We hired Premier to fix the floor in our dance studios. Premier came out and did shoddy work. The principal, ***, agreed to help fix the problems, but insisted on getting paid for the shoddy work. We foolishly paid him, and he ghosted us - not responding to texts, emails or phone calls. We had to hire a different contractor to undo his work, and redo the work with competence. We also had to purchase all new materials as Premier destroyed the flooring in the process of doing their work.

To whom it may concern,

First and foremost, Premier Commercial Floors did the vinyl installation at Balance Dance studio with no warranty. The reason for no warranty was because we advised *** (the owner) that the sub flooring had already failed and needed to be replaced. She then went on saying she didn’t have the funds to do so and she wanted patch the bad areas until she can generate more business to replace the floor. The areas that needed to replace had screw heads penetrating thru the vinyl flooring from the previous contractor using the wrong screws. We demoed the old flooring and replaced the visible screw heads that was being ejected with decking screws per the manufacturer guidelines, and the vinyl flooring was re-installed. One week later Kathy informed us that there was screw heads coming thru the new flooring; we then went out and noticed it was the old screw head that was covered with old floor prep and adhesives was the problem and that we was responsible for the flooring issues. These issues occurred due to the unforeseen problems of a bad sub floor which do not fall under our warranty guidelines. If we did install the sub floor; we would then take full responsibility of this matter.

Furthermore, I take no responsibility for our installation as we did everything to manufacture guidelines instructed by EFS flooring. Our flooring was adhered properly, and the vinyl was damaged by a poorly installed sub floor done by others.

Lastly, the out of pocket expenses is based on the incompetent decision that the owners of Balance Dance studio made at the time when I urgently recommended the sub floor be replace before installing the vinyl flooring. Balance Dance Studio is looking for a fall person to replace their flooring. They don’t have the fund to redo the floor and this is one of the reasons I only charge them for the worked we performed. I never made any commitments to install flooring on a poorly failed sub floor and nor will I be responsible for the patch work we did due to the unforeseen conditions of the floors.

I am rejecting this response because:Please see response below, and photograph attached. Thanks!*** blames us for the “incompetent decision” of hiring him - that does not make any sense. *** holds himself out to be a flooring expert. If in fact a client is asking him to do something that is doomed to fail, *** needs to educate the client, or not do the work. That did not happen here. We hired him to (1) repair the subfloor, and then (2) install the vinyl on top of the subfloor. He messed up both parts of that job, and we were forced to hire someone else to redo his shoddy work completely. *** also claims we do not have any money to pay for the job, which also does not make sense, considering that we paid ***, and we also paid the other contractor to redo the shoddy work done by ***. The subfloor needed to be repaired, which is what *** was hired to do. Instead of repairing it, he incorrectly installed new flooring on top of the damaged subfloor. The damaged subfloor had approximately one-third of its screws installed as the wrong size (see photograph). Additionally, *** installed the wrong cuts of vinyl in the wrong studios - he installed the vinyl for Studio 5 in Studio 4, and vice versa, so the materials that had been specially cut to size for each studio was wasted. *** also promised to come back out and repair the damage, but instead went completely silent once his check cleared.

We stand by our original complaint. Premier Commercial Floors did a terrible job on this flooring project, that we had to completely redo by hiring someone else, who was able to competently perform the work.

At no given time were you there for any of the conversation I had with your wife when we were asked to perform the work. I was hire to patch vinyl and not to do a subfloor repair. We advised your wife that the subfloor needed to be replace and she refused to. I did my part as I replace the vinyl. We are not responsible for your floor failure; try going back to the person who initially installed your subfloor that failed.

Complaint: ***

I am rejecting this response because the vendor is being dishonest and not telling the truth. The vendor was incompetent and did shoddy work, which we had to get redone by someone else. The vendor also refused to return Kathy's phone calls or texts, and only responded to me when I let him know that I am an attorney and was considering taking legal action.
