building is a camp and is a seasonal home. Rebuttal: We left the project in agreement with Mrs. [redacted] that when she had funds available to complete the project we would return and complete the project. We also were in agreement that if she finished the rest we would amend the contract price to reflect work not performed by us. This was verbally done between Mrs. [redacted] Mr. [redacted] (officer of company/project manager) We had completed 85% of the project at time of leaving while receiving approx 31% of the amended contact price.I personally (Duane [redacted])  feel we have went above and beyond to try to get Mrs. [redacted] the right amount of monies from her insurance company to restore her camp.   I dispute Mrs. [redacted] right to a refund of any amount. We met with [redacted] and worked with her and her insurance adjuster to raise her insurance claim payout from under 20k to 37k.  [redacted] contracted us for work in the amount of 49600 (amended lower) .  During progress she was worried about the ability to pay for work performed. She stated she could do the smaller finish work (painting etc) herself.  We completed much more than the majority of the project.  There came a point in which her insurance claim was closed. We advised her in the process to contact the department of NYS DFS regarding how her insurance company was handling her claim this would have given her the ability to reopen and us to continue working with her insurance.  [redacted] was advised that we had performed much more work than payed out and since no ability for payment was present (by her own admission) that we would be stopping work until ability to pay was presented. At this time, [redacted] was agreeable and beginning to do work herself on the camp.Our records show she has only payed approx 15k of 49600 to date. see attached*

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below. There are many issues with the response that the Business provided. 1) Although the company states that the work was stopped due to financial reasons, I have called to address problems with the work that was performed and never received a response from them.  2) Part of the contract states that any messes would be cleaned up and they were paid for a dumpster the place was left in a mess and I was forced to clean up materials left scattered around the yard. The basement was left a mess that is going to be difficult to clean up as there is limited space and there are joists and insulation laying down there. The dumpster that was brought in was also used for another job site as there were items in there that did not come from our residence.  3) The reason that the funding was stopped from the insurance company was that the Business failed to send detailed invoices and proof of why the costs would be higher that then what the insurance company adjuster claimed. The insurance company stated that no funds would be issued until they received this. Both the insurance company and I advised them of this yet they would only provide a vague estimate of work. The insurance company stated that once this was received they would review and send out additional payments. Funding was stopped because they failed to submit the requested paperwork.  4) The business claims that 85% of the work was complete, yet I have no kitchen, the floor in the bathroom was never laid down and now because they failed to do the work properly, all the work that was done now has to be taken up and redone. They had laid hardwood flooring which I provided, and they floor is buckled as you can see in the pictures. Since it was installed incorrectly all that flooring is no good and needs to be removed so new flooring can be installed. They set the tub in the bathroom even though the floor was never laid down and they also broke a chunk of the tub at the bottom. This unit is a tub/shower unit that is not easy to move. They placed the furnace and on demand water heater in the utility closet but this was just placed on the subfloor so that all needs to come out so that the floor can be laid first. 5) The walls in my husbands and sons room separated from the outside wall so now I was advised that  will need to have an engineer come in and inspect the place to see if the joist work that was done is even safe. If this fails inspection then the entire framing will need to be redone.6) I have never received any type of proof or invoice of what they are claiming the money that they show was given to them was used for. There is no way that they earned the money that they received as I now have to pay someone to undo everything that they did.  6) If the Business had submitted the paperwork that the insurance company requested they would have received the funding that was needed to perform the job, so they are responsible for the work not being completed. Now they have received $15,000 and $12,000 was spent on materials that have to be replaced, and I still am unable to use my camp. I feel that I should be reimbursed what they received plus the cost of the materials that have  to be removed and replaced. Regards,  [redacted]photos included
