof is shown with the attached certificate of occupancy. If in fact they are claiming what they are claiming, then the electrical costs over the last 7 1/2 years should only have been a minimum meter charge per month and not a monthly usage charge. But as Mr. [redacted] suggests in his complaint response, we have irrefutable proof that the problem existed in 2006, at the time we took occupancy. See his comment below:"If in fact they are claiming what they are claiming, then the electrical costs over the last 7 1/2 years should only have been a minimum meter charge per month and not a monthly usage charge."This is exactly the situation; we have been receiving a minimum meter charge only since the date of occupancy. The simple fact is that we did not receive the product we paid for in 2006 and Poythress Commercial Contractors refuses to take any real ownership of the problem. Meanwhile, we potentially face a large retroactive charge from [redacted] and have had to endure the expense of nearly $4000 to correct the problem. We are thankful that the issue is not worse - the electrical wiring, as it was, was likely lethal to any worker as the interlock system did not work properly with the backwards wiring. Since we had to quickly correct the problem, for both reasons of safety and to continue to receive power to our unit, we can now no longer ask for the remedy that Poythress do so. Instead, we now ask them to take financial responsibility for the expense of the repair.Final Business Response Our company is extremely proactive regarding warranty issues. The building was built 7 1/2 years ago and the work was installed in accordance with the NC State Building Code and accepted by both the [redacted] of [redacted] and [redacted] If this was truly an issue, then we should have been notified within the proper time frame. We are in no way responsible both legally or ethically.We are a well-respected contractor, therefore, I will not continue to go back and forth to try and justify our position.
