In regards to Ms***'s complaint our office has investigated the matter and found the following informationThe original contract for Ms***'s account was charged off with a balance of $on July 22, Pursuant to the
terms and conditions on page item 10-1, the contract interest rate is 22.90%The total amount owed currently is $638.43, this includes the following;
o Principle Amount- $
o Interest Amount- $
o Total Amount Paid - $
o Total Amount Owed - $
The statute of limitations in the state of Colorado is years pursuant to Colorado Code CRS 13-80-103.5(1)(B)(XXXX)A payment was made by Ms*** on May 14, in the amount of $reinstating the statue of limitations until May 14, If payment had not been made by Ms*** the statue of limitations would have been July 22, Our office has received a dispute letter from Ms*** and we have attached a copy of the validation letter to this complaint which has been mailed today July 23, Our office is willing to settle the account in question for Ms*** if she would like to enter into an arrangementMs*** may contact me directly at XXX-XXX-XXXX ext
Initial Consumer Rebuttal /* (3000, 15, 2015/07/24) */
(The consumer indicated he/she DID NOT accept the response from the business.)
Thank you for the clarification on the amountsThis business gave me fraudulent informationI called Precise on July 15, in response to a collections call I had received on that same day and asked for a managerI was transferred to a Mr*** I was told more than once that the call was being recordedPlease listen to the call from my phone number at 1:pm, 7/15/I was told that the amount owed was over $and that over $of that amount was interestPrecise is now saying that the total amount owed is $and that the interest is $That is a big discrepancyThe amount of interest an agency is allowed to collect on a debt is calculated by the date the debt was purchasedThe balance on this account according to my credit card report dated 6/6/was $as of 4/10/2010, after the payment of $At this time the debt was owned by a different companyIf you purchased the debt in (which I am sure you didnt) The interest on the balance of $would be around $You are charging interest on the original amount, not the amount that was owed on the account at the time of purchaseWhen was the debt purchased? Why was I told I owed over $in interest? I have attached a clip of my credit report that shows the account in question
Final Business Response /* (4000, 17, 2015/07/27) */
Our representative made a bona-fide error when telling you the balanceOccasionally our system does not calculate the interest correctly and it needs to be done manually, this does not happen often however we do apologize for this error
The interest accrues based of the charge off date and the last payment date; it has nothing to do with the date of purchaseIn this case, the account was accruing interest at the rate 22.90% per annumThe interest rate was calculated on the amount of $which was the original amount charged offUpon receipt of payment of $on May 14, 2010, the interest was adjusted to the last payment dateThe calculations we use or demonstrated below;
Charge off date - 07/22/
Charge off amount - $
Interest rate - 22.90%
o Interest accrued from charge off to last payment date- $
o Interest accrued from last payment date to 07/23/- $
o Total interest on account $+ Total Principle amount $= $
o Balance $- Payments $= Remaining balance as of 07/23/$
Our agency reports to the *** Credit Consumer Agency, in our guidelines and instructions we are to report the Highest Credit Limit/Original Loan AmountPursuant to their guidelines we are only able to report the charged off amount on your credit reportPlease keep in mind that pursuant to the contract terms and conditions for *** ***'s *** the interest rate will continue to accrue at 22.90%
Our office would be more than happy to assist you in setting up payment arrangements on the account in question, in some cases we can even agree to freeze the interest on the account so you are only paying on a set balancePlease contact us with further questions

Furthermore, the judgment itself isn't even near the "$past due" you are reporting on my creditSome interest HAS accrued, additionally they have collected quite a bit on it (about $500), but at no time has it ever reached $This is extraordinarily fraudulent business you are conductingI expect an expeditious reply from you and immediate removal of the 10/report you made to my credit

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted]. I don't know where they supposedly sent the original mail to but it didn't come to me. Having said that, I hopefully will now be able to dispute this debt and get the matter resolved.
Sincerely,
[redacted]

