I have reviewed the response offer made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below The home was not set by 12/4/We were unable to even move into the home until after Christmas because it had not passed inspectionThey did not even finish the trim out work on the inside of the home, or put a porch up to enter the homeThey left a stack of cinder blocks outside my door Regards, [redacted]

Franks response that we offered no resolution, we attached repair orders that show the work that was done and I think it was made clear, we do not want Frank anywhere near the dealership! He states he lives very near another GMC dealership that provided him wonderful service, that is where he needs to go From the previous response: Frank, for whatever reason does not want his truck He started one month before his first visit with his conversation with Bruce on 11/21/that he did not want the truck Throughout these so-called issues, he has continually requested his truck be purchased back , has threatened with all of his political family members and has been physically threating and vulgar His first service visit he stated to the Service advisor just give the keys back to the salesman Frank can go to any GMC dealership and have service performed which we want and have told him He is a threat to our dealership and employees and is not wanted anywhere near here, especially now since his recent case against him in Akron for “Impersonate a law officer” and “Firearms in a motor vehicle” charges on 1/10/If he has a service issue with GM and wants his truck purchased back, he needs to follow the proper process and it is up to them to make that determination Frank did talk with Robert Robert was not totally aware at the time of his conversation with Frank of the complete history with Frank and the dealership Frank told Robert that the navigation screen was damaged by Premier during his first visit at the dealership He told Robert that he went to another place and those people told Frank that we damaged the screen with a tool at the time of service Robert, not knowing the history, told Frank that IF we damaged the navigation screen that we would replace the navigation unit Well, per my original response, that on 11/21/16, Frank stated that the screen was cracked BEFORE he ever brought his truck in for his first service Frank, attempted to get Robert to believe something that was not factual and Premier is not going to replace the navigation screen that was cracked before we ever saw the vehicle This was not done by Premier as Frank had statedFrank states about Kelly Blue Book values, etcand other offers he has received Those offers, like I stated in the original response were as much or more than he paid for the truck! Why does Frank continue to bring this up vs just selling his truck to those who made these offers? Frank also states that the discussion of him wanting us to buy his vehicle back was only after we were un-willing/un-able to fix the truck Well, again, per the initial response, this is just not factual, as Frank started the “buy the truck back” argument on 11/21/and again at the first write up with the Service Advisor 12/21/16! Again, we want nothing to do with Frank [redacted] and he can go to any other GMC dealership (which he has a good one near where he lives) for any service or concernsOn another noteThe Revdex.com and any of its contacts with other state agencies may want to look into the company Frank [redacted] owns, [redacted] Per attachments, the website states that he is the owner and that this company is licensed in the State of Ohio According to the Ohio Secretary State website, [redacted] ’s license was cancelled on 4/14/and has not been reinstated He also states about his A+ Angies List rating, and according to Angies List, they do not recommend the company’s services like the website and Frank states Also, nowhere on EPA’s site does [redacted] show as a Lead Safe Certified Firm and attached are “reviews” from online by some of Franks customers Maybe Frank and his company are licensed under another legal name/entity and then so be it However, if not, these may be some “red flags” as to his status as a business in the state, taxation issues, misleading consumers , etc

I am rejecting this response because: Nothing has been done to fix or address any of the issues The business's response offered no resolution to any of the issues with the vehicle or in reference to the poor service that was provided The last I talked to Robert [redacted] (prior to this complaint) he agreed to replace the entire GPS unit I accept that offer, however there are still other issues that existNo explanation was given for the poor serviceI have more videos and pictures that I can provide The selection above is only allowing me to provide How or who should I provide the remaining videos and pictures? Additionally at the current time, Kelly blue book list my truck at mid range trade in value of $50, This information combined with the offers I received from other dealerships show the lack of good will interest from Premier GMC My comments and discussions of them buying my truck was only mentioned because they were un-willing/un-able to fix it Though they have told me several times and I mentioned in the complaint, they are yet to give the contact information of the "gm rep" who they referred to several times

