I inspected the above property today & will be sending the customer a detailed report of my findings next week including suggested remedies for the problems she mentioned.thank you

I have visited the property & met with the homeowner We agreed to do a little remediation work that is needed & this will be attended to within the weeks (as long as the rain stops)

WE HAVE STAYED IN TOUCH WITH THIS CUSTOMER & HAVE REVIEWED THE PROPERTY A NUMBER OF TIMES PREVIOUSLY & HAVE FOUND NO QUALITY RELATED ISSUES FROM THE INSTALLATIONWE EXPLAINED THAT TO THE CUSTOMER THE ONLY ISSUE WE ENCOUNTERED WAS SOME OBVIOUS DAMAGE TO THE WALL WHERE A VEHICLE HAD HIT THE CORNER OF THE WALL, POSSIBLY A SNOW PLOW.I WILL BE HAPPY TO CONTACT HER AGAIN & GO OUT & REVIEW IT AGAIN NOW THAT THE SNOW HAS MELTED & WE CAN ACTUALLY SEE WHAT SHE IS REFERRING TO.THANK YOU

Mr. [redacted] has absolutely no right to the deposit I paid in good faith and I once again demand that the entire $5,000 be refunded without delay.  Today is July 11, 2015 and Mr. [redacted] has had my deposit for over 5 weeks at this point.  BUILDING PERMITMr. [redacted] intentionally did not obtain a building permit to build the deck. He has both a ** Construction Supervisor License and a ** Home Improvement Contractor License, both of which require knowledge of ** building code.  The 8th Edition of the [redacted] State Building Code, 780 CMR [redacted] State Building Code Section 105.1 and R105.1 states that "it shall be unlawful to construct, reconstruct, alter, repair, remove or demolish a structure; or to change the use or occupancy of a building or structure; or to install or alter any equipment for which provision is made or the installation of which is regulated by this code" without first obtaining a building permit.  The code makes it very clear that a deck is included in this category. The purpose of requiring a building permit is to prevent bad workmanship.I’m sure the Commonwealth of [redacted] would be interested in the fact that Mr. [redacted] has failed to obtain building permits in other towns (per his Revdex.com reply) because under s.R113.4 of the 7th Edition of the [redacted] State Building Code, 780 CMR, violation of any provision of 780 CMR shall be punishable by a fine of not more than $1,000 or by imprisonment for not more than one (1) year, or both for each violation.CONTRACT AGREEMENTMr. [redacted] was trying to be sneaky and intentionally did not include the deck in the Contract Agreement, making it appear as though only a paver patio was constructed for $24,500.  This is a violation under the ** Office Of Consumer Affairs and Business RegulationI DISPUTE MR. [redacted]’S Revdex.com REPLY:1) Mr. [redacted] is not being truthful regarding incurring deck material expense.  On June 27, 2015 (Saturday 9:30 AM) - I called the company, [redacted], where Mr. [redacted] ordered the deck materials and spoke with the gentleman who took the order.  He told me the order had been cancelled and there was no penalty fee charged to Mr. [redacted].  Mr. [redacted] should have obtained a permit prior to ordering supplies, but regardless the company he ordered them from simply cancelled his order without charge.2) Mr. [redacted] did attempt to dissuade me from calling the town, I have attached my notes regarding this:June 25, 2015 - (Thursday)  Mr. [redacted] called at 8:30 AM to tell me there was not a problem with the deck design.  I informed him that I was going to call the town Building Permit Office to ask them about the deck design.  Mr. [redacted] was adamant about me not calling the town.  I asked him about obtaining a permit for the deck and he repeatedly told me a permit was not necessary or needed.  I informed Mr [redacted] that I wanted to call the town Building Permit Office for my own understanding of the code because I wanted to make sure there was no violation.  At that point Mr. [redacted] was attempting to coach me into what to say and what not to say to the town Building Permit Office.  He told me not to tell them my name or address.  He said this two or three times which seemed very strange.  He then came up with a sample dialogue of what questions they might ask and how I should answer.   It was becoming very clear that he did not want the town Building Permit Office to know about the deck. After I hung up with Mr. [redacted] I called the town Building Permit Office and spoke with the Permit Administrator. I immediately told her my name and address and explained my concern about the deck.  Her first question was “why hasn’t Mr. [redacted] obtained a permit?”   I told her that Mr. [redacted] told me repeatedly he did not need a permit and she was very surprised and informed me that all contractors with a Construction Supervisor License (CSL) know they have to obtain a permit to build a deck.  I also got the impression from the town Permit Administrator that Mr. [redacted]’s evasive behavior was unusual.  The town Permit Administrator called Mr. [redacted] and he then called me a short time later. Mr. [redacted] was clearly annoyed.  I had enough information at this point to determine that I could not trust Mr. [redacted] and  the Agreement was terminated.

check # [redacted] for $5,000.00 has been mailed to Mrs [redacted].  Please note that we are doing that as an indication of our committment to customer service even though the 3 day rescision period had passed & even though we are entitled to recoup expenses incurred on the project.  I wish Mrs [redacted] the best with her project.
