Good morning [redacted] ,I just wanted to respond to your emailI am quite frustrated at this pointI have not done anything wrong and Mrs [redacted] has breached the contractShe has filed a complaint against me with [redacted] I now have to respond to as wellShe as well as her husband have slandered my company through [redacted] and your social media as wellAs all of my prior responses have indicated as well asI do want to perform the work as contracted but for whatever reason Mrs [redacted] has changed her mind, humiliated me and my companyShe has turned this into a personal vendetta in my opinionThis is completely unfair when my company and employees have always tried to meet Mrs [redacted] ***'s needs and shown her respectMy contract doesn't state that a refund is non- refundable or refundableThere is no mention of a refund at allI have never been in a situation that I have had to offer a refund in over years of business.I am willing to Refund all but $ [redacted] of the Deposit to Mrs*** I have this much invested in time, supplies and the [redacted] Cherry Tree which is a Specialty tree Unless a contracted client requested this specialty item I will be stuck with it.Sincerely, [redacted]

We need our full deposit back of $***. They have not done any work, have been rude, have been impossible to contact or communicate with, and have run out of time. As far as purchasing a cherry tree for the job, they are a landscape company and should either be able to use the tree for another customer, try to return it, or maybe plant it in their own yard. That isn't much of a loss on their part. We have written to *** *** also and are hoping they can help solve the problem

Another letter full of lies. This is really getting old! We told him, at least two times, to call before he came so we would be available to go over work with him. He violated our rules on our property and came without callingseveral hours after receiving our complaint from the Revdex.com which statedWE WANTED OUR DEPOSIT BACK and WORK CANCELLED!and he came on the COLDEST Nov 18th we've had in 1** years! We were NOT PREPARED to go out there and talk with him about changes we had and he had already been FIRED ANYWAY! So he had NO BUSINESS on our property! I tried to contact him by email, by phone, and at his place of business. He is IMPOSSIBLE to contact or communicate with as is stated by a previous customer complaint posted at the Revdex.com site! I have already said all I need to say SEVERAL TIMES OVER HERE! We need the whole deposit back of $***. He has not done ANY work nor do we want him to with all the trouble! Nowhere on the estimate or anywhere else does it state that the deposit is nonrefundable if no work is done. A *** Cherry tree is a common tree for a landscaper to have, and if he had to purchase one because his business didn't have one, he can use that tree for another customer. It is not my problem that he broke our contract and didn't come to work as he stated he wouldand then VIOLATED our rules on our property! When we paid the **% deposit on Nov we were suppose to be scheduled for service. That is stated in his estimate. He told us he would try to schedule us for the following week. He decided to go "visit his little daughter" in St Louis instead of keeping his contract with us. His employee I talked to in the parking lot told me that, and those are his EXACT WORDS. It was not business as he stated, and to be honest, I really don't care WHY he went to *** *** instead of keeping his contract with us. But if he couldn't make it as he stated, he should have called us with another plan. When his employee got him on the phone for me to talk to, he yelled, very rudely, "I'M IN ** ***!!!" He was VERY RUDE! He has also violated the Revdex.com rules by not responding on time. He was suppose to respond within days of Dec 3. Today is Dec 15. That is days LATE! Customers don't like that! And that is why I FIRED HIM! After paying a **% deposit, customers should not have to wait around for weeks and weeksWONDERING WHEN OR IF he is going to SHOW UP! It is stated in his estimate that as soon as he receives a **% deposit we will be scheduled for service. That doesn't mean we wait around for weeks and weeks WONDERING. He said in his previous letter that he told us it would be 2-weeks - THAT IS A FLAT OUT LIE!!! NEVER DID HE SAY THAT!!! All he EVER said was he would try to schedule us for the following week. We believed him! And we believed if he could not make it, he would call to reschedule. He needs to improve on his customer service skills and show up when he says he will! The ONLY reason I called him is because he had an A+ rating at the Revdex.com and I believe he would show up on time, be professional, and we would NOT HAVE THESE PROBLEMS! How in the WORLD does he have an A+ rating with the Revdex.com! He even violates your rules of responding within days! And I have read at least complaints about him from other customersand mine makes 4! He has stated MANY lies in this last response, and in his first response also. I called ONE landscaper before him who didn't want to travel this far. And I wish to God I would have called someone else besides him! He was the second one I called. But the third may have been the charm! We need our full deposit back of $***!