*SEE ATTACHMENTS*Premier GMC response Frank purchased his truck on 7/28/new His purchase price before tax was 59,less rebates of $3,for a net price of $55,Frank first called on 11/21/and talked with saleperson Bruce and complained of poor fuel mileage, his radio unmutes shortly after he mutes it, the navigation screen changes to different view shortly after he changes the view, "now" the screen is cracked (said it was fine the night he went home, next morning when he got into the truck it was cracked and the truck was locked all night), Frank stated he has read reviews where GM diesel trucks are pieces of ***, wants to walk away from it Bruce suggested he bring it to our service department so we could look at his issues On 12/12/16, Frank brought the truck in for service (First service visit, months and 13,miles since delivery) and told the Service Advisor Clark about the GPS not working properly, that the screen was cracked, that he was getting poor fuel mileage, his phone charger didn’t work and that his drive shaft had excessive movement, plus he wanted Clark to give the keys to the salesman who sold it to himFrank said he didn’t want it Per the attached RO, we reviewed the GPS issue, finding that all was working OK even with the damage, and even had Bruce look at and review the operation and all was working properly The phone charger issue was tested and charger not only worked charging a phone, it was also tested with a EL- that showed all was OK The excessive drive shaft movement seemed all at this time Regarding the fuel issue, driving habilts, towing, etc will affect fuel mileage Tony, the service Manager, called Frank to review the issues He talked with Frank to get clarification as to how his screen got brokenHe said he came out and it was broken due to cold weatherRegarding the other issues, Tony told him we did not see anything abconcerning the fuel mileage, that there are many variables to considerHe told Tony he knew we wouldn’t fix his truck and with that Tony kind of chuckled and tried to explain the process to himHe said he was very offended to fact that Tony was laughing at him, and as Tony tried to explain things to him he continued to talk over Tony, then he said he would come down to the dealership and grab him by the collar and shake him and drag him to Billy's office and see Tony laugh at him then Tony stated he would not recommend that, at which time Frank then called Tony a [redacted] at which point Tony hung up the phone and went to see me and Billy about the situationBruce in the mean time, called Frank to discuss the issues with his truck Frank proceeded to tell Bruce his complete dissatisfaction with our service department, how Tony chuckled at him when Frank asked why they couldn't fix the problems, told Bruce that he said to Tony that if he was standing in front of him that he would have grabbed Tony by the collar and dragged him into Billy's office for failure to do his job and for disrespecting him He told Bruce that if we couldn't fix his truck that he wanted us to cut him a check for the amount he paid for it He explicitly told Bruce to tell the service department to stop whatever they were doing to his truck, park it outside, and if we didn't meet his demand for payment he would contact his aunt, Mary [redacted] , who is the Assistant Governor of the State of Ohio and get her involved in the matter Frank said he had already spoken to her so she was aware of the situation He told Bruce that it is a privilege to do business in the State of Ohio Bruce went to Tony and asked him what had transpired Tony told Bruce about his conversation with Frank and verified that Frank was unhappy with our response that we could not duplicate the issue with his navigation system, that he told Frank that the fuel mileage was not below expectations due to winter fuel mixtures, and that Frank had threatened him by grabbing him by the collar, and soon afterwards ended his conversation with Frank That afternoon Billy talked with Frank.regarding what was going on and he would not tell Billy what was wrong with the truck only stating he was disrespected by Tony and that he will not be talked to like thatHe said his phone records all calls and that he has the recording of the conversation with him and Tony however he would not give it to BillyFrank insisted that we are to buy his truck back for what he paid for it and Billy told him that we would be happy happy to do so for what the current market value is on his truck and that if GM is to buy it back, there is a process to follow He did not like that answer and said he is going to take this further and get Mary [redacted] involved and that he will not only get what he paid for it but he will even get moreBilly tried to tell him would look into the alleged issues with his truck, however Frank was not accepting that.On 12/13/16, Bruce called Frank and asked when he was coming in to pick up his truck He said he wanted his truck fixed or he didn't want it at all Bruce reminded Frank that he instructed us not to do anything more to his truck and have service park it outside He again expressed his dissatisfaction with his fuel mileage and Bruce asked Frank if it was OK for him to drive the truck and check the fuel mileage, which Frank approved Bruce drove the truck and the fuel mileage for what Bruce drove was Bruce then got with me and Billy regarding the issues About 4:PM that afternoon I talked with Frank for minutes and seconds at which time I tried to get some facts from Frank and to see about getting involved He stated he paid $60, for his truck and that his issues have not been resolved He says he video taped his issues with his GPS and got very combative when we were talking about this and I asked to see the video that it would help me get with tech support etcto see what is going on He stated he wasn’t going to drive back to dealership to show me the video and I told him to email or text me the video I gave him my cell phone to send it to meStated that he was getting MPG the last 1,miles and that consumer