[redacted] signed the contract on May 14, (I have the signed contract dated) I called the survey company the day she signed the contract I wouldn’t have called the survey company if I didn’t have a signed contract The survey company did me a favor and scheduled the survey right away I needed this to acquire the permit for building So I started work the first day I received a signed contract by scheduling the Survey I also completed all the drawings needed to acquire the permit that she saw and approved I received the survey on 5-23- days after she signed the contract on 5-29-Thursday she gave me the deposit of 10,which was not the agreed on amount of 30% she shorten the check by $1,the reason she gave me why it took so long to get the deposit was she had to move money around On 6-2-Monday I went in and got the permit for the agreed to location and final drawings of the garage The location of the garage was her decision I had to build within the rear 25’ set back and the side set back that is New Castle County zoning restrictions, so when she says my design that she approved was not wrong they met her parameters and zoning codes It was approved On 6-3-we moved rose bushes to the rear of the yard and the shed to her choice of the final location of the shed I told her that if there was not enough blocks to level it at that location We would have to purchase more After the move I informed her that additional blocks needed to be purchased We used 3” schedule PVC and metal pry bars and com-a-long chain prying from the bottom frame and we didn’t damage anythingWe laid out the location of the existing design She didn’t like how close it was in her trying to get the car in In my opinion it would have worked but she didn’t want it so she told me if she couldn’t move it back she would cancel the job I told her that there was a 25’ rear building set back and that I didn’t know if it was possible but I would try I made revisions to the drawings and went to try and get a revised permit at the new location On 6-6-I went back to the county and met with the zoning planner and got the approval to build inside of the 25’ rear set back only if I acquire a demolition permit and demolish the old shed in the rear yard and I would have to make up letters and deliver them to the neighbors connected to the property I had Beverly sign the letters and went in on the 6-18-to get the revised permit She approved all actions to this point During this time I had been in contact with all subcontractors and had met them out on site to review their contracts with them There was an issue of the electric which we still didn’t know if we had to bury the electric lines to her house We met with DP&L on site to review the project and finalize the method of feeding the main house which was an extra to the contract On 6-20-I contacted the excavator to have him come out to start the excavation There was rain in the forecast so he told me he would keep an eye on it and that we were the next one on his scheduleI informed her of the progressOn 6-26-14, weeks and day later after the contract was signed and all of these events, Miss [redacted] called the office when all of her communication was face to face or by cell and she leaves a message on the answer machine On Friday morning approx9:am the next door neighbor whom we have been working on her home decides to tell me with this really arrogant grin on her face that the garage was cancelled I immediately went next door to talk to miss [redacted] whom told me she left a message on Wed6-25-that she wanted to cancel the project but it was on 6/26/that she made the call and after asking her did I personally do something wrong or did my guys do something wrong she said no it wasn’t anything we did it was her she couldn’t deal with it right now I asked her is there anything I can do, Concrete anything she said NO I tried everything I could to resolve this but because she said it was nothing, there was nothing we could do Since then she lied to the police tried to press charges, telling them and that I took her money and ran and tried to have me locked up which the police said this was not a criminal matter She attacked me and my son when we were to doors up from her home working and for minutes yelled and screamed until the point we were going to leave and then she attacked my religion and my faith then I went up to aggressively and told her kindly, that what she just said was wrong she got even louder I tried to get her to calm down so I could talk to her, she refused and kept going and I turned around and walked awayNever coursing or raising my voice just trying to get her to calm down As far as her shed goes shes the one who stop work for no reason and at that point took responsibility for the shed She knew we were not finished Is her neighbor an expert on weight distribution and can determine something unsafe men after it was final set tried with all there might to move the shed to check for stability and guys could move it a MILLIMETER If there is anything wrong with the shed it’s on her She was in breach of the contract and there is no money being returned We feel that we did everything we could to resolve this with the client After she tried to have me locked up I stop any and all communication with the client We have spent a tremendous amount of time and money on this project as well as loss revenue due to the loss of this work during that scheduled time We had to struggle to try to find work that was allocated by this project and overhead expense as well There will be no money returned at this time [redacted]