Good morning***I just want to state for the record once againMy company and employees as well as myself and my office manager were not rude to Mrs*** *** in any way, shape of formWe have always been in contact and there are phone records to verify everything as well as phone records showing my call to the Revdex.com on the morning of November 17thIn my opinion she has wanted nothing more than to discredit my company and tarnish our standing with the Revdex.comWe entered into a contract and I have done everything in my power to meet her needsI now have a specific tree purchased for her projectI have absorbed time and money trying to appease Mrs*** ***She has shown up at my place of business without and appointment as well or permission as she claims and my staff as well as myself have always been polite and welcomingMyself as well as my foreman *** were at her residence to evaluate the workOnce a contract has been signed it allows me the right to perform the workMrs*** *** has never stated to me that I would have to make an appointment or get her permission to access her propertyHowever, I did inform her I would be in contact when we would start the projectWe were not there to start, we were only there to evaluate the workHer presence was not required at that timeI have discussed and gone over the work with Mrs*** *** on more than one occasionHow is it that a contractor needs permission to due work once a client solicited there service and agrees to the termsAt this point I would be willing to refund half of her down payment. I am now stuck with a tree that was ordered specifically for her project and now stuck with itI would not have ordered the tree or paid for it unless a contracted client requested a specialty itemAll of this has been blown way out of proportionMy entire goal with Mrs*** *** was to fix another contractors mistakes and provide additional work that she agreed uponI am now being treated unfairly and blamed for nothing that was done wrongAll of this needs to be resolved in a professional and honorable manorI was only trying to please her and do the work I said I wouldI truly hope this can be resolved because this is not fairThank you for your help in this matter and look forward to a reasonable resolution that does not discredit or tarnish my company, reputation or standing in any way.Sincerely, *** ***

We are not trying to ruin his business. We simply want our deposit back. He broke our contract and did not show up for work. We will pay $*** for the tree and no more. A *** Cherry tree is a common ornamental tree used in landscaping. He should have no problem selling that tree to someone else. Has anyone even seen the receipt for the tree he claims he bought? I see them at *** all the time for less than $*** and that is retail price. He did not buy any special materials for our job that any established landscaper wouldn't have. I am writing in response to the complaint filed by Mrs*** ***To begin Mrs*** *** contacted my office and spoke with my office manager *** *** and reque**ed my return call to schedule an appointmentI am the landscape designer and sales representative with the company as
well as the chief executive officerI returned her call in the order it was received and she explained to me the issues she had with a prior contractor that recently worked for herWe discussed the issues and then she asked if I would be willing to come to her residence in *** *** IndianaShe told me that she had contacted numerous contractors that declined on traveling that farIn order to meet her needs I said I would drive to her residence and scheduled an appointment to meet with herShe was so appreciative and very thankful for my response and willingness to travel that farMy company is based on the We**side of Cincinnati and her location was outside of my work range for the volume or extent of the project we initially discussed but I wanted to make her happy and fix the issues she had with the prior contractorMy goal was not only provide a service for her but also to reassu** her that the** a** contractors that do the work as contracted to meet the clients needs.Upon meeting both her and her husband thanked me again for coming all the out to their residence to meetWe discussed the issue of transplanting trees that we** recently in**alled in the wrong locations by a prior contractor as well as other small work items she provided a li** forWe discussed the enti** li** of things she wanted as well as her “wish li**”We discussed the different work and me being a designer, I offered ideas and solutions to things they wanted accomplishedThey we** very impressed and liked my sugge**ions.It was then that I explained to her my work loadI was scheduled already but in order to meet Mrs*** ***’s needs I told her I would extend the **art time to my other clients that had contracted work well befo** her and already scheduledI explained to her it would be 2-weeks after she agreed to the e**imate I submitted and paid the deposit as outlined in the e**imate.During our initial meeting I presented my business card to her and informed like I do with all my clients that I am out of my office mo** of the timeMy business cell number is on my card and that is the be** way to contact meShe did email me and we did discuss the projectI put together an e**imate which outlined all of the various small projects they we** intere**ed in and mailed and emailed them a copy. Mrs*** *** and her husband did visit my retail center and I did happen to be thereI typically work by appointment like mo** other businesses operateI do have a busy schedule with long hoursMy office manager handles my calls and schedule for me like mo** businesses operateI discussed the project and showed them some of the materials that would be used as well as the materials that needed to be orderedMrs*** reque**ed a *** cherry tree that she wanted since she was a little girlI informed her I would try and locate one for herThey agreed to the work and made a down paymentI called several commercial nurseries and located the tree for Mrs*** ***I