reviews showed issues with these trucks and mileage and that he had receipts and manually was calculating his mileage He stated that in “real world” scenario, we can argue the fact his mileage is not right and that if it is put in front of a judge, magistrate or politician that he would win that argument every timeDriving habits, towing, etc will obviously affect a vehicles MPG He continued to berate the vehicle and that it is embarrassing he truck only gets 12-MPG He did not like the fact that Bruce got 17+ MPG and that Bruce wasn’t driving like regular driving I stated I would get with my Service Rep, review the video he was sending and get with him in case there were any known issues he may know about and review the MPGAfter talking with him for about minutes about his iss;ues, Frank stated he wanted nothing to do with that and didn’t want the truck back He continued to berate Tony and the service he received and that all his calls are recorded due to the fact for the kind of business he does for the government He stated he records all of his calls on his phone and that he works for the government and all of his calls must be recorded He continued with his displeasure with Tony on the phone and that his truck is not worth $60,and that we were committing a crime for selling it(Dealers don’t set prices for the manufacturer) Frank continued to review the issues again and that the screen crack “just happened” and was irritated that Tony was calling him a liar when Tony only asked him what had happened He stated he is not taking our review of his issues and that he know to many people to put up with thisIf we didn’t want to fix it, there are other ways to take care of business I again stated I am here to try to work with him regarding the issues, then he state he doesn’t want the truckI asked if he wants me involved to fixing the truck and he stated he has serious doubts about me getting anything done I told him I would get involved the following day with our Service Rep He stated he probably should just bring the loaner back and get his truck, take it somewhere else and proceed to tell GM and everyone else and every other string he can pull about usI again asked him if he wanted me to get involved I asked him to send me the video and also would he send me the recording with Tony so I could review and if there was an issue with Tony I could discuss it with him Frank stated the recording does not belong to him, that it belongs to the government and that he works for them on special detailHe could not physically give it to me because it does not belong to him(Just a side note, not quite sure how legal the government recording calls that have nothing to do with an investigation they are doing – Ohio being a “one party consent law state and this being party) After he reminded me of his work as a consultant for his family members who work for the state of Ohio and that he will get these people involved if need be, we ended the conversation that I would get with my GM Service Rep the following day.On 12/15/Frank left a message in the morning that he stopped at the dealership to get something from his truck and wanted to talk with me that he was still not satisfied(He stated that we had an appointment which is just outright NOT TRUE) He said he was sending a video when he actually only sent a picture (jpeg) On my way into work, I called Frank and he continued to state his dissatisfaction all over again I told him that we just had this conversation at the close of business the night before, that I have not even gotten to work and that I was going to meet with my Service Rep that afternoonHe continued to get belligerent and wanted us to buy his truck back and stated that I just wanted him to come and pick up his vehicle and me do nothing I again stated that was not the case, that I stated I would get with my Service Rep that afternoon to review and he kept stating “Do you want me to just come and get my truck”? He kept this up least times and I finally told him, Frank if YOU want to come and get your truck, then do so, that I am trying to help him, we just had this conversation the day before, I haven’t even gotten to work, however, if he wanted to come and get his truck, then do so He stated he was not far away and that he would be there.Frank showed up and I handed him his keys He proceeded to tell me about him making us buy the truck back that we would not now have the asset (His truck) I told him I was not understanding what he was saying He proceeded to explain that if I buy the truck back and gave him $60,and sold it for $50,we would only lose $10, I told him we (dealers) don’t buy trucks back that this would be a GM issue for a buy back I then asked why would I buy something for $60,and sell it for $50,000.00, lose $10,000..00? He stated it will cost us a lot more than that He wanted the owners name which I gave him Sean’s name and number As I gave him the information he leaned over to me, whispered something in my ear (I have been Greenland????? or something), which I could not hear completely, I asked him to repeat but he continued to walk away.Frank had conversations with Sean and Robert regarding the issues They contacted me and I reviewed with them the above facts Sean talked with Frank to Franks displeasure and Frank then talked with RobertRobert stated if he wanted the vehicle bought back by us, we would appraise it and give him fair market value Robert told him that amount at this time is $42, Frank states that he went to other dealerships and got appraisals for $55,000.00-$57, He paid $55,for the truck! Frank states how dishonest and unfair we are Well, it sure looks like we gave him one heck of a deal when he can damage the navigation, drive the truck over 13,miles and get as much or more than what he paid for the truck!!!! Why didn’t he do this? Frank said he didn’t want it.  