*** please advise I will need the Revdex.com to authorize more down loads of correspondence on our behalfPlease be advised alot of the correspondence was conducted on the behalf of Mr.*** and never ***But please find attached so far the pool before the plaster holding water and on 5/5/holding waterOn 6/6/Mr*** sent a picture to us on how bad to the Bone the pool was with no recollection of the pool leakingOn the equipment Mr.*** purchased from our distributor at distributor cost We were contacted on that behalf and assisted with this and have the email correspondenceAlso there was construction still being done after the completion of the pool and still nothing of the pool leaking till a lmost a month later with this being said it's hard to believe the pool was leaking on a defect of our partNot saying it can't happenBut after a month of completion you bring forth of this giving us three days to handle the matter when we're on other job sites and can't just pull off the job then said you had contacted an attorney that would be representing the ***'s with correspondence on that emailYou have yet given us the time to do anything before you jumped the gun on this situationWe have email correspondence with Mr*** on numerous occasions Being the neighbors would like to know when we woul be handling their fence and and when we attempted Mr *** saying I wish he would of let you finish thenMay we have email to *** asking for the name brand of fence and total of panels *** responded back on may I will thanks May another sent out just touching base I know with the weather of rain in the forecast I am sure you are busy as wellBut just wanted to send a reminder we were still in need of the type of fencing and how many panelsThanks in advance on this matterMay th following up on the valve issueNothing of a pool leaking then until June 4thThen we had correspondence June 5th still nothing on fence or etcAlso please be advise with sales act we have a right to a estimate if the expected cost of repairs or services will be more the twenty five dollars you have yet to provide the invoice you paid out for this operation of the alleged leak before we could get to it since you brought this to our attention to act upon it with other customers on our schedule when if this was a issue at the beginning when the pool was first filled we could of acted quicker Our customers are our number one priority and have no problem helping our customers if there are to be any situationsBut we also have on the proposal where Mr*** was suppose to provide items and didn't costing more than what your requesting but since we're a good company we didn't care cause you were happy and that's all that mattered at the time of completion of the ***s projectAt this time I am requesting Revdex.com allow us to add more documents over approx to back up this complaintPlease and thank you

I am rejecting this response because:
I find it extremely amusing that Roger has this amount of time to upload sample text messages along with emails of correspondence within 10-hours of the Revdex.com response to the contractor. A simple search of the Revdex.com shows that Premier Gunite Unlimited has been through the gamete of complaints against their workmanship in prior years. complaints including this one to be exact. In each case, Roger puts the blame on the customer. If Roger was as worried about his customers as he states he is "our customers are our number one priority" than we wouldn't even be talking about a situation right now. Regardless, of the date that Roger was notified of the water leaking (which he knew about prior to when he admits) as stated on the work and repair order from *** *** *** which I believe has been previously uploaded: "Both skimmers were found to be leaking in skimmer throats where plastic and grout come together and also both main drains were found to be leaking where main drain lids come through pool floor". With the poor phone, email or even text message responses from Roger during the entire project, lead us to believe that he was not going to stand behind his workmanship so we had no choice but to hire *** *** *** to preform the service. For example, during the project Roger totally disappearing for right around weeks, no return calls, emails, or text messages. It is not imperative to the case in this situation but Roger knows where he was so I'll leave it at that without further embarrassment of Roger or Premier Gunite Unlimited.So, he claims that his customers are number one, we sure don't feel like it. What I am asking, since Roger is very handy at uploading pictures and files is to upload on the public forum, a copy of a check written to the ***'s for reimbursement of the amount owed. $to *** *** *** and $1,500.00 to *** *** to repair the fence. That will tell the public that he truly cares about his customers and is an honest businessman. My bet is that we don't see it! If received on my end I will then post the check as a receipt to show that he sticks to his word. I understand that people make mistakes (not covering a fence prior to gunite placement) which resulted in a damaged fence. It's how they follow up on the damage and how it's repaired is what matters. In this case the follow up is piss poor. Blaming the customer seems to be the easiest thing to do