had an employee of mine travel quite a di**ance to not only purchase but pick up her tree.Mo** clients don’t realize all the work and effort that goes into each project from clerical work, coordinating materials, scheduling and in**allationThis time of year we a** at Mother Nature’s mercyMrs*** *** did make revisions as well as changing the gravel optionThat was not a problem at all and I told her not to worryIt created additional clerical work but not a problemShe did call and reque** that she wanted an additional evergreen tree moved and transplanted and I did talk to her and discussed the workShe informed me she would pay for the additional workI explained to her that would not be a problem eitherOnce we began work at her property we would move the additional tree as well and we would add the work to her invoiceAll in an attempt to meet Mrs*** ***’s needs and to provide her with the service she expected.Mrs*** *** did show up to my office and the** weren’t any personnel presentThe** a** times we a** closed temporarily for running errands such as bank deposits, dropping of mail at the po** office and picking up office supplies or materials for projects, making scheduled deliveries or working on contracted projects themselvesTypical things that is required for a business to function properly on a day to day basisOnce my employee *** ** arrived he spoke with Mrs*** *** and he explained to her I was out of town on businessShe insi**ed on speaking with meTo appease Mrs*** *** he called me while I was in a meeting with a potential commercial client in ***My work does take me to other cities such as ***, ***, ***, *** and ***, *** to name a few for large residential and commercial projectsI did talk to Mrs*** *** to discuss her projectI explained to her she was next on the li** weather pending and that I finally located her tree she reque**ed.I have always been polite to Mrs*** *** and so has my office manager *** *** as well as my employeesOnce again it is hard to plan work with the recent snow and rain we a** havingIn our indu**ry for every day of inclement weather it puts our schedule off by three daysTrying to keep up and meet our client’s needs is challenging at times but we always have managed and always will.On November 17, 2014, being the colde** day of the year to date with snow on the groundI as well as my foreman for the project *** *** traveled to Mrs*** ***’s residence to go over the project and discuss the workWe we** preparing to complete the work as soon as the weather broke and the snow melted in order to meet Mrs*** ***’s needsWhile discussing the project Mrs*** *** opened her door and verbally lashed out at not only me but my foemanShe asked who we we** and what we we** doing on her propertyI tried to explain to her who we we** and what we we** doing thereShe didn’t even recognize me as the person she contracted the work withI was wearing company clothing with my logo present on both my atti** as well as my foreman’s work attireWe even arrived in the same vehicle as my initial appointment with her and her husbandShe reque**ed we leave her property immediatelyBoth myself as well as my foreman we** both in shock and confused as to her behavior when we only the** to evaluate the work to be doneWe honored her reque** and while leaving she in**ructed me in a vicious way how she was filing a complaint with the Revdex.com and not to come backWe left he property completely confused as to what ju** happened.As soon as I returned to my office with my foreman and my supervisor present I contacted the Revdex.com and being pro active discussed the issue we we** ju** involved inThe Revdex.com representative informed me that the issue wasn’t valid for a formal complaint and would be notedI was informed by the Revdex.com representative not to worry about itThat ultimately helped relieve the **ressful morning and dismiss the confusionLater that day I received a complaint notice from the Revdex.com **ating Mrs*** *** had filed a complaint.Once again found myself as well as my foreman, supervisor and now office manager completely shocked and confusedI have been in business since and am very proud of my work and professionalism as a contractorI am also proud of my A+ rating with the Revdex.comI as well as my company have always **rived to do the right thing and have always treated our cu**omers with respect and have always resolved any issuesMy rating and complaint hi**ory proves this with years of out**anding service to our clientsI am **ill willing to proceed with honoring the contract as agreed uponI am professional and this is something that can be resolvedIn fact the project for Mrs*** ***’s would have been completed by now well within in the 2-week time frame I promised her accounting for the snow and rain days.I would **ill be intere**ed in performing the work to meet my client’s needsI find it unfortunate if Mrs*** *** would prefer us not to do the workI have always honored my word as a business man and followed through no matter the circum**ancesIt is the right thing to do and that is what reflects our rating and **rong desi** from my clients to work with my companyThey know I am nice, reasonable in p*** and honor my word which I have shown Mrs*** *** or she would have never agreed upon the workI now feel that the** our issues with the Revdex.com and issues with Mrs*** *** that need to be resolved in a professional and honorable manor.If Mrs*** *** would prefer to not to proceed with the contracted work due to her lack of tru** which is not valid in my opinion I would honor a partial refund to her depositI have taken valuable time to locate and purchase a tree for her as well as other materials for her project all in an attempt to complete her project and meet her needsI have traveled to her residence with my foreman and have inve**ed money in the projectIn closing, I find it quite confusing that a client that solicited my impeccable services and then agrees to the contract has the authority to dictate when or if they want the work accomplished when all I was trying to do