Per the attached RO, we reviewed the GPS issue, finding that all was working OK even with the damage, and even had Bruce look at and review the operation and all was working properly.  The phone charger issue was tested and charger not only worked charging a phone, it was also tested with a EL-51755  that showed all was OK.  The excessive drive shaft movement seemed all normal at this time.  Regarding the fuel issue, driving habilts, towing, etc will affect fuel mileage.  Tony, the service Manager, called Frank to review the issues.  He talked with Frank to get clarification as to how his screen got broken. He said he came out and it was broken due to cold weather. He continued to get belligerent and wanted us to buy his truck back and stated that I just wanted him to come and pick up his vehicle and me do nothing.  I again stated that was not the case, that I stated I would get with my Service Rep that afternoon to review and he kept stating “Do you want me to just come and get my truck”?.  He kept this up least 4 times   and I finally told him, Frank if YOU want to come and get your truck, then do so, that I am trying to help him, we just had this conversation the day before, I haven’t even gotten to work, however, if he wanted to come and get his truck, then do so.  He stated he was not far away and that he would be there.Frank showed up and I handed him his keys.  He proceeded to tell me about him making us buy the truck back that we would not now have the asset (His truck)   I told him I was not understanding what he was saying.  He proceeded to explain that if I buy the truck back and gave him $60,000.00 and sold it for $50,000.00 we would only lose $10,000.00.  I told him we (dealers) don’t buy trucks back that this would be a GM issue for a buy back.  I then asked why would I buy something for $60,000.00 and sell it for $50,000.00, lose $10,000..00?  He stated it will cost us a lot more than that.  He wanted the owners name which I gave him Sean’s name and number.  As I gave him the information he leaned over to me, whispered something in my ear (I have been Greenland????? or something), which I could not hear completely, I asked him to repeat but he continued to walk away.Frank had conversations with Sean and Robert regarding the issues.  They contacted me and I reviewed with them the above facts.  Sean talked with Frank to Franks displeasure and Frank then talked with Robert. Robert stated if he wanted the vehicle bought back by us, we would appraise it and give him fair market value.  Robert told him that amount at this time is $42,000.00.  Frank states that he went to other dealerships and got appraisals for $55,000.00-$57,000.00.  He paid $55,529.71 for the truck!  Frank states how dishonest and unfair we are.  Well, it sure looks like we gave him one heck of a deal when he can damage the navigation, drive the truck over 13,000 miles and get as much or more than what he paid for the truck!!!!  Why didn’t he do this?  Frank continues to berate our service and how great all of his business service are, well I will put our A+ Revdex.com rating up to his [redacted] “F” rating any day.   Frank, for whatever reason does not want his truck.  He started one month before his first visit with his conversation with Bruce on 11/21/16 that he did not want the truck.  Throughout these so-called issues, he has continually requested his truck be purchased back , has threatened with all of his political family members and has been physically threating and vulgar.  His first service visit he stated to the Service advisor just give the keys back to the salesman.  Frank can go to any GMC dealership and have service performed which we want and have told him  He is a threat to our dealership and employees and is not wanted anywhere near here, especially now since his recent  case against him in Akron for “Impersonate a law officer” and “Firearms in a motor vehicle” charges on 1/10/17. it rained twelve days with at least two days to dry out. Therefore, it was a month before their mobile home was delivered. I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
The home was not set by 12/4/15. We were unable to even move into the home until after Christmas because it had not passed inspection. They did not even finish the trim out work on the inside of the home, or put a porch up to enter the home. They left a stack of cinder blocks outside my door.

I am rejecting this response because:
Nothing has been done to fix or address any of the issues.  The business's response offered no resolution to any of the issues with the vehicle or in reference to the poor service that was provided.  The last I talked to Robert [redacted] (prior to this complaint) he agreed to replace the entire GPS unit.  I accept that offer, however there are still other issues that exist. No explanation was given for the poor service. I have more videos and pictures that I can provide.  The selection above is only allowing me to provide 4.  How or who should I provide the remaining videos and pictures?  Additionally at the current time, Kelly blue book list my truck at mid range trade in value of $50,639.00.  This information combined with the offers I received from other dealerships show the lack of good will interest from Premier GMC.  My comments and discussions of them buying my truck was only mentioned because they were un-willing/un-able to fix it.  Though they have told me several times and I mentioned in the complaint, they are yet to give the contact information of the "gm rep" who they referred to several times.