To whom it may concern, This letter is in response to the letter complaint by the [redacted] Master Bath renovation We were called to look at a leak and damage to the bathroom floor and ceiling beneath the bath in the family roomWe found that the tile floor outside of the shower where the soaking tub, shower and floor Intersected was damaged We contracted to renovate the BathWhile prepping the floor to install new )i" tile backer board we put a level on the floor and the floor dropped nearly 1•1/2" over 4' We brought to the customers attention and said there is something seriously wrong with the construction of the 'floor and that we were very concerned about itWe show [redacted] and she took our level and said she saw the issue I told her that the builder did something wrong I told her that the entire bathroom wouJd have to be demoed and subfloor removed to see why the floor is so far out of level for a new house and she said she didn't want us to do any additional repairs After completing the project using an high quality products from Oino and Sons tile supplierThe same products we use and is used by many professionals in the trade for many yearsThe customer called us and said that the grout was cracked and was very aggressive toward us and said we did poor quality workAfter Inspecting the bathroom we found that there was cracks only In the inside cornersWe told her that it appears the floor joists must be flexing and causing cracking but this was a professional opinionWe made all repairs using a flexible high end grout caulkA month later she called againWe went back down and cut out the caulk we put in, ran dehumidifier and then made repairs the second time along with more inside comers Tile third time the home owner called we went down and found that the grout caulk had cracked and that all the repairs we had performed at each floor to wall connection crackedWe started to Investigate the construction of the home the homeowner showed us her basement where we found that the builder screwed up the foundation and had put a set of steps in the wrong place leading outside and had to remove it and repair the foundation along with other foundation repairs that was below the area of the Master bath also found that the builder put the floor joists on 24" centers instead of 16" centers and spanned the joists more than 26'I explained to the home owner that I have never in my Years' experience have I ever seen a builder build a house this wayThis will allow the floor to move drastically with a lot of deflection This would explain why the floor Is moving and the cracking Is occurring at the location in the bath and that if something is not done about this it will continue to crack the grout We told her that cracking grout in the master bath room Is not a CRAFTSMANSHIP ISSUE AND IS NOT COVERED BV OUR WARRANTY We still made the repairs anyway The fourth time it happened again we went down and spent men hours and cut out all the grout and caulk and re.caulked and grouted all inside comers with 100%silicone that matches the grout which is more flexible hoping it would be able to help and grout in aU seamsI informed her that until she corrects the flooring framing issue caused by the builders construction of the floors it is going to continueShe called a sm timeWe are no longer going to make any repairs to this bathroomWe have spent more than 4,fixing grout that has nothing to do with anything we did wrong and now she is trying to say that we used inferior products which Is not correct We Installed W' thick tile backer board and screwed it on 12..pattern, installed thin set and the tile, installed a quality grout and installed a grout enhancer that makes the grout bond better and keeps It from stainingAll products are of good quality and meets all manufactures recommendations for Installing their products They will continue to have issues until they correct the floor joists deflecting so muchWe have went over and beyond to try to help this clientShe has been very disrespectful to me and my partner as we tried to do everything we could to correct this issueWe are no longer going to do anything else on this projectWe are not going to reimburse any money to themAlso the ceiling In the living room was never corrected from the original leakIn fact I personally put a pencil mark around the stain to make sure that it never changed from the original stain prior to our involvement up until the last time we were there doing the fourth repair If there Is any more information needed on this project please contact me at [redacted] [redacted] ***

Revdex.com:I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.Marrs Contracting was at the time I signed the contract working on the neighbors house.  I signed the contract on or about May  24, not the 14th of May. The contract does not state a refund clause or cancelled work policy. I gave him a deposit on May 29th with his guarantee the work would be started in two weeks.  He cashed the deposit check on June 2, 2014. After the check was cashed he put four metal poles in the ground to outline the garage.  They were so close to my house I would not have been able to get my car around the house into the garage. That when " I "  told him it was not where I wanted the garage and it was too close to my house where he placed the poles . I couldn't get my car around the corner of the house into the garage.He then asked me where I wanted it and I said farther back.  He told me he didn't know if the county would approve the location.  He did get a revised permit.   He wrote a letter for the neighbors to tell them the old shed would be demolished within the next two weeks.  That was on June 11, 2014.  May 20, 2014 he had the survey AES team come out.  He then told me they were going to start excavation so I moved my vehicles out every morning for a week in May waiting and no one came. His excuse was the excavator had a graduation party to attend.  