Thank you for the allowing me the chance to respond to the accusations made by Mr*** against my Company for work completed to his shower
I was first informed of this dispute with Mr*** when we received a check in the amount of $and a hand written letter from Mr*** for
payment in full for an invoice in the amount of $(copy of letter enclosed)
In this letter Mr*** informed us of his reasoning for the payment he sentHe states the drain and water supply lines are miss measured and unusable and that he has hired another plumbing company to make the repairalso since an estimate was never given, his attorney informed him he is only liable to pay for the material used
G&M Plumbing and Heating has been in business since and consider it very important to leave any customer satisfied with the work we performIf this rouwas installed incorrectly it would have been fixed at no charge to the customerThis is company policy, for any customer, at any timeI asked my two employees, Chris my service manager and Don, my service technician if they could inform me about Mr***'s job and allegationsAfter speaking with both my employees I sent Mr*** a letter explaining our policy and disputing his claimsI offered to settle this mater if he would contact me at our office
A few days later Mr*** contacted me by phone at our office and proceeded to make numerous claims against my company and stated that my service manager Chris "Blew it"Trying to find out exactly what happened, we discussed his recollection of the job and statements on the letter he had previously sentMR*** referenced conversations over the phone and through test messages, which he previously had with Don my service technicianMany of these claims were not relevant to the work performed on his shower
Once I finished my phone conversation with Mr***, I questioned my employees again about the jobChris, my service manager reassured me that he had only spoken with Mr*** once, where he was informed that the roudimensions were off for the shower and another plumbing company had already been hired to correct itChris informed Mr*** that he would contact Don to see what may have happened and told Mr*** if the shower was roughincorrectly G&M would come back and correct it at NO CHARGE to Mr***This offer was refusedChris proceeded with a call to Don after his conversation with Mr*** to see if we could still fix this issue and to prevent it from happening againDon also reassured me that an estimate was given verbally , face to face on the second day of work
Mr*** then tells me he is going to Contact Angie's list and report us to the Revdex.comI told him if he feels he should, than to do itI informed Mr*** that the Revdex.com would allow G&M to tell our side of the storyIf you take care of your customers you should not have to fear the Revdex.com
Enclosed are copies of the text messages sent to me from Mr*** between Don and himselfIf you look at these message it appears as if these two men were friends and I have a hard time believing all his accusations
Mr*** claims Chris would not look into the issue (Page 5) This strikes me as odd since he would not accept Chris's offer to make things right
Why did Mr*** let Don Come back and work a second day, provide material and finish the roufor the shower without an estimate?
According to Don, Mr*** ask him a number of times to do side work for Bob (the guy patching the concrete and drywall)
Mr*** mentions his attorney in the letter he sent with his payment, and again when I called him the first timeI told him that if he let Don work over days and was present, but says he doesn't have to pay because nothing was signed that is "unjust enrichment"
If you notice in his text and his letter he never complains about the hours billed or the amount of the bill
In my years of experience I have learned in this business that if there is a dispute between two parties the truth usually lies somewhere in the middleFinding the truth was always my main goal in this matter
In Summery:
G&M Plumbing and Heating Inchad Don work for part of days where he demoed a concrete floor and roughed in drain and water lines for the new shower
Don said he gave a verbal estimate of $- $to complete the job
Mr*** calls and claims roufor shower was 2" off
Chris offered to fix/repair anything that was incorrect(No payment had been made at this time)
Mr*** refuses all attempts to correct problem
We send a bill for the work we have completed to date
Mr*** sends payment for $for payment in full with note stating he has contacted his attorney, and does not have to pay any more since an estimate was never provided
Mr*** claims he paid D & L Plumbing for hours of work to move the shower valve and drain rough-in
Mr*** tried to threaten me with going to the Revdex.com and Angie's list
In my last conversation with Mr*** I debated the claims Mr*** had made, and tried to come to some kind of agreement on paymentI never disputed the text between Mr*** and DonI just pointed out to Mr*** that if you read his texts you can see discrepancies from one text to anotherEven with the discrepancies I offered to take a few hours from the bill so we could resolve this matter
Mr*** offers for me to come over to his house and have coffee with CREAM with himI have not had time to meet Mr*** due to June being my year end and my partners early retirement due to medical reasonsI am not willing to accept the $as payment in fullIf he wants to negotiate a settlement he can contact me at any timeWe offered to come out and correct the drain and water rough-ins if they were off but Mr*** refused
