This tenant prospect was shown my rental listing by one of Our Realtors in December The tenant liked the home and submitted an application to lease the home beginning the first week of January The tenant was relocating from Utah
and had to handle application and lease execution remotely from Utah.Once the rental application was received and approved by the landlordA Standard Virginia lease was prepared and approved by the landlord. The lease was sent to the the tenant for review and signature. The tenant returned the lease with a very long list of editsMostly editing the language in the lease that protected the landlord This lease is a standardized document that all Realtors in VA use and created by our local Real Estate Association attorneys It answers most concerns that arise during tenants occupation of a property The edits sent back by the tenant prospect were not acceptable to the landlord and frankly, had the landlord concerned as to whether this prospect would be a problem tenant once they took possession After much consideration, the landlord responded to the tenant prospect stating that they were not willing to edit the standard lease and if the lease was not acceptable to the tenant prospect as it was written, then no further discussion about the house was necessary
The tenant arrived from Utah after the landlord had emptied and cleaned the house to the landlords satisfaction During the walk-through inspection the tenant remarked that the house was dirty and felt it was not being delivered to her in acceptable condition The landlord was notified of the tenants dissatisfaction and cleaning options were discussed The landlord agreed to have a maid service clean the house and a steam cleaner come and clean the carpets Since the landlord lived out of state, I made a Maid/carpet cleaner recommendation to the tenant The tenant was advised to contact the cleaning company, get the house cleaned and send the bill to the landlord for payment The landlords and my assumption was that the tenant would contact both cleaning services, get a quote, clear the price and services with the landlord and then have the work done(Note: this carpet steam cleaner runs a special of $for rooms, so the whole house should have cost approximately $300) Instead the tenant ordered both maid and carpet cleaners and appeared to have chosen the highest level of service without consulting the landlord The tenant subsequently submitted a bill to the landlord for just under $after all cleaning was completed Of course the landlord was upset and felt taken advantage of The landlord was not willing to pay this large number, it was not reasonable so he commenced to negotiate a split with the Tenant.
After a month of back and forth and subsequent misunderstandings, the split payment was agreed to and the issue was resolved
At the point that the lease was signed and possession was given to the tenant, the tenant and the landlord become partners and the broker steps away Unfortunately in this situation, there was conflict at the point of turnover and I as listing agent was compelled to work directly with the landlord in an attempt to not have any further miscommunications/misunderstandings or unsatisfied expectations from the tenant I chose to limit my communication to the landlord and have the landlord take all actions with the tenant directly The tenant did not like this and I apologize if the tenant felt abandoned The reality was that the lease was signed, money was paid, possession had been given to the tenant and he tenant had revealed themselves as difficult to deal with and likely to misunderstand or misinterpret communication between parties At this point my broker responsibilities were over and I was simply advising the landlord as a friend
I hope this explains our position on this conflict We run a clean professional business and have never had a complaint through the Revdex.com or any other entity since our inception in This is a first.