The following week [redacted] told me he wouldn't be working because he had a graduation party to attend. The verbal agreement concerning the shed was he was not going to charge me for the move. It was to be placed on concrete footers and blocks, and he assured me he had equipment to move it. There was no equipment but poles and he, his son and one other person rolling it across the yard which is slanted.  Right after this I noticed the corner of the shed was damaged and also the two doors in the front were indented.    There were no permanent concrete footers.  The blocks cracked from the weight of the shed, there were no blocks under the center for support, and the lower section was built up with 4" blocks that were unstable and unsafe.  I had neighbors telling me that it didn't look safe and I should not use it unless it was reinforced. damage was incurred to my shed due to poor movement of the structure followed by inadequate support of the structure. The shed should never have been moved to a foundation that would not support the structure fully, the blocks that were placed as a foundation broke under the weight of the structure causing further damage to the shed. The damage to my shed  is only one example of the sub-par work which caused me to cancel the contract in the first place. I did not want to risk further damage to my property or pay a contractor whom would not return my calls, answer my text messages and emails, or would constantly cut corners to get temporary results which would cause unnecessary problems in the future.He had no contact with me until July 26, 2014 which was over the phone when my son hollered as he drove past. He called a few minutes later and I asked him when he would return my deposit, and said I was willing to pay for his limited services.  He told me and my son, on speaker that I would have my check for the deposit by the first week of August. He did not cancel the permits until September, after I notified the county that the contract had been cancelled in June.I sought legal advice.  A letter was sent to Marrs Contracting and he never responded to my attorney who requested expenses and receipts.  I am still persuing the return of my deposit for the services not rendered. On November 10th, 2014 I approached him while he was working for a different neighbor. He charged at me in an aggressive and threatening manner and told me I was not getting my deposit returned. He said he discussed the matter with his colleagues and they decided they were not going to return my money due to a breach of contract, even though the contract was breached by [redacted] prior to my cancellation. All of this was witnessed by a neighbor.Regards,

My husband and I had our kitchen remodeling. Marrs Contracting did and excellent job. They were professional,friendly and courteous.

drawings and submitted the drawings to [redacted] for her approval then submitted the drawings for and were approved on 6/2/1 We thenmoved her shed and to a  location she had chosen. She asked for us to lay out the garage by staking the property. She then said she wanted to move the garage back. There Is a 25' rear set back restriction I said I don't know ifthat is possible but I will try. I went to New castle County and talked to a Zoning Planner and he said as long as we Demolish the existingshed on the rear of the property we would be permitted to build up to the 10' easement. I told [redacted] she asked me to re stake the new locatlon for the garage and we did. She said go ahead with the new location. We had to revise the plans, acquire a demolition permit and a revised permit for building on the newlocatlon on. We went to New Castle County again and acquiredthe demaHtron permit for the shed and for the revised permit for the new location on 6/18/2014. We had to make up fetters for the neighbors on all connecting properties and have them signed by [redacted] and then delivered to the neighbors.This happened on 6/20/14 thru 6/23/14. We then contacted all of our subcontractors and metthem out at the sight to finalize their contracts and requirements sent the material llsts off to our suppliers and on Thursday the 2st" 2014 [redacted] left a message on our office phone saying she cancelled the contract. There was other Issues we were dealing with as well. We had DP&L out to the site to talk about the electrical supply to the house to determine whether or not the power line could stay at Its existing location or if it would have to be installed underground. Now I didn't receive the message right away on Friday Morning the homeowner next door whom we were completing a S month long project tells me Friday morning with a smirk grin on her face that the garage job next door was cancelled. I was perplexed.6/27/14 I went next door and knock on the door and [redacted] said she has cancelled the project. I asked her why did I do something wrong or did my guys do something wrong and she said no. We didn't do anything wrong she said it was her and that she couldn't deal with it at this time she has to much going on and she wants to cancel the contract. Iexplalned to her that Ireleased the materials to the suppliers and will have to see where they are. She said she wanted a refund. 'told her that we don't give refunds can we do the concrete sidewalks and driveway that was part of the contracts and she said no. I told her I would be in touch. After this I contacted lawyers and cannot discuss it any further. Isent an email cancellinsthe permits to NCCO on 9/16/2014. As far as damage to her shed doors she cancelled the contract before we could finish the supporting. There needed to be additional concrete blocksinstalled. She knew that because I told her.