I spoke with you earlier this week in regards to this case and you explained to me the case was extended another 10 days upon trying to access the email you sent me to view it online it says the case is closed and wont let me attach our docs. pool. Upon explaining we have contacted an attorney and he as the majority of our original Docs of this case. But other than what we have given our attorney this is what we can provide on behalf.  Also be advised that on a legal recorded Plat that a builder uses to identify a property lay out when a house is built. The easement that was not marked by owner or identified on a legal Plat. Per our contract attached we are not liable for those type of situations but we are taking the downfall for the unforeseen underground drainage or obstructions which we are fighting and was at no fault of [redacted] & [redacted]'s or Premier Gunite Unlimited Pools & Spas LLC. The home builder [redacted] is reliable for this situation he falsified a legal recorded Plat. We are not in contract with the builder we are in contract with [redacted] and [redacted]. Per the text we have printed out and have Kept the Originals on phone to protect the company to back up cause it only downloaded in word format so they can not state we have changed any format. Per [redacted] back on 07/29/2016 at 6:53pm we were told to at least hold off one week at that time why we figure out pipe  and easement and best solution. Please refer to attached back of our contract which our Attorney has signed copy. Numbers 3,7,13,23. That protects the company once the Home owner signs our contract. Our company equipment sat on the premises while this was being figure which specifically states under payments in our contract #3 that were accumulated due to the un foreseen circumstance that have not been paid to date and specifically states in the contract ( Any additional cost arising out of work stoppage hereunder shall be the obligation of and be paid by the owner prior to the recommencement of construction of the pool use. . Also I told you the Plat was too large to attach but will be working to format it to size to send as well and waiting on the other concrete company to send the cancelation of Gunite around this time frame due to the obstruction not identified by home owner or builder [redacted]. Which the company that built the house is attached as well. Also this pipe that was not properly recorded wasn't just their pipe it was tied in with other houses as well. Please also be advised at the time of showing up to the property to talk the cops were called on us and were told to remove the equipment off the said premises and the location was not properly secured by us putting the company at risk due to the behavior of said customer. We have tried to work with them in this situation with plenty of docs to prove. But they do understand what's going on and this we are the bad people. So now there is attorney involved to protect the company of a situation that was at not fault of ours. They have started the process of sland[redacted]g and defamation of character of our company at this point that is not fair that will be brought fwd. too. But we don't air our dirty laundry on line we have nothing to hide but will not stoop to their level and still working currently and have plenty of satisfied customers in the mean time. If you have any further questions please feel free to let us know. I am rejecting this response because:(Revdex.com converted from voicemail.)She is responding because she saw update to complaint.She is forwarding a powerpoint presentation that shows timeline of events of exactly what happened and hopefully make it clear as to what exactly happened.The pool builder is obviously still trying to blame everything on the home builder.  Yes, the home builder is at fault for the pipe existing on her property.  But, the fact remains that the pool builder uncovered the pipe, proceeded to tear it apart after it was brought to his attention, and did not inform the consumer that he found it.  He took it upon himself to repair the pipe and insisted on putting a $90,000 pool on top of leaking pipes.  The consumer has a video, 4 or so days after when the pool owner said the pipes were fixed, that show they were still leaking.  Video shows pipes leaking in 4 different places.The consumer does not know how the $28,000 charge is from equipment sitting on her property when, even if it sat for two years, it wouldn't add up to that amount.   The other charges are just made up.Although the pool builder has cited clauses in the contract, the consumer pointed out that the business did not adhere to the terms of the contract by performing work that was not within the scope of work without authorization or without a change order.  (The pool builder and home builder made an agreement for Premier Gunite Pools to repair pipes.)The business owner is associated with seven businesses and has a history of closing businesses when he gets into financial/legal difficulties.  He also has a number of liens against him and court cases for personal and business disputes.  There are also drug charges filed against him in the Mansfield Courts.
