Premier Furniture, located at[redacted]., Union City, TN sold furniture items on 04/26/2014 with contract signed, in breach of contract.Item referred to are in non-delivery status, management contacted several times and claim of not knowing wherabouts of items sold. Manager informed customer of refund if delivery not performed by delivery window of 8 weeks which has expired. Furniture store in liquidation status, and item purchased by cash was ordered through [redacted] located in Virginia.Premier Furniture has breached a legal contract and legal action is considered if monies not refunded according to managers verbal statement. If not honored, indicates lack of character and honest sales practices. Desired SettlementFull refund of item in breach of contract by Premier Furniture.

was told at purchase could exchange if not happy with product sold by salesperson [redacted].went back to following day after delivery to ask for exchange because the bed was too hard.was told we would have to wait 30 days but was not told of waiting period at the time of purchase.I left unhappy and within less than 3 minutes I was called on my cell phone and was told that he had talked to his boss and that he would exchange the bed.I waited for the next weeks delivery truck and called to inquire if my bed was in. then was told that I would have to wait the 30 days but I explained I was told multiple phones calls later we were back to waiting 30 days and was told it would be here when the 30 days was up so I played along. now the 30 days has expired still no bed.I have inquired to speak the owner and was told the he would call me back but he did not even with me mentioning of filing a complaint with the on my 3 call on the date I was promised an exchange.I feel this has been one big run around and do not wish for this company to have my business or money.Product_Or_Service: bedDesired Settlementwill need to order new bed from competitorafter competitor delivers the right bed [redacted] to pick their bed up and have finance company reimburse me for the first months payment.Business Response The customer did purchase a mattress set with a 90 day comfort exchange option. We offer that on several high in mattress sets. The manufacturer requires you to sleep on the mattress for 30 nights. This allows your body to adjust to the new feel of the mattress. 1 night is ridicules. The exchange works like this. You may swap for a mattress of equal or greater value no questions asked within 30-90 days as long as the return mattress doesn't have any soils of any kind. We agreed to allow customer to swap but he picked out a mattress that we don't carry in our store. We have tried to get the mattress but can't at this time. If Mr. [redacted] wants to exchange within our store guidelines we will gladly assist him in any way. If He also paid a upgrade fee we will refund him the difference immediately until this is resolved. We are doing what we can on our end. Thank You. I would advise the customer to work this out with the store. We have a no refund policy. He ordered this mattress in good faith & was delivered. He needs to come into the store & exchange for something we carry not a mattress from another location. Complaint9/4/14 Ordered a split king temperpedic bed.My husband was having surgery & we needed it asap. Was told if either mattress was uncomfortable, we could exchange it, no problem. Also got "Free $300 worth of items" with this $4500 purchase. 9/10/14 went back to store & ordered sheets, was told they would be in when the bed came. 9/11/14 my mother went in and bought a set of sheets for my birthday. 9/16 bed delivered, no sheets. 9/17 sheet set my mom ordered &BOUGHT a day AFTER I ordered my "FREE" set, showed up at my door. 9/24 went in & ordered & paid extra $300+ for a replacement mattress-my husbands side too hard & cannot sleep on it. Asked about sheets, again. 9/30- Husband calls about sheets & replacement mattress. No one knows anything! No idea of status. 10/7 called owner in Union City, Tn store but owner "sick" & no one there knows anything about sheets or mattress either. 10/13 call owner at 5:10pm doesnt know why sheets arent in. Says mattress will be in 7-10 days from today. Also says there is a 30 day rule on exchanging mattresses. That I shouldve been told I had to wait 30 days from purchase date to order an exchange. We were never told this. 10/23 call owner, he will check on status of orders & will call me back that day, NEVER did! 10/24 husband calls jackson, tn store n& speaks with saleman who tells us that mattress is to be in on NOV 1 & that the owner told him not to worry about trying to speed up deliver because it is "just a swap out".11/5/14 today- NO ONE HAS EVER CALLED ABOUT REPLACEMENT MATTRESS OR SHEETS! BUT THEY ALREADY HAVE ALL OUR MONEY! I WILL NEVER RECOMMEND this store to anyone!
