Review: Preferred Settlement recently completed (8/18) a closing for the sale of my home. $200 was withheld for a final sewer/water/trash bill to Cranberry Township. Upon closing, waiting 1 week I contacted Cranberry Township and they indicated that they would never receive a payment from a settlement company in this case.

I attempted to contact the closing agent, no return call was ever made to me. I attempted to leave voicemail for 2 of the closing agents, however both of those voicemail boxes were not set up. There was no way to leave a voicemail. Weekly emails have gone ignored, not responded to, and otherwise radio silence.

A woman answered the phone one day and said she was able to help and indicated that the payment would not have gone to Cranberry Township, but, would've been returned directly to me. Our CORRECT mailing address was on all the closing paperwork and confirmed day of with Ms. M[redacted].

Upon further review with Cranberry Township, my final water/sewer/trash bill was direct debited from my checking and officially closed with a final bill. Thereby leading to the fact that $200.00 was withheld from me and I have no reason to believe based on the procedures so far that I will obtain it.Desired Settlement: I would like the $200.00 returned to me. It was paid on the settlement sheet. Cranberry Township doesn't want the money as there is no account to pay on it.

The $200.00 was paid by me and should be returned to me. Simply want someone to contact me with accurate information as to when I will receive it.

Response:

First, I would like to note that Preferred Settlement has a full-time receptionist and we are very reachable. Also, Mr. [redacted] did not indicate to whom he sent e-mails, so I cannot verify this information or respond to that complaint. I can say that we have 1300 closings in a year and no other complaints have been made about the escrows and the very few complaints we have were addressed immediately. Mr. [redacted] was told when the check was sent on September 12, 2016. Someone in my office also told him to give us a call if he did not receive it. Apparently, he did not receive it and called again on September 19th. We confirmed that the check had not been cashed, so we stopped payment on the check and sent another check. The entire process itself is not instant, since we have to call the water and sewer authorities to confirm that the accounts are paid in full and then the refund check has to be ordered from our corporate office. This is not an unreasonable amount of time given the need for the account to be finalized by Cranberry, the confirmation of payment by Cranberry and the ordering of the check from the corporate office. I suspect that this is what caused the concern on the part of Mr. [redacted]. It truly is not an unreasonable amount of time.Thank you -Sandra D[redacted], Esq
