We have a signed contract to which we paid the amount agreed to but did not receive delivery of the shed and did not receive the refund agreed to
Contract was entered into for build onsite one (1) shed as per plans and schedules provided by *** on June 25, 2016. We paid full amount of the contract value on June 26, 2016 as acknowledged by Defendant in email dated same day. Delivery was to be scheduled for the summer of 2016 with deadline of end of August, but nothing was done and the deadline extended by mutual agreement until October 31st 2016 whereby Defendant agreed to either have the shed delivered and built onsite by that date or to refund the money in full (refer to email dated Oct 6, 2016). Subsequent to missing the Oct 31, 2016 deadline, several emails were exchanged trying to secure refund of the money owed without success with final email confirming debt owed dated Oct 2nd, 2017.
Subsequent to our difficulties with securing repayment of funds provided to Precise Pre-fab, we completed a more thorough search of the person, company and company details on the Canadian Revdex.com Website and while Precise Pre-Fab does not have a record of problems with current clients, another business in the same jurisdiction by the name of Precision Pre-Fab listing the same employees and using the same contact cell phone was reported many times as not complying with delivery of product and/or refund of money provided to them.
We ordered a shed, signed a contract, paid for the shed and have never had the shed delivered.
My husband and I live on an acreage in central Alberta. Due to the decrease in economy and escalation of theft we made a decision to increase the security at our home. We decided to get a pre-fab shed built to store/lock up equipment that is in the yard. We did our due diligence, got quotes and met with about 3 different vendors. We decided to go with Precision Pre-Fabs which is now Precise Pre-Fabs. In March we ordered the building from Barry *** and met with him a few
times to finalize the building. The agreement was that he would complete the building in 8 weeks.(7 weeks to get supplies ordered, 1 week to build) We were thrilled with this. We also needed the shed delivered and that was part of the 8 week commitment. (delivery date end of May 2016) The contract also stated that we had to pay full purchase price prior to them even ordering the supplies. We were not really comfortable with that and
tried to only do a % or half the amount but Barry said that he can't take the chance ordering all the materials and siding specific to a customer's needs and get stuck with it if they back out. We understood this and were 100% committed to buying this building that we agreed and paid in full, again with the promise that it was an 8 week commitment from them. March 22, 2016 @ 6:42pm we received confirmation of our payment to Barry for the purchase price of $13,039.95.
Weeks, months and now a year and a half has gone by and we still do not have our building. We started contacting Barry at the 8 week mark (June 5th 2016) and got excuses that the wrong siding had been ordered and thus he had to
reorder it. Again, we understood that mistakes happen and waited patiently for our building. The 12 week mark came and went and we contacted him again and then the excuse was in-climate weather. As it was such a large building he had to build it outdoors. (he builds them outdoors regularly as we saw many when we met with him) We were growing impatient now but he had our money so we said ok, we will wait. In early September 2016 we spoke with him again and asked for our money back. He promised us at that time he would get it done in the next 2 weeks and deliver it. He also promised to send us build progress over the next weeks with pictures for our file. 4 weeks later we contacted him again, still no shed and no progress updates/pictures. On October 19th 2016 we talked to him again and he begged for and promised it would be complete in 10 days.
We agreed to give him to the end of Oct and if it wasn't done then he agreed to give us our money back.
The end of October came and went, Barry made no contact with us so we then sent him our bank
information to receive a return of our money in hopes that he would just make it right at this point. He did not. He said he has already incurred costs and would have to sell the building (which has never been built) to recoup their costs and be able to refund the money. He proposed a repayment schedule that he said he
would send to us by the end of the week or that they are still willing to provide delivery upon
completion of the construction. We have never received a schedule of repayment OR our building. It is now November 2017. We try calling every other day and receive no answer or return calls after leaving messages.
