Premier Surgery Center of Pittsburgh

Review: Today I spoke with three representatives with Premier Surgery Center of Pittsburgh to inform them that I would need to reschedule my surgery currently scheduled for May 16th due to a major life change. The last representative threatened that I would lose the $2000 prepayment that I had made. When I proceeded to explain my major life change, she refused to listen and stated that the penalty to cancel is 10%. I proceeded to tell her that 10% of my total balance was not $2000. I have thus requested that the center's manager contact me in the morning. According to the surgery proposal, the following is stated: 1. The deposit of your surgery is non-refundable should you cancel within 3 weeks of your scheduled surgery date.-I was trying to reschedule my surgery for later date. But according to their policy I am allowed to cancel within 3 weeks of surgery. Deposit is $1000; not $2000 2. If the need arises to reschedule your surgery, your deposit can be applied to surgery rescheduled within 90days, minus a rescheduling fee.- As stated, I am allowed to reschedule my surgery until 90days after May 16th original date3.If you cancel within 7 days of your scheduled surgery no refund will be given-I was canceling the May 16th surgery 8 days before (canceled on 5/8/2014, 8 days before 5/16). Document does not state "business days" just "days". Therefore, I am entitled to a refund should I choose not to rescheduleMy other complaints surround the fact that I never received receipt of my second deposit of $1000. When I was in the office during my second visit, I was told by the Premier Surgery Center of Pittsburgh representative that she was unable to run my card at their Wexford location. She was to run the card at their second office and send me a copy of receipt that I requested via postal mail. I have yet to receive the receipt or the updated proposal statement as I requested. The charge of $1000 has been applied to my WageWorks card.

I just spoke with [redacted] at Premier Surgery Center of Pittsburgh. She has agreed to refund me $1015 of the $2000. My complaint now is surrounding if their deposit return policy is legal. Most service providers surrounding medical care have a cancellation penalty however none have ever been more than $300. When I asked her if I could reschedule she stated I would still lose my deposit of $985. However their documentation states "if the need arises to reschedule your surgery, your deposit can be applied to surgery rescheduled within 90 days, minus a rescheduling fee." What [redacted] told me over the phone does not match their policy. A rescheduling fee is not $985. Desired Settlement: I am filing this complaint with the demand of one of the following:Refund of pre-deposits minus the minimum rescheduling fee which should not exceed a few hundred dollars according to normal medical practice. Rescheduling of my surgery up to 90 days from May 16th date as stated in their policyI am being nice to allow reschedule as I feel after speaking with their last representative and her threatening tone as if my surgery could be put at risk as a sign of retaliation
