I have reviewed the response made by the business in reference to complaint ID# ***, and have determined that my complaint has NOT been resolved because:
[ The attached contract is not the contract that I signedThe contract signed by me looked very different and had only pages When I called in early December to cancel over the phone, I was never told to submit anything in writingThere was an accidental double charge charged to my bank account and the error was never reported to me until I contacted the organization seeing all the charges on my bank accountI do not know who this individual responding to the complain is, but the individual I was working with (*** ***) and his assistant was who told me about the accidental 2nd chargeSteven first admitted the mistake, then went back on his word and his story has been changing as this process has been going onHe even attempted to threaten me with an early termination fine of $claiming that my contract was for yearsAfter reviewing our contract, our attorney advised not to communicate with *** *** further as he is a liar and his threats have no legal base. letter. This merchant was boarded on to Preferred Merchant Services / First Data on 06/**/2013 to start accepting credit cards. Whenever a merchant signs an agreement with Preferred / First Data, they must sign the official agreement which includes the companies policies and billing procedures as well as card acceptance regulations which are set by the networks themselves. Attached is a copy of  the general agreement - please reference to section 19  which starts on page 25 to review the billing/collection practices.[redacted] is claiming that she was billed $257.99 without an explanation and in fact we have numerous records showing that these charges were explained to her. Every charge that the merchant is billed is followed by a "merchant statement" which is sent via mail with a description the of the charges. The charges are for having the merchant account open but not using it. There are minimum fees that incur to a merchant account if the account is not used. The merchant stated that they requested to cancel the account in December 2014. We have no such record of this cancellation request. We have advised the merchant numerous times that if they can provide proof of facsimile which dates to referenced date by the merchant - we would gladly issue a refund. We have been in operations for almost 5 years and never received a complaint regarding our service/billing practices. If [redacted] can provide proof of her cancellation request dated December 2014 with the transmission code we are still willing to issue the refund. Sincerely,[redacted]

Review: We were charged $257.99 without an explanation for the charge. They have refused to cooperate or communicate to resolve this issue. We were also threatened by the use of an illegitimate contract.Desired Settlement: To resolve the issue and replace the current management.