(The consumer indicated he/she DID NOT accept the response from the business.)
Then this is a duplicate account on my credit report. I have a judgment from [redacted] in the same amount that a different agency (you, Precise financial) are reporting on my credit at this time. (Please see attached image). So you are double-dipping, and double-damaging my credit. So if you are not involved, and you do not have this file, you need to immediately remove your reporting from my credit file. It is illegal to report it as both a judgment, a collections account, AND an account not paid on (as if it were still an open, revolving credit account). That means 3 items on my credit report instead of just one. And it came as reported from you on 10/2015 (again, see image), so if you have not had any interest in this debt since 2012, why are you reporting it in October 2015? So what exactly is your connection to [redacted], are you one and the same? Notice [redacted] represents their name to be [redacted] on the judgment from the court. What you people are doing is wrong and illegal, and I have attorneys who are prepared to involve themselves in this. This is a huge violation of the fair credit act. I expect an immediate response, and immediate removal or your item from my credit if it no longer your account and is now otherwise reported as a judgment on my credit (which it is). (Duplicate account.png)

Our office has moved the account in question into a Cease and Desist status to halt further collection calls.  Additionally a verification of debt letter along with the original charge off statement will be mailed to the address you requested.   All information on how to dispute a debt was...

provided in our original letter of notification. We will also include it in our verification letter.

The account in question was placed with [redacted].back in 2012. If you wish to settle or dispute your account you will need to contact them directly. Please let us know if you are unable to reach them, or if you have further questions.

Ms. [redacted] does have a delinquent account with our office.  This debt originated in 2008 and has accrued interest since then.  Ms. [redacted] made a couple of small payments in 2014, then refused to make any further payments.  The original debt in 2008 was $454.11.  In 2016, on...

March 7th I spoke with Ms. [redacted] and she was offered a settlement of $415.00 to which she agreed.  She made a $207.50 payment, and was to pay the other half the following month.  She never made that payment.  We called several times and left messages but the outstanding balance was never resolved.  This means the debt continued to accrue interest.  Over the last several months we have only been able to reach Ms. [redacted] a few times.  She either tells us she is disputing the debt or says she will try to take care of it, but since the payment in 2016, nothing has been done to resolve the account.  The settlement offered back then is no longer valid.  This is a valid debt, and as far as our records show has not been resolved.  If Ms. [redacted] will contact this office at 888-314-3633 we would be happy to try to resolve this issue with her.

Our office has pulled all outgoing calls to the number listed on **. [redacted]'s file, there have been no phone calls since July 28, 2015.  The account will remain in a Cease and Desist status with no further contact.  Our office was able to pull a detailed payment history on the file showing that **. [redacted] had previously been paying on this account.  We have attached a copy of the payment history as well as the account notes to show that no phone calls have been placed.

On May 15, 2017, we received a call from [redacted].  He stated that he had received our letter, and that this account that had been placed with us for collection was fraud.  He told one of our agents that he had this happen with another payday loan around the same time that this loan...

was taken out and that he had a police report he filed at that time.  He said he would send that police report into our office, and we advised we would put the account in dispute and contact our client who owns this account to get whatever documentation they could provide us.  It is possible that [redacted] may have to file another report with the local police as only he will be able to do that.We are a full service collection agency and our clients place thousands of accounts with us for collection.  The clients maintain the documentation, or have to request it when needed, which is what we did on this account.  In order for us to close an account as fraud, we do our due diligence by obtaining any documentation that the consumer has showing where they filed a police report claiming fraudulent activity with their personal identification, and obtaining the validation documents from the client who placed the account with us for collection to show what was provided when the account was activated.  The account for [redacted] is currently in dispute.  We are waiting for the documents from our client, and once received will provide those to [redacted] and determine how to proceed at that point.  We hope to have those documents in a few days.  We are very diligent about working with both the consumer and our clients to resolve issues like this, and will work hard to resolve this issue as well.  If it is determined that this is fraud, the account will be closed for the consumer.

Complaint: [redacted]
I am rejecting this response because:i have a letter sent by the company which I received January 31, 2016. I also have recorded phone calls and emails from this company's employees after the date listed in their response. In this current response Precise Financial has my name completely WRONG. I feel as though one thing is said and another thing is done. I would like my name deleted from their records so that I quit receiving correspondence from them.
Sincerely,
[redacted]

Complaint: [redacted]
I am rejecting this response because: I have received documents from the parent company responsible for this fraud, [redacted], that exonerates me and agrees that I was not responsible. Whether or not Precise agrees with this is immaterial.  The action has been taken.
Sincerely,
